RE: ACKNOWLEDGE AND OBJECT TO COLORADO LIQUOR SALES ROOM
APPLICATION, AND AUTHORIZE CHAIR TO SIGN - ROCK N ROLL BREWERY, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Colorado Liquor Sales Rooms are under the sole jurisdiction of the Colorado
Department of Revenue, Liquor Enforcement Division, pursuant to C.R.S. §44-3-202 and
Regulation 47-428, 1 C.C.R. 203-2; however, applicant(s) are required to submit a copy of their
application and associated materials to the local licensing authority for review, and
WHEREAS, Rock N Roll Brewery, LLC, presented to the Board, an application for a
Colorado Liquor Sales Room for the sale of fermented malt beverages and malt liquors for
on -premises consumption, subject to the rules and regulations found in Article 3, Title 44, C.R.S.,
for comment upon whether or not the Board has an objection to the issuance of said Colorado
Liquor Sales Room, and
WHEREAS, Rock N Roll Brewery, LLC, is duly licensed as a Manufacturer, by the
Colorado Department of Revenue, and
WHEREAS, the proposed Colorado Liquor Sales Room is located outside the corporate
limits of any town or city in the County of Weld at the location described as follows:
Rock N Roll Brewery, 10286 County Road 15, Longmont,
Colorado 80504; being further described as Lot 1 of Enchanted Hills
Subdivision and Lot 11 of Resubdivision, RES23-0001; being within
Section 8, Township 2 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, Weld County departmental staff reviewed said application and indicated
issuance of said Colorado Liquor Sales Room would violate local zoning laws and recommends
the Board object.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, having examined said application does hereby declare that it objects to the
Colorado Department of Revenue granting a Colorado Liquor Sales Room to Rock N Roll
Brewery, LLC.

with local regulations or ordinances.

Lease Agreement
This Lease Agreement is for property located at: 10286 County Road 15, Longmont CO, 80504
Monthly Rent shall be: $ No Charge This lease agreement begins on: 1-1-2022
and shall end on: 12-31-2230 The lease is between: Steve Maas
(hereafter known as lessor) and all lease signer. All lease signers (tenants), agree to the following:
1.The residence shall only be occupied by the following persons: Rock N Roll Brewery, LLC
hereby known as tenant or tenants.
2.No others may occupy the residence for longer than 7 days without written permission from lessor.
3.Security deposit in the amount of $ 0.00 shall be held by lessor until 60 days past lease end (NO VERBAL
AGREEMENTS) via tenant(s) and lessor. It is tenant's responsibility to notify lessor of forwarding address to receive security
deposit upon lease termination.
4.Security deposit will be held against: any property damages beyond normal wear and tear and/or unpaid utility bills.
Property damage is considered CAUSED BY TENANT unless a POLICE REPORT has been filed and lessor has been
contacted within 24 hours of discovery of damage.
5.Security deposit is not to be used as last month's rental payment. If tenant refuses to pay final month's rent, an eviction
proceeding will be initiated. This may result in a judgment and eviction on the record of the tenant.
6.If lessor sells or assigns the leased property, lessor shall have the right to transfer the lease and security deposit to the new
owner or assignee and upon so doing, lessor shall be released from any and all liability to tenant.
7.No sub -leases are allowed without written permission from lessor.
8.Rent payments are due on the first of each month. Lease agreements begun other than the first of the month will be
pro -rated 1/30 of a monthly rent payment to the next month's start.
9. Tenant will give lessor a 30 -day written notice of intent to vacate the property when tenant intends to vacate property at
lease end.
10. Breach of lease agreement. Any breach of this lease agreement may allow lessor to terminate the lease agreement with
30 days written notice delivered by hand or registered mail. Any breach of this lease agreement may allow lessor to consider
tenants as month -to -month tenant lessees. Any breach of lease agreement by one tenant is considered as breach of lease
agreement by all tenants. Breach of lease agreement is valid for 3 months past. Failure to keep utilities paid is considered
breach of lease agreement. Paid utilities means no disconnections have been done.
11. Abandonment. Leased property is considered abandoned if not occupied for a period of 7 days and rent is owed to
lessor. Any abandonment shall be considered as breach of lease agreement. This definition is subordinate to, and shall not
in any way impair the rights and remedies of lessor under this lease agreement or applicable law, except that in case of
abandonment, lessor may immediately re -take the premises abandoned by the tenants, as provided by applicable law, and
terminate this lease agreement without notice to tenants.
12. Property is leased for use of small brewery.

SALES CONTROL PLAN: I am asking to conduct beer sales outdoors during the warmer weather months from May through October. This would be limited to Fridays from 3 pm to
8 pm, Saturdays & Sundays from noon to 6 pm, and some holidays including Memorial Day weekend, 4th of July weekend, Labor Day weekend, and an October Fest event. If the
building qualified for on -site tours inside, then I would like to sell all year. Inside would be just 50 people max. Outdoor events 200 people capacity max. Much of the proceeds will be to
raise funds for charities including Children's Hospital. Keep in mind that "Wild Cider" is a local winery in our area which conducts very large events with a much larger capacity, and is
also located on their ranch property.
BREWERY HISTORY: In 1985 I started my first commercial brewery. I am considered a pioneer in the brewing industry, my work has been published in respected brewery author's books. If
you are a craft beer lover. I believe you will appreciate what I produce. There is more information about my brewery history at rockNroll.beer In 2016, I decided to brew again under the name of
Rock N Roll Brewery, LLC.

The Colorado Department of Revenue, Liquor Enforcement Division (LED), solely reviews and issues
Manufacturer's Licenses for the manufacture of various alcohol products. However, when an existing

Chloe,
This subject property owned by Steve Maas has not received a land use permit for the operation of his
brewery. The property owner does currently brew beer on site but public does not come to the site.
There has been many conversations regarding the ability for public to enter the property but no formal
submittal has occurred. This proposed use would fall under a Zoning Permit for Certain Uses in the Agricultural
Zone District (ZPAG) for a Brewery.

Good afternoon,
The Colorado Department of Revenue, Liquor Enforcement Division (LED), solely reviews and issues
Manufacturer's Licenses for the manufacture of various alcohol products. However, when an existing
manufacturer applies for a `Sales Room', which allows them to serve alcohol to the public, LED allows the local
licensing authority the chance to review the application.
This afternoon, LED submitted the attached application and requested we expedite our review, if possible.
Please complete and return the attached "Staff Referral Memo — Rock N Roll Brewery, LLC". Your report will
be used by the Board of County Commissioners in considering the Applicant's Colorado Sales Room
Application.

The Colorado Liquor Enforcement Division forwarded your application for a permanent Colorado Liquor Sales
Room at 10286 County Road 15, Longmont, Colorado 80504, because your property is located in
unincorporated Weld County. Part of Weld County's process for reviewing applications includes sending a
copy of the application materials to various Weld County Departments for referral review prior to listing it on the
Weld County Board of Commissioners' regular Agenda for final review and recommendation.
On your application, you indicated the 'date application copy submitted to local licensing authority' as 'TBA'.
Since I received it for the first time yesterday, I will date stamp the application packet as 6/5/2024, which starts
our 45 -day allowance. However, one of the requirements of LED is that you, 'Attach a copy of the premises
control plan describing how the premises will be controlled to ensure compliance with liquor code and rules. It
must include restricting sales to minors and visibly intoxicated persons and insuring that customers cannot
leave the premises with an open container of alcohol." Your diagram labeled, 'On -Site Sales Control Plan' does
not currently include your plan for restricting sales to minors and visibly intoxicated persons, nor does it show
how you will insure that customers cannot leave the premises with an open container of alcohol. Additionally, I
have the following questions regarding your diagram(s):
• Is the red outline on the diagram indicative of your liquor licensed premises?
• If so, how will it be controlled, i.e. fencing, ropes, barriers, etc.?
• What are the dimensions of your liquor licensed premises (i.e. fencing, ropes, barriers, etc.)?
Can you also please provide a copy of the deed to your property?
Furthermore, I have received the Department of Planning Services' referral review comments, which I have
included below:
This subject property owned by Steve Maas has not received a land use permit for the operation of his
brewery. The property owner does currently brew beer on site, but the public does not come to the site.
There have been many conversations regarding the ability for the public to enter the property, but no
formal submittal has occurred. This proposed use would fall under a Zoning Permit for Certain Uses in
the Agricultural Zone District (ZPAG) for a Brewery.
It is my understanding that the ZPAG application process typically takes around 60 -days. Please address the
Department's requirements and contact the Planner On -Call at (970) 400-6100 as soon as possible.

To my knowledge, this is in Weld County's jurisdiction, not the City of Longmont's. I can't make any promises
regarding how quickly I can have this application reviewed because I have to send it for referral review by
various Weld County Departments. Additionally, I don't see that there is a land use permit currently on file, so
it's possible this might violate our zoning laws. However, that is not my area of expertise, which is why I need
to send it to different Weld County departments for referral review.
I'll be in touch to keep you updated and will also reach out to the applicant if we have any comments and/or
requirements.
