HomeMy WebLinkAbout20242877.tiffHEARING CERTIFICATION DOCKET NO. 2024-52 RE: BOARD OF EQUALIZATION FOR 2024 I hereby certify that pursuant to a notice dated June 24, 2024, and duly published June 26, 2024, in the Greeley Tribune, a public hearing was conducted on October 30, 2024, with a quorum of the following Commissioners being present: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Clerk to the Board, Esther E. Gesick Assistant County Attorney, Karin McDougal County Assessor, Brenda Dones Assessor's Chief Deputy, Jason Marini Independent Referee, Bill Garcia El Weld County Assessor, Brenda Dones, summarized the property tax appeal process, detailed the current market appraisal dynamics, stating it is an intervening year, and presented the findings of the Hearing Officer, Bill Garcia, regarding the 44 appeals received for 155 properties. Ms. Dones elaborated the Hearing Officer is recommending two (2) appeals result in adjusted values, 138 appeals are denied, 13 appeals are stipulated, and shared two (2) appeals were withdrawn. She explained of the 138 appeals recommended for denial, property tax agents for 128 appeals requested administrative denial. Ms. Dones stated Mr. Garcia presided over 12 hearings this year, thanked him for his service, and explained he was selected as the sole Hearing Officer because of the smaller number of appeals received in 2024 and his vast knowledge of property valuation. Mr. Garcia stated the role of an independent referee / hearing officer is important for the public because the appeal process is their opportunity to present their concerns and requests to an independent party and learn about the evaluation process. He shared hearings have 15 -minute time blocks and further described the hearing review process. Mr. Garcia discussed the Assessor's innovation by making hearings accessible via Microsoft Teams for virtual hearings to provide flexibility and accommodate work schedules and travel restrictions of property owners and tax agents. He discussed 2025 is anticipated to have more appeals than 2024 and recommended exploring the opportunity for virtual hearings further. Chair Ross thanked Mr. Garcia for serving in this capacity. El Commissioner James, likewise, thanked Mr. Garcia for his service, stating it was vitally important and his experience and knowledge is valuable, thus, he invited Mr. Garcia to pursue service again in 2025. Mr. Garcia shared he is passionate about property valuation. Eti Edwin Grant, Greeley resident, stated he lived in his house for 35 years and purchased it for $120,000.00, and the purchase price is what he should be taxed at, not the appraisal value. There was no further public comment. Commissioner James moved to accept the decisions of the designated Hearing Officer to adjust or deny various accounts, and moved to Administratively Deny various accounts and approve the Stipulation Agreements, as submitted by Assessor Dones on Exhibit "A" to the Final Determination Resolution. Seconded by Commissioner Buck, the motion carried unanimously. There being no further discussion, the hearing was adjourned at 9:34 am This Certification for Docket #2023-52 was approved on the 13th day of November, 2024.
