WHEREAS, the Weld County Planning Commission has presented the following
recommendation:
John Watson moved that due to the opinion of the people present, the
Weld County Planning Commission recommend to the Board of County Commissioners
that the Jack Chambers Petition for Change of Zone from "A" Agricultural
to "C" Commercial and "I" Industrial be denied. Seconded by Art King.
Unanimously carried.
and,
WHEREAS, the Board of County Commissioners believes it to be to the best
interest of the County to uphold said recommendation.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners,
Weld County, Colorado, do and hereby unanimously agree to uphold the recommendation
of the Weld County Planning Commission by denying any change of zoning in the
Fort Lupton Area.
The above and foregoing resolution was, on motion duly made and conded,
adopted by the following vote:

Minutes of Zoning Meeting - December 17, 1962
Appeal by Mr. Jack Chambers to change zones
from "A" to "C";
Mr. Reed called the meeting to order and asked if there were objections to
the proposed change in zoning in the Ft. Lupton area.
Mr. Max Ruhge of Route 1, Brighton asked to be heard, and quoted from the
Planning Commission Book, citing examples of infringement on pages in the
book, beginning with 1. He specifically cited pages 1, 6, 9 and 10. He
stated that if this zoning were accomplished, his property would decrease in
value. He also stated that since there was at the present time a feed
lot in the immediate area, that the addition of a public dump would pollute
the air even more. He stated also that the traffic would increase greatly on
the road behind his place, and that the road was all ready dusty. He stated
also that there is no speed zone on this road, and that due to the fact that
the road is not within the limits prescribed by law, that it is not patrolled
by either the county Or the state.
Mr. W. C. Klug of Route 1, Brighton, also objected to the dump on the grounds
that it was not in the best interests of the farmers in the area. He stated
also that it would cost to maintain the road, as the traffic increased.
Mr. Reed asked if there were more views to be expressed, and Mr. Chambers
stated his feeling that the area had been improperly zoned in the beginning
and that with the exception of Mr. Klug and Mr. Ruhge, there was very
little farming in the immediate area, but that it was primarily a
residential area, there being some twenty residences in the area, and he asked
if with this number of homes in the area, could it be designated as an
agricultural area.
Mr. Chambers also stated that in the event the property in question was sold,
any sort of business could be started there.
Mr. Ruhge asked whether a feed lot had to be 650 feet from any other property.
Mr. Ewing replied that only when the term "commercial feed lot° was used was
this necessary. He stated further that when the feed lot accommodated less
than 300 animals, it was not termed a commercial feed lot, and there were
no restrictions on the building of same.
Mrs. Ruhge stated that the increase of vandalism was sure to be a by-product
of the rezoning, and felt that it should not be allowed for this reason.
She stated that she had three children, and felt that their lives would
be endangered by the extra traffic, coupled with the foul air arising from
the dump.
Mr. Telep asked that the purpose of theneeting be clarified, and instructed
Mr. Reed that if the purpose had been accomplished, he could do one of
three things ask that the matter be decided immediately, ask for a brief
recess, or take the matter under advisement.
At this point, Mr. Reed asked Mr. Bean to clarify a point that Mr. Chambers

had made when he had said that the area was improperly zoned in the begin-
ning. Mr. Bean stated that Agricultural Zoning is a liberal term, and
tat in his opinion, it was not improperly zoned in the beginning.
Mr. Ruhge stated that he felt that Mr. Reed had all ready made up his mind,
and that he was taking sides. Mr. Reed explained that he was not the only
member on the board, and he could not see the reason for Mr. Ruhge believing
as he did.
Mrs. Ruhge asked if more police protection would be automatic, and Mr. Telep
assured her that it was not automatic.
Mr. Reed closed the meeting, stating that the Board would take the matter
under advisement, and would then notify interested persons of its decision.
Findings of the Board of County Commissioners on preceding hearing - December
17, 1962:
It was agreed unanimously to uphold the recommendation of the Planning
Commission, and deny any change of zoning in the Chambers appeal.
Motion made by Mr. Reed to deny "A" to "I", seconded by Mr. Shultz; Motion
made by Mr. Shultz to deny both, seconded by Mr. Ewing. Motion unanimously
carried.

MEMO TO WELD COUNTY COMMISSIONERS

On the 22nd day of October, 1962 the Weld County
Blanning Commission turned down the application for a
change of zoning for Mr. Jack Chambers.
The request was to change the area where a gravel
pit is located on Mr. Chambers property from "A" Agricul-
ture to "I" Industrial. Mr. Chambers also requested the
area where his Used Car Sales Lot is located to be changed
from "A" Agriculture to "C" Commercial.
Mr. Chambers has asked for the petition to be con-
sidered by the County Commissioners. Mr. Trafton Bean
is of the opinion that it is regular procedure for the
Commissioners to hold a Public Hearing even if the
Planning Commission does not approve of the change.
Would you please see that a Public Hearing is held
for the Commissioners.

Gentlemen:
At a Public Hearing of the Weld County Planning Commission held
On Monday, October 22, 1962, at 2:00 P. M. in the office of the Board
of County Commissioners, Court House, for a change of zone in the Fort
Lupton Area for part of Siff NE+ of Section 31, Township 1 North, Range
66 and owned by Jack Chambers, from "A" Agricultural to "C" Commercial
and "I" Industrial District, the Commission recommended the following:
John Watson moved that due to the opinion of the people present,
the Weld County Planning Commission recommend to the Board of
County Commissioners that the Jack Chambers Petition for Change
of Zone from "A" Agricultural to "C" Commercial and "I" Indus-
trial be denied. Seconded by Art King. Unanimously carried.
Reasons for this recommendation are:
1. Because of the great amount of evidence submitted by the
people present and this evidence being in opposition to
said change of zone.
2. According to our attorney the contract with the City of
Brighton was very loosely drawn, and too many loop holes
in sane.

TO ALL INTERESTED PERSONS:
On the 22nd day of October, 1962, at 2:CO P. M. in the office of the Board of County
Commissioners, Court House, Greeley, Colorado, the Weld County Planning Commission
will hold a public hearing concerning the change of zone of an area located South of
Fort Lupton on the East side of U. S. HigFway 85 approximately three -fourths of a
mile North of the Weld County line from Agricultural Zone to "I" Industrial Zone

Dear Sir:
We thank you for the opportunity to comment on the proposed
zoning South of Ft. Lupton, near the Adams County line. It is
only with co-operation across political boundaries that effective
planning can be accomplished.
It appears that this request for rezoning is within a tran-
sitional highway area. Unless there would be supporting develop-
ment or if the proposed development would be self-contained, re-
zoning of commercial and industrial property would lead to high-
way strip zoning. The proposed use should be thoroughly examined
to determine if the land utilization would be correct with future
anticipated development. For example, many highway commercial and
industrial uses in reality become junk automobile storage areas.
Without supporting economic development or proof of the self
contained nature of the development the Adams County Planning De-
partment stands as opposed to the rezoning.
