Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James — EXCUSED Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Diana Aungst Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 18, 2024, and duly published November 20, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Jerry Cass, c/o Zen Midstream, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0022, for Oil and Gas Support and Service (compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Chair Ross reviewed the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner James being excused. El Diana Aungst, Department of Planning Services, presented a summary of the proposal, described the sign posting and location of the site. She relayed 11 referrals were sent out, and seven (7) agencies responded with no concerns, or included comments which are addressed in the Conditions of Approval (COA) and Development Standards (DS). She described the surrounding uses, and explained the closest residence is located 300 feet from the site. Ms. Aungst shared nine (9) surrounding property owners (SPOs) were notified and no correspondence was received back. She explained, per the Development Review staff, access is onto County Road (CR) 74, which is a local gravel road, and stated the latest average daily traffic counts 697 vehicles per day, with 48% trucks, and the 85th percent speed is 51 mph. Once operational, the site will generate ten (10) passenger vehicles and two (2) semi -truck daily round trips. She stated a Road Maintenance Agreement is requested including, but not limited to, dust control and damage to specified haul routes, a Preliminary Drainage Report has been submitted, a Final Drainage Report is required, and a Weld County Grading Permit is required if more than cc: in. Ms. Aungst entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. Lauren Light, Department of Public Health and Environment, stated screened portable toilets are acceptable, an Air Pollution Emission Notice (APEN) will be required from the state, and Dust Mitigation and Waste Handling Plans have been submitted, adherence of which are required in the DS. She further stated a Noise Impact Assessment was prepared by Urban Solution Group, which stated the site will comply with the Light Industrial noise standard, with one receptor located 25 feet west of the property line, which was not in compliance, therefore, the Industrial Standard was included in the DS. She stated Environmental Health has 15 DS to be adhered to, with no outstanding items with the request. Ei Jennifer Teeter, applicant representative, narrated a PowerPoint Presentation providing a history of Zen Midstream owned by Bison Oil and Gas LLC. She reiterated the request as described by Ms. Aungst and reviewed the location of the site. She stated the proposed Wren compressor station is not likely to impact nearby residential areas or communities, and described the proposed fire prevention measures, fencing to be installed around the perimeter of the site, lighting, access, and the Dust Mitigation Plan. She shared the closest residence is 640 feet from the proposed project. No public testimony was offered concerning this matter. El Ms. Aungst requested COA #1.A (Oil and Gas Energy Department advisory comments) be removed. The Board reviewed the Conditions of Approval and Development Standards. In response to Chair Freeman, Ms. Aungst explained the existing access is used for another facility, and although the access for the proposed use will be in the same location, a new permit will be requested. The Board agreed to all of the aforementioned changes. El In response to Chair Ross, Ms. Teeter, on behalf of the applicant, indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. IR Commissioner Saine moved to approve the request of Jerry Cass, c/o Zen Midstream, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0022, for Oil and Gas Support and Service (compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously.
