Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Molly Wright Department of Public Health and Environment representative, Lauren Light The following business was transacted: hereby certify that pursuant to a notice dated May 16, 2024, and duly published May 22, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Wells Ranch, LLLP, c/o SunShare, LLC, dba Aquamarine Solar, LLC, and Beatrix Solar, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0001, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services, presented a brief summary of the proposal, stated construction will employ approximately 60 people, taking place Monday through Friday from 7:00 a.m. to 6:00 p.m. She explained a temporary construction trailer will be located onsite, as well as two (2) storage containers, with one (1) storage container remaining onsite during operation, which will require routine maintenance, project monitoring and vegetation control on a quarterly basis. She shared, per the Development Review staff, access will be onto County Road (CR) 64, which is a local, gravel road. Ms. Wright stated the week of equipment delivery, there will be a maximum of 14 truck round trips per day, and during the installation period there will be a maximum of four (4) truck round trips per day, and 24 passenger vehicle round trips per day. She relayed a Road Maintenance Agreement will be required, to include dust control and damage to specified haul routes, as well as a Stormwater Management Report. She described the sign posting, and stated Notice was sent to five (5) surrounding property owners (SPOs), with no responses received back. She relayed a Dust Abatement Plan was submitted, which indicated water trucks will be utilized during construction, and mechanical, biological, or chemical methods will be utilized for weed control. She shared the department has seven (7) Development Standards (DS) to be adhered to, and there are no outstanding items with this request. ... In response to Chair Ross, Kristy Weyerman, Sunshare, LLC, confirmed neither she nor the applicant had contact with any of the Commissioners regarding this case. Ms. Weyerman narrated a short history of the company, described the proposed site layout, and explained the finished site will connect to existing distribution lines. She described the fence to be installed around the site, noted Sunshare will be working with Xcel Energy, and detailed how locations are selected and how solar contributes to agriculture through sheep grazing and soil management. Ms. Weyerman shared a community meeting was held on March 7, 2024, at the Galeton Fire Station, with no attendance. In response to Chair Ross, Ms. Weyerman confirmed there is no irrigation on the property. No public testimony was offered concerning this matter. In response to Chair Ross, Ms. Weyerman, on behalf of the applicants, indicated they have reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. The Board reviewed the Conditions of Approval and Development Standards and no changes or corrections were made. Commissioner James moved to approve the request of Wells Ranch, LLLP, c/o SunShare, LLC, dba Aquamarine Solar, LLC, and Beatrix Solar, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0001, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Buck, and it carried unanimously.
