HomeMy WebLinkAbout20242706.tiffRESOLUTION RE: APPROVE CANCELLATION AND FULL RELEASE OF COLLATERAL FOR IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS (PUBLIC ROAD MAINTENANCE) FOR PLANNED UNIT DEVELOPMENT FINAL PLAN, PF-#1037 - STARK FARMS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 2, 2002, the Department of Planning Services staff approved a Planned Unit Development Final Plan, PF-#1037, for Stark Farms, LLC, 223 North College Avenue, Fort Collins, Colorado 80524, for 38 lots with E (Estate) Zone uses on the following described real estate, to wit: Part of the NE1/4 of Section 12, Township 7 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, on October 27, 2003, the Board of County Commissioners of Weld County, Colorado, approved an Improvements and Road Maintenance Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Stark Farms, LLC, with further terms and conditions being as stated in said agreement, and accepted project collateral, in the form of Irrevocable Letter of Credit #249 from New Frontier Bank, 2425 35th Avenue, Greeley, Colorado 80634, in the amount of $362,968.00, and WHEREAS, on September 10, 2004, said Irrevocable Letter of Credit #249 expired, and New Frontier Bank closed on April 10, 2009, and WHEREAS, by letter from the Federal Deposit Insurance Corporation, dated July 21, 2009, identified as Document ID #2009-3794, the County was notified of said closing and the intent to disaffirm said Letter of Credit #249 to the full extent, and upon recommendation of staff, the Board deems it advisable to release said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the currently held warranty collateral, procured in the form of Irrevocable Letter of Credit #249 from New Frontier Bank, 2425 35th Avenue, Greeley, Colorado 80634, in the amount of $362,968.00, be, and hereby is, canceled and released. New Frontier Bank closed April 10, 2009. No further collateral is required to be held. Weld County Planning Services and Public Works Departments performed a site inspection, at the above -mentioned site, and observed the following: • All items on Exhibit A, of the Improvements Agreement According to Policy Regarding Collateral for Improvements Document Tyler #2003-2998, have been completed and are found to be acceptable. What options exist for the Board? (include consequences, impacts, costs, etc. of options): 1. Have this BOCC Hearing item be placed on the next available agenda as part of the Consent Agenda. 2. Have this BOCC Hearing item be placed on the next available agenda as part of the Regular Agenda. 3. Have this BOCC Hearing item not placed on the next available agenda as neither part of the Consent Agenda nor the Regular Agenda.
