Case# COZ24-0001 I am very much opposed to the Proposed Project: Change of Zone from the R-1 Residential to Zone A Agricultural. Why are these people buying R-1 if they want AG? If they want AG they should buy AG. Don't buy R-1 then want to change it to AG. I bought R-1 because I want R-1. Over the 33 years 1 have lived here it has developed into a strong 9 Residential Area. With the addition of schools, parks and many more single family residence. 9 It's a strong NO for me. Parcels for Rezoning to AG: COZ24-001 • 1910 Cherry Avenue (Parcel # 096110309001) • TBD (Parcel # 096110309002) • Parcel # prior to re -subdivision 096110300022 Owner: Moore Real Property LLC — Derick B Moore and Babaft AC Moore We purchased adjacent Parcels# 096110300022 and 096110300023 in June 2021. • Both properties were advertised agricultural land totaling 4.2 acres. • Both properties are taxed agricultural land. • On closing day, we brought in a semi trailer filled with construction materials and personal belongings and several vehicles since we are under the assumption that the properties are zoned agriculture. • A month later, we were notified by the Planning Department that both properties were under violation even though the trailer was parked on Parcel # 096110300022. • We immediately contacted the Planning Department to apply for a permit for the trailer as this is allowed under Ag zone. • But the Planning Department informed us that the properties are zoned R-1 and so our permit application was denied. We had to move our semi trailer to First Avenue Storage and have been paying $160 per month since September 2021. • We asked the Planning Department if we could rezone to Ag since we are paying taxes as Ag anyways and there is too much land for one residential house. The Planning Department denied our request since the properties are too close to a school (Bella Romero). • The Planning Department then suggested that we do a Pre -Planning meeting to discuss the properties further. • At the Pre -Planning meeting the Planning Department offered that we could re -subdivide the land if 4.2 acres total is too much for one residential building without the agricultural zoning benefits. • At the Planning Department's suggestion, we moved forward with re -subdivision. We paid the $1000 application fee plus almost $3000 survey fees for the re -subdivision. • As part of the re -subdivision approval, the Planning Department and Public Works Department also required us to replant hay on the properties, because according to them, we are technically under violation for tilling the soil because we are in an MS4 area, even though there is no complaint filed against our property for doing so, but we complied with their request. • The 2 parcels are now 3 parcels because of the approved re -subdivision. On April 2022, the residential building construction on northernmost parcel was started. • On July 2022, the Building Department issued a "stop work" on the building permit due to deficiencies. • The project has been under litigation since then. • In 2023, the residential building collapsed. • We received several complaints about the disheveled building and a violation letter from the County but there isn't much that we can do about it since the project is under litigation.
