BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, NOVEMBER 4, 2024
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, November 4, 2024, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

L. MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of October 21, 2024, as printed, Commissioner Buck moved to approve. Commissioner James
seconded the motion and it carried unanimously.
El READ ORDINANCE BY AUDIO: Commissioner James moved to read Ordinance #261, and Code
Ordinances #2024-13, #2024-14, and #2024-15 by audio. The motion was seconded by
Commissioner Buck and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the Agenda.
CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Freeman seconded the motion and it carried unanimously.
PRESENTATIONS:
1) RECOGNITION OF SERVICES, HUMAN SERVICES ADVISORY COMMISSION - LISA TAYLOR
AND TOM TEIXEIRA: Chair Ross read the certificates for the record. Lisa Taylor was present and
acknowledged the collaborative efforts and great work of those who are involved on the Board. The Board
recognized her engagement, leadership, and her voluntary contributions on behalf of the citizens of
Weld County. (Clerk's Note: The group gathered for a photo opportunity.)

• 2) RECOGNITION OF SERVICES, JUVENILE COMMUNITY REVIEW BOARD -
YVETTE GUTHRIE AND MARGIE GOMEZ: Chair Ross read the certificates for the record.
Margie Gomez was present and the Board commended her on her long-standing commitment and
voluntary contributions on behalf of the citizens of Weld County. (Clerk's Note: The group gathered for a
photo opportunity.)
CI 3) RECOGNITION OF SERVICES, WELD COUNTY COMMUNITY DEVELOPMENT BLOCK
GRANT ADVISORY COMMITTEE - DEBBIE LEWIS DEMILLE: Chair Ross read the certificate for the
record and thanked Debbie Lewis Demille for her voluntary contributions on behalf of the citizens of
Weld County. Ms. Demille was not present, but Chair Ross indicated she will be sent her certificate.
• 4) RECOGNITION OF SERVICES, WELD FAITH PARTNERSHIP COUNCIL —
MARGIE MARTINEZ: Chair Ross read the certificate for the record and the thanked Margie Martinez for
her voluntary contributions on behalf of the citizens of Weld County. Ms. Martinez was not present, but
Chair Ross indicated she will be sent her certificate.
El PROCLAMATIONS:
1) NATIONAL ADOPTION MONTH - NOVEMBER 2024, AND WELD COUNTY ADOPTION DAY -
NOVEMBER 22, 2024: Jamie Ulrich, Director of the Department of Human Services, thanked the Board
for their recognition and took the opportunity to highlight the initiative created for increased awareness
by the National Children's Bureau for children and youth in the foster care system. In honor of National
Adoption Day, she indicated the department will help facilitate the finalization of twelve (12) adoptions on
November 22, 2024, at the Weld County Courthouse. Ms. Ulrich reported the number of children who are
currently waiting permanency with a focus on teen -aged youth who are historically being the most
challenging to place in their `Forever Homes.' Ms. Ulrich recognized the staff who were present, and
expressed her heart -felt appreciation for their passion and dedication to fulfill their calling to serve the
children in communities throughout Weld County. The Board recognized the fundamental and
foundational values of the core family and the importance of sacrificial work done by staff on behalf of
the children, youth, and expectant families. (Clerk's Note: The group gathered for a photo opportunity.)
WARRANTS:
1) GENERAL WARRANTS - NOVEMBER 1, 2024: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner James seconded the motion and it carried unanimously.
• BIDS:
1) APPROVE BID #B2400136, KEENESBURG GRADER SHED DESIGN AND ENGINEERING
SERVICES - FACILITIES DEPARTMENT: Toby Taylor, Purchasing Department, stated staff
recommends selecting the lowest bidder who met specifications, Robert Shreve Architects and Planners,
Inc., for a total amount of $47,800.00. Commissioner Buck moved to approve said bid. The motion was
seconded by Commissioner James, and it carried unanimously.
• NEW BUSINESS:
1) CONSIDER APPOINTMENT OF DAVID EISENBRAUN AS DIRECTOR OF WELD COUNTY
DEPARTMENT OF PLANNING SERVICES: David Eisenbraun introduced himself for the record. He
shared his pleasure and honor of joining Weld County, expressed his excitement to bring his skills and
knowledge to contribute to the County's values and growth. In response to Commissioner Saine, Mr.
Eisenbraun shared personal memories for the record. In turn, the Board welcomed him to 'Team Weld'
and provided words of encouragement. Commissioner Freeman moved to approve said appointment.
The motion was seconded by Commissioner James, and it carried unanimously. (Clerk's Note: The group

2) CONSIDER CONTRACT ID #8832 2024 MULTIMODAL TRANSPORTATION AND MITIGATION
FUNDS (MMOF) CALL FOR PROJECTS APPLICATION FOR ON -DEMAND TRANSIT PROGRAM,
AND AUTHORIZE DEPARTMENT OF PUBLIC WORKS TO SUBMIT ELECTRONICALLY - NORTH
FRONT RANGE METROPOLITAN PLANNING ORGANIZATION (NFRMPO): Evan Pinkham,
Department of Planning Services, requested approval to submit an application for the On -Demand Transit
Program for grant funding to provide services through Via Mobility with various municipalities, from
September 1, 2025, through August 31, 2028. In response to Commissioner Saine, Mr. Pinkham
indicated the program local match is 25%, but further clarified that cost is shared among the partner
communities that participate and is based on population. He estimated roughly 1,500 rides have occurred
since the program began to accommodate the elderly, compromised, and para-rides for individuals who
are disabled. Commissioner Saine requested the determination of cost per ride to assess if there are
more cost-effective options. Chair Ross indicated the program fills the gap for individuals who do not
qualify for other programs, like 60+ Rides. After discussion, Curtis Hall, Director of the Department of
Public, extended his apologies for not addressing Commissioner Saine's questions and concerns ahead
of the meeting. Commissioner James moved to approve said application and authorize the Department
of Public Works to submit electronically. The motion was seconded by Commissioner Buck.
Commissioner Saine requested a work session to explore further discussion with other transit options
that could be more cost-effective for the taxpayers. There being no further discussion, and upon a roll
call vote of four (4) to one (1), the motion carried with Commissioner Saine opposed.
3) CONSIDER CONTRACT ID #8834 AMENDMENT #1 TO GRANT AGREEMENT FOR SAFE
STREETS AND ROADS FOR ALL (SS4A) PLANNING GRANT PROGRAM, AND AUTHORIZE CHAIR
TO SIGN: Mr. Pinkham stated the amendment allows for the addition of municipalities located in
Weld County that have elected to adopt the County's Safety Action Plan, with no additional cost to the
county. He noted the county has received positive responses from fifteen (15) municipalities that plan to
pursue funding through the Federal Highway Administration (FHWA). Commissioner James indicated his
appreciation of the opportunity for additional funding and further moved to approve said amendment and
authorize the Chair to sign. The motion was seconded by Commissioner Buck. Chair Ross echoed
Commissioner James' sentiments. There being no further discussion, the motion carried unanimously.
IR 4) CONSIDER COUNTY DANCE HALL LICENSE NO. 2025-01 AND AUTHORIZE CHAIR TO
SIGN - RM, INC., DBA ROOM 119: Matthew Conroy, Assistant County Attorney, gave a brief overview
of the location of the establishment which has held their Dance Hall License since 2017, and stated there
are no concerns from referral agencies. No public testimony was offered concerning this matter.
Commissioner Freeman moved to approve said license and authorize the Chair to sign. The motion was
seconded by Commissioner James and it carried unanimously.
5) CONSIDER INCREASE OF CHANGE FUND FOR WELD COUNTY SHERIFF'S OFFICE
SOUTHWEST SUBSTATION: Chris D'Ovidio, Interim Weld County Controller, stated the southwest
substation of the Sheriff's Office has requested an increase to their cash fund from $50.00, to $100.00,
to accommodate the increased amount of large dollar transactions. Commissioner Saine commented she
has no concerns with this item despite the pass around indicating she did. Commissioner Freeman moved
to approve said increase of Change Fund. The motion was seconded by Commissioner James and it
carried unanimously.

• 6) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE
SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO
INTERIM CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Mr. D'Ovidio referenced a list of
equipment that has reached end -of -life and will be sent to auction on November 6, 2024. He indicated all
replacement equipment is already in production and recommends approval. Commissioner Buck moved
to approve said declaration as surplus property, sale of same at auction, and authorize the Interim
Controller to sign any necessary documents. The motion was seconded by Commissioner Freeman and
the motion carried unanimously.
• 7) CONSIDER APPOINTMENT TO HUMAN SERVICES ADVISORY COMMISSION:
Commissioner Freeman moved to approve said appointment. The motion was seconded by
Commissioner Buck, and it carried unanimously.
Ei 8) CONSIDER REAPPOINTMENTS AND REASSIGNMENTS TO JUVENILE COMMUNITY
REVIEW BOARD: Commissioner Buck moved to approve said reappointments and reassignments. The
motion was seconded by Commissioner James and it carried unanimously.
• 9) CONSIDER REAPPOINTMENTS TO WELD FAITH PARTNERSHIP COUNCIL:
Commissioner Saine moved to approve said reappointments. The motion was seconded by
Commissioner Buck and it carried unanimously.
le 10) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR DECEMBER 4, 2024: Commissioner James moved to approve said cancellation. The
motion was seconded by Commissioner Freeman and it carried unanimously.
11 11) FIRST READING OF CODE ORDINANCE #2024-13, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 12 LICENSES AND PERMITS OF THE WELD
COUNTY CODE (LIQUOR LICENSES AND PERMITS, AND COUNTY DANCE HALL LICENSES):
Mr. Conroy gave a brief overview of the proposed changes to Chapter 12 regarding liquor licenses and
permits, and dance hall permits. He detailed administrative improvements for liquor licensing, delegated
inspections from a volunteer Commissioner to the Clerk to the Board who will report back to the
Commissioners. He further stated renewal licenses with no concerns from staff and referral agencies will
be placed on the Consent Agenda for approval, and pursuant to changes in state statute, licensees are
allowed to opt for a biannual renewal application process. In response to Commissioner Saine,
Mr. Conroy clarified state law allows local licensing authorities the right to refuse to renew or suspend a
license if the licensee is not in compliance with the Code, and he further clarified there are already
parameters in place for permitting events. Commissioner Saine noted she did not see anything specific
in the statute changes addressing building code ordinances or zoning violations, indicated those are
being added to the Weld County Code, and expressed her concerns with the weaponization by the
Department of Planning Services. After discussion among the Board, Chair Ross opened this matter for
public testimony; however, none was offered concerning this matter. Commissioner James moved to
approve Code Ordinance #2024-13 on First Reading. The motion was seconded by Commissioner Buck,
and upon a roll call vote of four (4) to one (1), it carried with Commissioner Saine opposed.
• 12) FIRST READING OF CODE ORDINANCE #2024-15, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE OF THE WELD
COUNTY CODE (APPENDIX 5-H - FEES FOR LIQUOR LICENSES): Mr. Conroy gave a brief overview
of the proposed changes to Chapter 5 regarding the fees associated to liquor licenses. In response to
Commissioner Saine, Mr. Conroy confirmed the ordinance establishes fees for new permits and licenses
available, pursuant to the change in state statute. No public testimony was offered concerning this matter.

Commissioner Buck moved to approve Code Ordinance #2024-15 on First Reading. The motion was
seconded by Commissioner Freeman, and it carried unanimously.
El 13) FIRST READING OF CODE ORDINANCE #2024-14, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE OF THE WELD
COUNTY CODE (FEE SCHEDULE): Jennifer Oftelie, Weld County Budget Manager, alongside
Cheryl Pattelli, Chief Financial Officer, gave an overview of the proposed changes to Chapter 5 regarding
the fee schedule. She indicated the changes include changes in statutory allowances from the state,
administrative cleanup, and the inclusion of State Treasurer and Public Trustee fees.
Commissioner Saine stated she does not support increased costs related to the Colorado Open Records
Act (CORA) since it is less transparent. No public testimony was offered concerning this matter.
Commissioner James moved to approve Code Ordinance #2024-14 on First Reading. The motion was
seconded by Commissioner Buck, and upon a roll call vote of four (4) to one (1), it carried with
Commissioner Saine opposed.
14) FIRST READING OF ORDINANCE #261, IN THE MATTER OF SUMMARIZING
EXPENDITURES AND REVENUES FOR EACH FUND AND ADOPTING A BUDGET FOR THE
COUNTY OF WELD, COLORADO, FOR THE CALENDAR YEAR BEGINNING ON THE FIRST DAY OF
JANUARY, 2025, AND ENDING THE LAST DAY OF DECEMBER, 2025: Ms. Pattelli gave an overview
of the proposed 2025 Weld County final budget. She indicated a work session was held in
September 2024, had a recommended budget of $570.9 million, which is a 16.2% increase from the 2024
budget, but informed the Board, since September, there have been additional changes to the 2025
proposed budget. Ms. Pattelli detailed the significant changes to the budget that have taken place since
the work session held in October, resulting in a $7.6 million decrease to the overall expenses for the
proposed budget in 2025, which results in an adjustment of a 14.7% increase from 2024. No public
testimony was offered concerning this matter. Commissioner Freeman moved to approve
Ordinance #261 on First Reading. The motion was seconded by Commissioner Buck.
Commissioner Saine commended staff for their efforts but indicated she will be a no vote based on a
disagreement with certain topics during the process. Commissioners James and Freeman also
commended staff for navigating a new process and for the increased transparency on an accelerated
timeline, the discussions on cost savings, and for keeping the needs of the taxpayers at the forefront of
the requests. There being no further discussion and upon a roll call vote of four (4) to one (1), the motion
carried with Commissioner Saine opposed.
El PUBLIC COMMENT: No public comment was offered.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Ordinance #261, and Code Ordinances ##2024-13, #2024-14, and #2024-15 were
approved on First Readings.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 10:01 a.m.
