BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, DECEMBER 16, 2024
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, December 16, 2024, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Kevin D. Ross, Chair
Commissioner Perry L. Buck, Pro-Tem

Commissioner Lori Saine

El MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of December 2, 2024, as printed, Commissioner Buck moved to approve. Commissioner James
seconded the motion, and upon a roll call vote of four (4) to one (1), the motion carried with
Commissioner Saine abstained.
• READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2024-18
by audio. The motion was seconded by Commissioner Buck and it carried unanimously.
El CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of
Hearings conducted on December 2, 2024, as follows: 1) Annual Meeting and 2025 Budget Hearing —
Weld County Beebe Draw Law Enforcement Authority, 2) Annual Meeting and 2025 Budget Hearing —
Weld County Pioneer Community Law Enforcement Authority, 3) Annual Meeting and 2025 Budget
Hearing — Southwestern Weld County Law Enforcement Authority, and 4) 2025 Final Budget for Weld
County, Colorado. Commissioner Buck seconded the motion, which carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the Agenda.
• CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Freeman seconded the motion and it carried unanimously.

PRESENTATIONS:
1) RECOGNITION OF SERVICES, CLERK TO THE BOARD - CHERYL HOFFMAN: Chair Ross read
the certificate for the record. Esther Gesick, Clerk the Board, shared heart -felt stories working alongside
Cheryl Hoffman for the past ten (10) years, described her as a 'Godsend', and honored her by extending
gratitude to her family for sharing her with Weld County. Ms. Hoffman thanked her family and the Board
for the recognition, expressed her deep appreciation for Weld County and the ladies whom she has
worked alongside during her tenure. She indicated it was her pleasure being of service to the public, but
looks forward to her new chapter in life, and shared some of her plans for retirement. The Board, in turn,
acknowledged her tenacity, wished her luck in her future endeavors during her retirement, and expressed
their gratitude for Ms. Hoffman's passion and dedication for the citizens of Weld County. (Clerk's Note:
The group gathered for a photo opportunity.)
El 2) RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN RESOURCES —
MICHELLE RAIMER: Chair Ross read the certificate for the record. Jill Scott, Director of the Department
of Human Resources, thanked Michelle Raimer for helping her during the transition into her role as the
Director when she came to Weld County in 2022, and for aiding employees in Weld County in one
capacity or another, and wished her the best of luck with her next chapter. Ms. Raimer thanked her family
and the Board for the recognition, and expressed her appreciation for the opportunity to work at Weld
County for the past three (3) decades with her colleagues, many whom have become life-long friends.
She indicated it was her pleasure being of service to the employees of Weld County but looks forward to
her new chapter in life and shared some of her plans for retirement. The Board, in turn, acknowledged
her tenacity, wished her luck in her future endeavors during her retirement, and expressed their gratitude
for Ms. Raimer's passion in working with people and her dedication to the employees and citizens of
Weld County. (Clerk's Note: The group gathered for a photo opportunity.)
El 3) 2024 EMPLOYEE SERVICE AWARDS - 10, 20, AND 30 -YEAR EMPLOYEES: Chair Ross
introduced the presentation for the record and the various Elected Officials and Department Heads spent
approximately the next 90 minutes honoring numerous employees and presenting them with pins for 10,
20, and 30 years of service. The Commissioners, in turn, thanked the employees for their years of
dedication to the citizens of Weld County.
(Clerk's Note: Chair Ross requested a five (5) minute recess, and reconvened the meeting at 10:46 a.m.)
WARRANTS:
1) GENERAL WARRANTS - DECEMBER 11, AND 13, 2024: Commissioner Buck moved to approve the
General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously.
El 2) COMMISSIONER WARRANTS (KEVIN D. ROSS) - DECEMBER 13, 2024:
Commissioner James moved to approve the Warrant as printed. Commissioner Buck seconded the
motion, and upon a roll call vote of four (4) to zero (0) , the motion carried with Commissioner Ross
recused.
El NEW BUSINESS:
1) CONSIDER CONTRACT ID #8932 CONTRACT FOR THE 2025 VICTIM ASSISTANCE AND LAW
ENFORCEMENT (VALE) GRANT FOR LAW ENFORCEMENT VICTIM SERVICES, AND AUTHORIZE
CHAIR TO SIGN: Sonja Kohlgraf, Sheriff's Office, stated the County has been awarded grant funds, in
the amount of $42,485.00, which will fund a portion of one (1) full-time equivalent (FTE) in the Victims
Assistance Unit from January 1, 2025, through December 31, 2025. Commissioner Freeman moved to
approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Buck
and it carried unanimously.

• 2) CONSIDER CONTRACT ID #8935 THREE (3) MASTER SERVICE AGREEMENTS FOR
VARIOUS PUBLIC SAFETY SYSTEMS AND AUTHORIZE CHAIR TO SIGN - MOTOROLA
SOLUTIONS, INC.: Cordero Bustos, Department of Public Safety Communications, stated these
agreements provide the Weld County Regional Communications Center (WCRCC) with reliable software
and technical support for the dispatch of emergency services. Commissioner James moved to approve
said agreements and authorize the Chair to sign. The motion was seconded by Commissioner Freeman
and it carried unanimously.
• 3) CONSIDER CONTRACT ID #8936 MEMORANDUM OF UNDERSTANDING FOR FRONT
RANGE COMMUNICATIONS CONSORTIUM (FRCC) RADIO INTEROPERABILITY CHANNEL
SHARING FOR WELD COUNTY REGIONAL COMMUNICATIONS CENTER (WCRCC) AND
AUTHORIZE CHAIR AND DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS TO SIGN —
CITY OF BRIGHTON POLICE DEPARTMENT: Mr. Bustos stated the non -financial memorandum of
understanding (MOU) allows for channel sharing for dispatch services between the WCRCC and the City
of Brighton Police Department for the next five (5) years. Commissioner Freeman moved to approve said
MOU and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried
unanimously.
El 4) CONSIDER CONTRACT ID #8937 MEMORANDUM OF UNDERSTANDING FOR FRONT
RANGE COMMUNICATIONS CONSORTIUM (FRCC) RADIO INTEROPERABILITY CHANNEL
SHARING FOR WELD COUNTY REGIONAL COMMUNICATIONS CENTER (WCRCC) AND
AUTHORIZE CHAIR AND DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS TO SIGN -
GREATER BRIGHTON FIRE PROTECTION DISTRICT: Mr. Bustos stated the non -financial MOU allows
for channel sharing for dispatch services between the WCRCC and the Greater Brighton Fire Protection
District for the next five (5) years. Commissioner Buck moved to approve said MOU and authorize the
Chair to sign. The motion was seconded by Commissioner James and it carried unanimously.
El 5) CONSIDER CONTRACT ID #8938 MEMORANDUM OF UNDERSTANDING FOR FRONT
RANGE COMMUNICATIONS CONSORTIUM (FRCC) RADIO INTEROPERABILITY CHANNEL
SHARING FOR WELD COUNTY REGIONAL COMMUNICATIONS CENTER (WCRCC) AND
AUTHORIZE CHAIR AND DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS TO SIGN -
NORTHERN COLORADO DRUG TASK FORCE: Mr. Bustos stated the non -financial MOU allows for
channel sharing for dispatch services between the WCRCC and the Northern Colorado Drug Task Force
for the next five (5) years. Commissioner Freeman moved to approve said MOU and authorize the Chair
to sign. The motion was seconded by Commissioner Buck and it carried unanimously.
• 6) CONSIDER DIRECTING CLERK TO THE BOARD TO HAVE PUBLISHED EMERGENCY
ORDINANCE NO. 260-C SUPPLEMENTAL APPROPRIATION FOR 2024: Jennifer Oftelie, Weld County
Budget Manager, indicated Ordinance No. 260 was done as an emergency for the supplemental
appropriation of funds, and part of that process requires the public to be notified; therefore, she requested
for the Clerk to the Board's Office to publish the public notice in the Greeley Tribune, to be brought before
the Board on December 30, 2024. Commissioner Buck moved to approve said resolution. The motion
was seconded by Commissioner James and it carried unanimously.

PA PLANNING:
1) FIRST READING OF CODE ORDINANCE #2024-18, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING OF THE WELD COUNTY CODE (STATE
LICENSED NATURAL MEDICINE FACILITIES): Maxwell Nader, Department of Planning Services,
explained Proposition 122 was approved by Colorado voters, in 2022, for the decriminalization and
regulation of certain psychedelic plants and fungi for individuals 21 years or older, and as a result the
Colorado Department of Revenue, Division of Natural Medicine, will begin licensure of the facilities in
early 2025. Mr. Nader clarified these facilities are not to include synthetically manufactured drugs or the
establishment of retail stores. He informed the Board the facilities must meet local building and zoning
codes, but noted local governments cannot prohibit a facilitator from providing such natural medicine
services within their boundaries. Furthermore, Mr. Nader indicated that local governments cannot adopt
ordinances or regulations that are considered unreasonable or in direct conflict of the state legislation.
He stated the natural medicine facilities include four types of establishments: Healing Centers,
Cultivation/Growing, Manufacturing/Processing/Extraction, and Testing, which must be at least 1,000 feet
from schools and childcare facilities (including in -home state licensed providers). Mr. Nader stated the
purpose for the revision to Chapter 23 is to include the definitions of a natural medicine facility pursuant
to the Colorado Natural Medicine code, to allow such facilities in an Industrial Zone District, to mirror the
state's prohibition of their existence less than 1,000 feet from schools and childcare facilities, and to
comply with state law. No public testimony was offered concerning this matter. Commissioner James
expressed his concerns and indicated it is abhorrent for the state to exert their authority by forcing local
governments to augment their planning codes to include these facilities; however, recognizing the
regulatory necessity he moved to approve Code Ordinance #2024-18 on First Reading. The motion was
seconded by Chair Ross for purposes of discussion, who further indicated his agreement with
Commissioner James concerning the appalling mandate for such facilities knowing it goes against the
values of Weld County government and many of its citizens. Commissioner Freeman echoed the
sentiments shared by Commissioner James and Chair Ross. In response to Commissioner Saine,
Mr. Nader stated there are no marijuana facilities located in unincorporated Weld County, but the
verbiage of the new legislation is such that they cannot be prohibited, but this Code will limit where they
can exist. There being no further discussion, the motion carried three (3) to two (2), with
Commissioners Buck and Saine opposed.
PUBLIC COMMENT:
1) Edwin Grant, City of Greeley resident, offered his comments to the Board.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2024-18 was approved on First Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 11:02 a.m.
