RE: APPROVE AMENDMENT #1 TO SETTLEMENT AGREEMENT FOR BRIDGE 54/13A
RECONSTRUCTION PROJECT AND AUTHORIZE CHAIR PRO-TEM TO SIGN -
DUSTIN AND JAMIE CHRISTENSEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Settlement
Agreement for the Bridge 54/13A Reconstruction Project between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, and Dustin and Jamie Christensen, commencing upon full execution
of signatures, with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Amendment #1 to the Settlement Agreement for the Bridge 54/13A
Reconstruction Project between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Works, and
Dustin and Jamie Christensen, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro-Tem be, and hereby is,
authorized to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 25th day of March, A.D., 2024.

PASS -AROUND TITLE: Christensen Temporary Construction Easement for Protective Bollards
DEPARTMENT: Public Works DATE: 03/18/24

Brief description of the problem/issue:
When the County originally purchased ROW from the Christensen's for this project, the County agreed to
install protective bollards around an Xcel valve station. The bollards were to have been installed at the edge of
Xcel's existing easement on the Christensen property. When Xcel went to install the bollards in their
easement, it was discovered that the gas lines had been installed 6 inches away from the edge of their
easement. As a result, Xcel refused to install the bollards because they could not meet their internal safety
standards. Xcel refused to relocate the gas line to obtain the distance needed to meet their standards.
Because the bollards could not be installed within Xcel's existing easement, the Christensen's threatened to
sue the County for breach of contract.
The County worked with the Christensen's to obtain a temporary construction easement (TCE) so the bollards
could be installed on the Christensen property to meet Xcel's safety requirements. The TCE is needed so the
County's contractor can enter onto the Christensen property and place the bollards in an area that is 3 ft wide
by 17 feet long. This area is the minimum area needed to meet the Xcel safety standards. In the future, the
Christensen's will have the responsibility of maintaining the bollards. The County also agreed to move the new
access 11 feet east away from the Xcel easement.
What options exist for the Board?
Option 1: The County negotiated a cost of $500 for the TCE. The BOCC can sign the Amendment to the
Settlement Agreement which will result in the Christensen's providing a Temporary Construction Easement to
the County for the installation of the required bollards.
Option 2: Do not sign the agreement or ask fora work session to obtain more information regarding the issue.
Consequences:
Option 1: If the BOCC signs the Amendment to the Settlement Agreement, the Christiansen's will provide a
TCE so the County's contractor can install the bollards. Installing the bollards also satisfies one of the
conditions shown in the Settlement Agreement for the sale of the ROW needed for the project.
Option 2. If the BOCC does not sign the Amendment to the Settlement Agreement, the Christensen's will not
provide the TCE. By not providing the TCE, the County will be unable to install the bollards that were agreed
upon as a condition of the original Settlement Agreement.
Impacts: If the agreement is not signed, the County's contractor will not be able to install the bollards to
protect the Xcel valve station. The contractor's schedule will also likely be impacted because of issues related
to the construction of the new Christensen access in relation to the valve station.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
Option 1: The Cost is $500 to the County for the TCE. All other costs associated with the installation of the
bollards will be covered by the BR54/13A project construction budget. The other costs are anticipated to be
less than $1,000.00 in material and labor.
Option 2: The County may be in breach of contract if the bollards are not installed. It is unknown what the
lawsuit costs would be, but it would likely exceed the $500 for the TCE.

SUBJECT: Amendment #1 to Settlement Agreement from
Dustin & Jamie Christensen fora Temporary Construction
Easement on the BR54/13A Bridge Replacement Project
Please place the attached Amendment to the Settlement Agreement on the BOCC agenda. The agreement
is for the purchase of a temporary construction easement (TCE) located on the Christensen property. The
TCE is required so the County can install protective bollards around an Xcel gas valve. The On -Base
contract ID for this amendment is 7956 and the Tyler Reference Number for the original agreement is
2023-1641.
The amendment to the settlement agreement was reviewed by the BOCC in a pass around that was
returned on March 20, 2924. All five commissioners approved the recommendation to place this
amendment on the BOCC agenda for consideration.
The cost of the TCE is $500. Public Works has included the acquisition of the TCE in their 2024 budget.
I will attend the BOCC meeting to answer any questions the BOCC may have.

SETTLEMENT AGREEMENT AMENDMENT #1 BETWEEN
THE WELD COUNTY DEPARTMENT OF PUBLIC WORKS
AND DUSTIN C. CHRISTENSEN AND JAMIE A CHRISTENSEN
This Settlement Agreement Amendment #1 ("Amendment"), is made this 25'day of
MaYC{1 , 2024, by and between Weld County, a body corporate and politic of the State of
Colorado, by and through its Board of County Commissioners, whose address is 1150 'O' Street,
Greeley, CO 80631, hereinafter referred to as the "County", and Dustin C. Christensen and
Jamie A. Christensen, whose address is 6504 County Road 54, Johnstown, CO 80534,
hereinafter referred to as the "Owner". The County and the Owner may be collectively referred
to herein as "the Parties".
WHEREAS, the Parties entered a Settlement Agreement dated June 12, 2023, and
recorded in the records of the Weld County Clerk and Recorder's office on July 6, 2023 under
Reception Number 4907618 (the "Settlement Agreement"); and
WHEREAS, pursuant to the Settlement Agreement, the County is required to install
protective bollards between the Public Service Company of Colorado ("PSCo") existing facilities
and the west edge of the future driveway on the west side of the Owner's property located at 6504
CR 54, Johnstown, Colorado 80534, at a location approved by the Owner, prior to completion of
the Project on the Property; and
WHEREAS, there is insufficient room within the existing PSCo easement for the County
to install such bollards; and
WHEREAS, the County desires to acquire from Owner a certain temporary construction
easement described in the attached Exhibit A (hereinafter referred to as the "Temporary
Construction Easement" or "TCE") in order to permit the County to install the bollards as required
by the Settlement Agreement; and
WHEREAS, pursuant to the terms and conditions hereof, Owner has agreed to convey
such TCE, so that the bollards may be installed by the County on Owner's property.
NOW, THEREFORE, in consideration of the terms and conditions contained herein and
the recitals set forth above, the Parties agree to amend the Settlement Agreement as follows:
EXHIBITS INCORPORATED. The following exhibits are attached and incorporated into
this Amendment:
Exhibit A — Description, Depiction, and Form of TCE.
Exhibit B — Revised pages from Construction Drawings for the project showing the new
driveway location and the required revisions to the Construction Drawings.
Exhibit C — Location of Bollards
II. COMPENSATION: PROPERTY CONVEYANCE
A. At Closing, the County shall pay the Owner a total compensation amount of Five
Hundred and 00/100 Dollars ($500.00) for the Temporary Construction Easement.
B. Upon presentation of an itemized invoice from the Owner's attorney, the County shall
pay no more than Two Thousand and 00/100 Dollars ($2,000.00) of the Owner's
attorney's fees. The itemized invoice shall include a copy of the attorney's W-9.

Within 30 days of receipt of the itemized invoice, the County will pay the attorney
directly.
III. OWNER'S RESPONSIBILITIES
A. The Owner shall grant the County's contractor permission to enter the Owner's
property only for the purposes of constructing the Owner's driveway access and
matching the new driveway access into the Owner's existing gravel road elevations
in accordance with Section IV below.
B. The Owner shall grant the County the TCE for the sole purpose of installing bollards
around the existing above ground valve station. The location of the bollards within
the TCE are at the location required by PSCo to meet its safety setbacks for the
bollard installations.
IV. COUNTY'S RESPONSIBILITIES
A. The County will move the driveway access approximately 11 feet to the east of the
location shown in the Bridge 54/13 Final Plans dated May 12, 2023, attached hereto
as Exhibit B, which were previously approved by the Owner.
B. The County will provide a paved driveway access from the edge of asphalt on the
new CR 54 to the southern edge of the ROW line and will properly tie the paved
driveway access into the elevation of the Owner's existing gravel road that is outside
of the County's Right -of -Way. The paved driveway access will consist of 6 inches
of Class 6 aggregate base course and 5 inches of hot mix asphalt. At the ROW line,
the driveway access will be 24 feet wide.
C. The County, will (at no cost to either Party) obtain a new access permit on behalf of
Owner for the paved driveway access onto CR 54 for commercial uses.
D. The County will install three to four bollards on Owner's property near the eastern
edge of the existing PSCo permanent easement area as shown on Exhibit C.
All capitalized terms that are not otherwise defined herein shall have the meaning set forth
in the Settlement Agreement. Except as expressly added or modified herein, all terms and
conditions of the Settlement Agreement remain unchanged. In the event of any conflict between
the terms and conditions of this Amendment and the Settlement Agreement, the terms of this
Amendment shall prevail.

GRANT OF TEMPORARY CONSTRUCTION EASEMENT
This Temporary Construction Easement (TCE), executed this day of , 2024 is made
between Dustin C. Christensen and Jamie A. Christensen, (referred to herein as "Owner", whether one or
more), whose legal address is 6504 County Road 54, Johnstown, CO 80534 and the County of Weld, a
body corporate and politic of the State of Colorado, by and through its Board of County Commissioners
(referred to herein as "County"), whose legal address is 1150 "O" Street, Greeley, Colorado 80631:
VWTNESSETH: That Owner, for and in consideration of payment made by County, the receipt and
sufficiency of which is hereby acknowledged, does hereby dedicate and convey unto County a Temporary
Construction Easement, covering that real property lying and being in the County of Weld, State of
Colorado, to wit:
The real property described and depicted on the attached Exhibit A.
Subject to the following conditions:
1. The TCE is conveyed from Owner to County immediately and shall expire and be of no further force
twelve (12) months from the date hereof.
2. The right to use the TCE shall belong to the County and its agents, employees, designees,
contractors, guests, invitees, successors and assigns, and all those acting by or on behalf of the
County for the purpose of establishing, laying, constructing, reconstructing, installing, realigning,
modifying, replacing, improving, adding, altering, substituting, operating, maintaining, accessing,
inspecting, patrolling, protecting, or repairing protective bollards.
3. County shall have the right of ingress, egress, entry and access in, to, through, on, over, under,
and across the TCE from any adjacent property to which County has legal access, for any and all
purposes necessary and/or incident to the exercise by the County of the rights granted to it
hereunder. At the expiration of the term of this TCE, County shall promptly repair any damage to
Owner's property caused by County, its agents, employees, contractors, guests, invitees, and all
those acting by or on behalf of County so as to maintain the Owner's property in substantially as
good or better condition as existed prior to use by County.
4. County agrees that any current access to the property from the road Right -of -Way shall remain
open throughout the term of the TCE.
