Public Service Company of Colorado ("Xcel") has submitted an application for a use by special review — 1041 Major Facility of a Public Utility or Public Agency to construct approximately 47.2 miles of electric transmission line in Weld County (the "Application"). The electric transmission line is proposed to occupy the length of 18.17 acres across three parcels owned by Pioneer shown in Figure 1 below ("Pioneer's Property"). Pioneer's Property is included in the Project consisting of 3,400 acres which is anticipated to be developed with single family and multi -family homes, commercial, retail, and other amenities in the Town of Keenesburg ("Keenesburg"). The first phase of the Project began in 2018 when Keenesburg approved the annexation and zoning for a portion of the property comprising the Project, as shown in the zoning ordinance and recorded annexation map attached hereto and incorporated herein as Exhibit A. The second phase of the Project continued in 2022 when Keenesburg approved the annexation and zoning for Pioneer's Property, as shown in the ordinances attached hereto and incorporated herein as Exhibit B. This raises significant jurisdictional issues as to whether Weld County should be reviewing the Application on Pioneer's Property or if Keenesburg is the appropriate reviewing authority considering the significant amount of time, planning, and effort that has been made by Pioneer and Keenesburg for the future development of Pioneer's Property. Notwithstanding the question of jurisdiction, Pioneer, as a negatively affected property owner, requests that the Planning Commission recommend denial of the Application because it fails to meet the criteria per §§ 23-2-220.A of the Weld County Code (the "Code"). Under § 23-2- 1 EXHIBIT 1105C-47A-na.):1) a P; to sell a portion of such Property. Although Weld County zoning of Pioneer's Property is currently agricultural, there is no doubt that the approved zoning in Keenesburg provides more development potential. As a result, the loss of private property rights will be much more devastating to Pioneer. 11. Application frustrates the goals and objectives of the Plan. In accordance with Code § 22-2-30.B, it is a land use goal and objective to locate urban development in urban areas. Specifically, Code § 22-2-30.B states that urban - scale residential development belongs in municipalities and should be placed where urban services, including public water, are available. To achieve this goal of the Plan, Pioneer sought and obtained Keenesburg's approval for the annexation and zoning of its property to residential and industrial designations. To further demonstrate the urban scale of Pioneer's development plans, Pioneer Metropolitan Districts No. 1-6 and Pioneer Regional Metropolitan District (collectively, the "Pioneer Districts") were organized in Weld County following approval by the Board of County Commissioners on February 6, 2006. Resource Colorado Water and Sanitation District was also formed following approval by the Weld County Board of County Commissioners in 2004 ("Resource" and together with the Pioneer Districts, the "Districts"). The Districts were formed to provide urban services to Pioneer's Property, including but not limited to water and sanitation services, street, drainage, and park and recreation. The service plans for the Districts approved by Weld County, authorized the issuance of debt up to $330,000,000 to fund the infrastructure necessary for the urban development. Given the large scale nature of the Pioneer urban development, the Pioneer Districts have formed the Pioneer Community Authority Board to centralize services (the "Authority"). The Pioneer Districts and the Authority have issued the following debt to finance the water, water pipelines and improvements, design and other public improvements necessary to provide urban services to the Pioneer development: applicable. The Keenesburg Municipal Code defines the purpose of the R-2 District as providing for low to moderate -density residential development and allows two-family housing units.1 The only uses by right enjoyed by public utilities in the Keenesburg Municipal Code are underground utility distribution mains and lines, demonstrating that a large overhead electric transmission line is inconsistent with a residential area. And, most importantly, the location of the transmission line eliminates Pioneer's ability to develop and sell several lots intended for residential uses. 11. Inconsistency with L-1 District. The same is true in the L-1 District. The L- IDistrict provides for land areas to be used primarily for research and development, mini warehousing, small product assembly and manufacturing and other services, distribution and industrial uses that are relatively nonpolluting and have few off -site impacts as a result of the operations on -site. Above ground utility lines are not related to any of the aforementioned primary uses in the L-1 District and may only be approved as a special review use.2 And, the location of the transmission line eliminates Pioneer's ability to develop and sell several lots intended for light industrial uses. iii. Inconsistency with 1--1-2 District. The third parcel on Pioneer's Property in which the electric transmission line will cross is in the H-2 District. Even in this heavy industrial district, major facilities of a public utility are only permitted as a special review use. The H-2 District is reserved for land areas to be used primarily for manufacturing, assembly and distribution of basic goods. In addition, uses that involve resource extraction operations and recycling, storage and disassembly of all types of used products and related support uses are included within this category. The electric transmission line is not a use by right nor an accessory use in this heavy industrial District, indicating the intense nature of electric transmission lines. And the location of the transmission line eliminates Pioneer's ability to develop and sell several lots intended for heavy industrial uses. B. Compatibility with Future Development as Projected by the Plan i. Incompatible Easement Location. Xcel must obtain an easement for the electric transmission line from Pioneer; however, the location of the needed easement is incompatible with the uses that are planned for that portion of Pioneer's Property, as explained herein. If an easement were to be conveyed to Xcel in the requested location, a substantial portion of Pioneer's Property will become undevelopable. Xcel has not taken into account the future development of Pioneer's Property in valuing the easement. For the parcel in the R-2 District, the proposed easement will cause Pioneer to forfeit forty (40) single-family ' Keenesburg Municipal Code § 16-2-90. Z Keenesburg Municipal Code § 16-2-140. 5 iii. incompatibility with the Keenesburg Comprehensive Plan — Heavy Industrial District. The heavy industrial category is intended to provide for areas where substantial manufacturing or product processing may occur, including the output of finished products made from raw materials. An electric transmission line could negatively impact these types of specialized uses.6 For the foregoing reasons, Pioneer requests that the Planning Commission recommend denial of the Application. We have also advised Xcel that bisecting the property (as proposed) leaving islands of less -impacted lands is not acceptable and to reroute the line around our property to existing state property which abuts her property in all directions other than toward the west. It is hard to make a case for eminent domain or for the government to take her land when the government (by way of a utility) already owns the land on three of the four sides already. The Foster Letter referenced certain parcels' owned by Pioneer Holdco LLC ("Pioneer") that the proposed electric transmission line would cross as part of the Project and raised purported "jurisdictional issues" with the Applications.' Specifically, the Foster Letter claims that "Keensburg approved the annexation and zoning" for the properties crossed by the Project in 2022, making Keensburg the "appropriate reviewing authority" for the Project, not Weld County. Mr. Foster is mistaken about the status of the Pioneer properties that will be crossed by the Project. Pioneer owns about 3,400 acres of property that it plans to, at some point, annex into the Town of Keenesburg and develop with a combination of single family and multi -family homes, commercial, retail, and other uses. In 2018 Pioneer did annex and zone a portion of its property into Keenesburg. See Exhibit A to the Foster Letter. It has not, however annexed or re -zoned the parcels crossed by the Project. The annexation ordinance attached as Exhibit B to the Foster Letter was subject to certain conditions. See Section 2 of Exhibit A to the Foster Letter. It is our understanding that not all of those conditions were satisfied, and therefore the property crossed by the Project has never been annexed into Keenesburg.
