HomeMy WebLinkAbout20240205.tiffHEARING CERTIFICATION DOCKET NO. 2024-10 RE: PUBLIC HEARING TO CONSIDER APPROVAL OF 2023 HIGHWAY USER TAX FUND (HUTF) ANNUAL MILEAGE AND CONDITION CERTIFICATION REPORT, AND ADOPTION OF HUTF MAP TO BE SUBMITTED TO COLORADO DEPARTMENT OF TRANSPORTATION (CDOT) SHOWING WELD COUNTY PRIMARY AND SECONDARY ROAD SYSTEMS AND SHOWING TOTAL MILEAGE OF PUBLIC ROADS IN WELD COUNTY WHICH ARE ELIGIBLE FOR PARTICIPATION IN THE HUTF, PURSUANT TO REQUIREMENTS OF C.R.S. §43-2-110(1) A public hearing was conducted on January 24, 2024, at 9:00 a.m., with the following present: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Department of Public Works representative, Evan Pinkham The following business was transacted: I hereby certify that pursuant to a notice dated January 10, 2024, and duly published January 12, and January 13, 2024, in the Greeley Tribune, a public hearing was conducted to consider approval of the 2023 Highway User Tax Fund (HUTF) Annual Mileage and Condition Certification Report, and adoption of the HUTF Map to be submitted to the Colorado Department of Transportation (CDOT) showing the Weld County Primary and Secondary Road Systems and showing the total mileage of public roads in Weld County which are eligible for participation in the HUTF, pursuant to the requirements of C.R.S. §43-2-110(1). Bruce Barker, County Attorney, made this a matter of record. Evan Pinkham, Department of Public Works, presented the 2023 HUTF Certification Report, as well as a map depicting the Primary and Secondary roads maintained by Weld County as of the end of 2023. He reviewed the changes to the road system, including miles of paved and gravel roads maintained by the County, and explained the adjustments typically result from improvement projects, municipal annexations, and housekeeping to correct any errors, which he reviewed in detail for the record. Mr. Pinkham stated the map will be submitted to CDOT reflecting the Primary and Secondary routes to satisfy statutory requirements to document the current status of public roads, and all this information will also be accessible in the GIS portal. In response to Steve Teets, Greeley resident, Mr. Pinkham clarified this is the submittal method that allows for Weld County to report the milage in the County, and the funding allocated correlates and varies based on the type of roadway (paved vs. gravel), and the condition in which those roadway surfaces are in. cc:PL(ER/MN/EP), GIS (s6), p .i(ca /Do /ow Gr$) 02/2.0/2'1 2024-0205 EG0082 HEARING CERTIFICATION - APPROVE 2023 HIGHWAY USER TAX FUND (HUTF) ANNUAL MILEAGE AND CONDITION CERTIFICATION REPORT, AND ADOPT HUTF MAP PAGE 2 Fi Commissioner James moved to approve the 2023 Highway User Tax Fund (HUTF) Annual Mileage and Condition Certification Report, and adoption of the Map to be submitted to the Colorado Department of Transportation (CDOT) showing the Weld County Primary and Secondary Road Systems and showing the total mileage of public roads in Weld County which are eligible for participation in the HUTF, pursuant to the requirements of C.R.S. §43-2-110(1). The motion was seconded by Commissioner Buck. In response to Commissioner Freeman, Mr. Pinkham indicated this year may be slightly less in funding due to the number of annexations, and further confirmed Weld County added 4.21 miles of paved roadway; however, the County also lost 13.49 miles of gravel roadway miles. Thus, Weld County lost an overall total of 9.28 miles of roadway. He further explained, due to Larimer County changing the haul route on County Road (CR) 90 east of CR 29, after annexation; the Town of Severance would need to de -annex, or relinquish, for Weld County to regain those miles. There being no further discussion, the motion carried unanimously, and the hearing was completed at 9:39 a.m. This Certification was approved on the 7th day of February, 2024.
