HomeMy WebLinkAbout20241409.tiffMEMORANDUM TO: Board of County Commissioners FROM: Rob Godin, Building Official DATE: June 24, 2024 RE: ORD2024-06, Chapter 29, Adoption of the 2023 National Electrical Code & the 2018 International Swimming Pool & Spa Code (Second Reading) The purpose of Ordinance 2024-06 is to update County Code Chapter 29 Article II -Code Standards. Specific updates include: 1. Section 29 -2 -70. -National Electrical Code. Update from the 2020 National Electrical Code (NEC) to the 2023 NEC. 2. Section 29 -2 -95. -Uniform Swimming Pool, Spa and Hot Tub Code. Repeal the Uniform Code and replace with the 2018 International Swimming Pool and Spa Code (ISPSC). 1. The State Electrical Board is granted the authority pursuant to CRS 12-20-204, 12-115- 107(2)(a), and 24-4-103(12.5) to incorporate by reference adoption of the National Electrical Code. The State Electrical Board adopted the 2023 NEC effective August 1St, 2023. Furthermore, the State Electrical Board pursuant to CRS 12-115-107.2.II.B.j mandates that all jurisdictions adopt the same version of the NEC as the State no later than 12 months from the State adoption. 2. The swimming pool construction industry has moved on from the currently adopted Uniform Swimming Pool, Spa and Hot Tub Code in favor of the 2018 or 2021 International Code due to its applicability to manufactured swimming pool products available on the market today and current construction methods. Summary: • Updating to the 2023 NEC keeps Weld County in compliance with the State. • Updating to the 2018 Swimming Pool and Spa Code brings the County current and consistent with neighboring jurisdictions and the swimming pool construction industry. A work session with the Board was held on June 17th, 2024. The County Attorney's Office has reviewed this ordinance. These standards are incorporated by reference as the minimum standards governing the planning, laying out, and installing or the making of additions, alterations, and repairs in the installation of wiring apparatus and equipment for electric light, heat, and power in this state. This Rule does not include later amendments to or editions of the National Electrical Code, 2023 Edition. The effective date shall be August 1, 2023. Furthermore, the State Electrical Board pursuant to CRS 12-115-107.2. I I . B. j mandates that all jurisdictions adopt the same version of the NEC as the State no later than 12 months from the State adoption. A few items to note: • There is no presentation for this ordinance • The effective date of 7/26/24 as proposed by Cheryl is good • By the insertion of the section titled "Colorado Model Electric Ready and Solar Ready Code", there is a need to change the numbering convention to Article II as noted on the attached code changes document. The publication of the National Fire Protection Association, known as the National Electrical Code, 2020 2023 Edition, NFPA No. 70 2020 2023, is incorporated by this reference as a part of this Building Code for the purpose of establishing standards for the inspection of electrical installations and issuance of electrical permits in the County, with the following amendments: A. Add to NEC Article 110: "Wiring methods consisting of materials not designed for damp or wet locations shall not be installed in a building or structure until the roof is in place and the building or structure is dried in. In addition, all other electrical components designed for dry locations, such as light fixtures, service equipment, distribution panels, motors, transformers, and related control equipment, shall not be installed until the roof is in place and the building or structure is dried in." B Add Section 210.52(J) to read as follows: 210.52(J) Sump Pit Receptacle Outlets. A 125 -volt, single-phase, 15- or 20 -ampere receptacle outlet shall be installed adjacent to and within 18"36" of the sump pit. This receptacle outlet shall be on a dedicated branch circuit and shall be GFCI protected. C. Add Section 300.5(L): "All electrical underground wiring located outside a building or structure shall be separated by a minimum of twelve (12) inches from all other underground utilities, including telephone and cable television. Such separation may be horizontal or vertical." D. Add the following sentence to Section 511.3(B): "The areas described in Sections 511.3(A) and (B) shall also apply to private garages as defined by the IBC and IRC. Sec. 29-2-90. International Energy Conservation Code. The publication of the International Code Council, Inc., known as the International Energy Conservation Code, (IECCM 2018 2021 Edition, is incorporated by this reference as a part of this Building Code, with the following amendments: A. Section C101.1 is amended to read as follows: C101.1 These regulations shall be known as the International Energy Conservation Code of the County of Weld, hereinafter referred to as "this code". B. Section R101.1 is amended to read as follows: R101.1 These regulations shall be known as the International Energy Conservation Code of the County of Weld, hereinafter referred to as "this code". Sections C109 and R109 are deleted in their entirety. Sec. 29-2-95 . References within this code to "U -RC" shat be con-si-d-ered amended to read "IPC." B. Amend Section 309.4 to -read: "All poo4, spa and hot tub suction outlets shah be listed to Standard ANSI/APSP 7 for suction entrapment avoidance."
