At almost 10,000 acres, this WILL be the largest solar farm in the United States. Area residents have brought up concerns for the 5,700 acre portion in Morgan County as well as the 4,300 acre portion on the Weld County side. Despite the countless legitimate concerns, it seems that the requirements for the special use permits are being met. On October 15th the Weld County Planning Commission voted to move it onto the Weld County Commissioners for approval. As a Colorado native and area resident, I would ask that all of you please take into consideration the sheer scale of this project and the long term impact it will have on the surrounding homes and environment. Beyond the eye sore of thousands of acres of black solar panels surrounded by 6' tall fencing, we have concerns about climate changes (heat island effect), turbulence for small =crafts, lack of reclamation and ability to maintain vegetation, flooding, change of water flow, contamination of water sources, increased traffic, ability for the local fire departments to respond efficiently, etc. We ask all of you to look beyond the dollars that are being dangled and please consider the scale of this project. We ask all of you to do your due diligence in research and take consideration of current setback requirements of only 500' from any residence. Why are there not 2,500 foot setback requirements OR size restrictions on these solar farms? They house lithium batteries, lead and other harmful chemicals. Gas plants, oilfield sites and even feedlots are just a few examples of other industrial sites that have further requirements for a reason- they can be hazardous. Why is there not a fire response plan required to be in place prior to construction? As of now, they don't even have an access to the North side of the railroad tracks which is where they have proposed the main substation to be. Why is there no requirement for a buffer zone between these solar farms and surrounding homes? At least a treellne with multiple rows of larger trees. This would assist in protecting property values as well as create a new habitat for the displaced wildlife. It has become so difficult for farmers and ranchers to make a living that leasing out their land for a solar farm looks like a better option. Why are we not putting more effort and support towards the industries that actually contribute to feeding this country? What is going to happen when all of the Ag land is covered with solar panels or wind turbines? And what happens to all the damaged equipment? Landfills? Neither are "green" or efficient, so who is really benefiting? We are looking to you, as County Commissioners, to protect the best interest of the land as well as consider the people and animals who call it home. BACKGROUND A. Operator is the owner and/or developer of the Taelor Solar and Energy Storage Project ("Project") within unincorporated parts of Morgan County ("County"), and, as of the time of the execution of this MOU, is developing the Projects to the point of construction and operations within unincorporated portions of the County. B. Wiggins Fire are the closest emergency services to the Project and are therefore most likely to be first on the scene in the event of any emergency. Operator is committed to ensuring Wiggins Fire has the resources required to be able to respond appropriately. C. The purpose of this MOU is to describe the support Operator is prepared to provide to Wiggins Fire during the construction and operation of its facilities to protect human health, safety and welfare and to protect the environment and wildlife resources. The Project will include solar panels, racking structures, inverters, transformers, overhead or underground wiring, a battery energy storage system (BESS) and high -voltage substation facilities, as well as internal roads, fences and ancillary facilities. D. The commitments below represent the current understanding and agreement between the Parties. The Parties intend to negotiate and execute a binding Community Benefits Agreement subsequent to the issuance of final land use approval from the Board of County Commissioners. The Operator Agrees to: 1. Pre -Construction Coordination Operator will work with Wiggins Fire during the design phase of the Project to ensure appropriate measures are taken to enable emergency response, including gate access, vehicle turn-arounds and related considerations. Operator will also coordinate with Wiggins Fire throughout the construction phase of the project, providing relevant information about plans and activities to better enable response to any incidents that could occur during construction of the Project. 2. Emergency Response Plan Development Operator will work with Wiggins Fire and Fire & Risk Alliance (or another highly qualified industry expert) to develop a written emergency response plan to establish protocols and procedures for responding to an event at the Project site 1 based on the final design of the Project, Wiggins Fire apparatus and organization, and industry best practices 3. Training After BESS equipment has been procured, Operator will coordinate and fund in - person solar and battery fire and incident response training for Wiggins Fire, adjacent fire districts, and other Morgan County first responders including the Sheriff's office Training will be conducted by Fire & Risk Alliance or another highly qualified industry organization with knowledge of current best practices and industry codes & standards Training topics could include de-energization tactics, heat/flame reduction tactics, standoff rules, rattlesnake safety, and implementation of the Emergency Response Plan In addition to in -person training, recorded training videos and written materials will be provided for those unable to attend and to serve as refresher materials Operator will provide updated training and materials if there are substantial changes in industry best practices for BESS fire response Operator will work with Wiggins Fire to coordinate annual site walks of key Project facilities to ensure Wiggins Fire personnel are able to remain familiar with the Project facilities Operator funding of training will be above and beyond its contributions to Wiggins Fire via property tax payments 4. Equipment. It is Operator's and Wiggins Fire's current understanding that industry experts do not recommend special equipment or apparatus for responding to a fire originating from Project Facilities However, if during the design of the Project or the training of Wiggins Fire personnel it is determined (and agreed by a qualified independent expert, such as Fire & Risk Alliance) that special dedicated equipment is necessary to safely respond to a fire at the Project, and the cost of such equipment is m excess of the property tax allotment from the Operator to Wiggins Fire paid over the first ten (10) years of operation, Operator will provide additional funding up to a total of $100,000 to procure such equipment and materials on or after the completion of construction of the facility 5. After -Action Reporting After any fire originating from the Project that Wiggins Fire is required to respond to, Operator will commission and fund an After -Action Review to be conducted by a qualified third -party (e g , Fire & Risk Alliance) to review the incident, 2 impacts & damage, and actions taken by all parties The review will also include recommendations for minimizing the impact of any future events The results of this review will be provided to Wiggins Fire and be made available for review by interested community members 6. Goodwill Contributions to Wiggins Fire.
