Anderson offered the following resolution and moved its adoption: WHEREAS, Weld County, Colorado, has acquired and is the owner of the following described real estate, duly recorded in the records of the County Clerk and Recorder of the County of Weld, State of Colorado, as follows, to -wit: TREAS RECORDED RECEPTION DEED DATE BOOK & PAGE NUMBER DESCRIPTION 2563 10/1/49 1254 1067872 423 and Lot 2, Block 15 Lot 4, Block 16 Lot 4 & 7 to 9 Block 17, Lots 4 to 12 Block 23 Carr, Colorado WHEREAS, said property has been duly advertised for sale at public auction held on the 2nd day of August 1967, at the hour of 2:00 o'clock P. M. in the Office of the Board of County Commissioners, excepting therefrom the reservations in favor of the Union Pacific Railroad Company; and excepting therefrom the reservations in the United States Patent and existing reservoir sites and irrigation ditches, if any, existing rights -of -way for public highways and roads, and any and all existing easements of rights -of -way, however evidenced or acquired, and subject to existing leases, and excepting therefrom all oil, gas and other minerals therein or thereunder, together with the right to prospect for and remove the same; and all county owned structures, if any, on said property, and all property used for county purposes; and WHEREAS, at said sale J. D. Cameron, c/o Bert H. Thomas of Carr, Colorado, bid $50.12 as the purchase price for said property and being the highest and best bidder, said property was sold. NOW, THEREFORE, BE IT RESOLVED, that Francis M. Loustalet, County Treasurer be and he is hereby constituted and appointed as Commissioner for Weld County, Colorado, and is hereby ordered to convey without covenants of warrantyto J. D. Cameron the property more particularly described as follows; to -wit: Lot 2, Block 15; Lot 4, Block 16; Lot 4 & 7 to 9; Block 17 Lots 4 to 12, Carr, Colorado. Block 23, excepting therefrom the reservations in favor of the Union Pacific Railroad Company; acid excepting therefrom the reservations in the United States Patent and existing eservoir sites and irrigation ditches; if any, existing rights -of -way for public highways and roads, and any and all existing easements of rights -of -way, however evidenced or acquired, and subject to existing leases; and excepting therefrom all oil, gas and other minerals therein or thereunder, together with the right to prospect for and remove the same; and all county owned structures, if any on said property, and IT IS FURTHER RESOLVED, that as to such conveyance, Francis M. Loustalet is authorized to affix the seal of Weld County and said conveyance, shall have the effect to transfer to said J. D. Cameron of Calgary, Alberta, Canada - C/o Bert H. Thomas of Carr, Colorado, all right and interest which Weld County has in and to the above described property subject to the exception and reservations hereinabove mentioned or referred to. Weld County does not warrant title. February 19, 1968 Dear Mr. Yeabsley: The Board of County Commissioners of Weld County Colorado, has received a letter dated February 9, 1968, from Mr. J D. Cameron, copy attached for ready reference, wherein he requests than. Weld County transfer certain loos to you My reason for writing this letter to you is for you to inform Mr. Cameron (I don't have his address.) that he is the legal owner of the lots -referred to ant, if he sold same to you, then it is his legal duty ana obligation to transfer same to you, at his expense and by paying the necessary revenue depending upon the amount of the purchase price. I regre, that we cannot be of service, either to you or to Mr. Cameron at this time; however, if Mr. Cameron requests that I execute a proper deed transferring the lots to you, I will do so and forward same to him for his signa- ture and returned to me for recording here in Weld County, Colorado. After recording said deed of transfer, same will be returned to you for your files. As stated above, the cost for preparation for the trans- fer deed is always the expense of the seller and the cost for recording the instrument is always borne by the purchaser.
