Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine — RECUSED Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Kim Ogle The following business was transacted: El I hereby certify that pursuant to a notice dated August 15, 2023, and duly published August 18, 2023, in the Greeley Tribune, a public hearing was conducted on October 4, 2023, to consider the request of Thomas and Marjorie Brown, do CBEP Solar 27, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR23-0023, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. At said hearing the Board continued the matter to December 6, 2023, to allow the applicants adequate time to get a Good Neighbor Agreement and a Crossing Agreement in place. At said hearing the Board continued the matter to January 17, 2024, to allow the applicant additional time to get said agreements in place. At said hearing the Board continued the matter to January 31, 2024, to allow the applicants additional time to get the Crossing Agreement finalized and signed. Karin McDougal, Deputy County Attorney, made this a matter of record. Ei Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and relayed the applicant has obtained a Final Crossing Agreement and a Good Neighborhood Agreement, and although said agreements have not yet been recorded, they do address Conditions of Approval #1.B, #1.E, and #1.G. w _= Brysen Daughton, Cloudbreak Energy, described the terms and provisions of the Good Neighborhood Agreement and the Final Crossing Agreement, and thanked the Board for the additional time to negotiate them. No public testimony was offered concerning this matter. Cc' pL..(ER/MN/Ko/DA/mt /IKR' 03 /o 1/214 2023-2880 PL2889 HEARING CERTIFICATION - THOMAS AND MARJORIE BROWN, C/O CBEP SOLAR 27, LLC (USR23-0023) PAGE 2 The Board reviewed the Conditions of Approval (COA) and Development Standards (DS) and agreed to strike Conditions of Approval (COA) #1.B, #1.E, #1.G, and #1.H.11. No public input to the changes in the Conditions of Approval. In response to Chair Ross, Mr. Daughton indicated they have reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner James moved to approve the request of Thomas and Marjorie Brown, c/o CBEP Solar 27, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR23-0023, for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. This Certification was approved on the 14th day of February, 2024.
