BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, APRIL 29, 2024
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, April 29, 2024, at the hour of 9:00 a.m.
[] ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Kevin D. Ross, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Mike Freeman
Commissioner Scott K. James
Commissioner Lori Saine

El MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of April 15, 2024, as printed, Commissioner Buck moved to approve. Commissioner James
seconded the motion and it carried unanimously.
tvoc, READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2024-05
by audio. The motion was seconded by Commissioner Buck, and it carried unanimously.
lg AMENDMENTS TO AGENDA: There were no amendments to the Agenda.
CONSENT AGENDA: There being no public testimony concerning Vacation, VAC24-0004, of
Recorded Exemption, RECX16-0090 — Faith Tabernacle Ministries, Inc., do Danny Perdew,
Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James
seconded the motion and it carried unanimously.
111 PROCLAMATIONS:
1) NATIONAL MENTAL HEALTH MONTH - MAY 2024: Chair Ross read the proclamation for the record.
Kim Collins, Chief Executive Officer of North Range Behavioral Health (NRBH), thanked the Board for
recognizing National Mental Health Month, sharing NRBH averages between 16,000-18,000 unique
clients annually, and introduced her team for the record. In turn, each Commissioner expressed gratitude
for NRBH's continued excellence and dedication to maintaining the mental and physical well-being of the
citizens of Weld County. (Clerk's Note: The group gathered for a photo opportunity.)

LEHI WARRANTS:
1) GENERAL WARRANTS - APRIL 26, 2024: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner James seconded the motion and it carried unanimously.
",12 2) COMMISSIONER WARRANTS (SCOTT K. JAMES) - APRIL 26, 2024: Commissioner Buck
moved to approve the Warrant, as printed. Commissioner Freeman seconded the motion, and upon a
roll call vote of four (4) to zero (0), the motion carried, with Commissioner James recused.
El NEW BUSINESS:
1) CONSIDER CONTRACT ID #7761 PROVIDER NETWORK AGREEMENT FOR MEDICARE PART D
COVERAGE AND AUTHORIZE CHAIR TO SIGN - POC NETWORK TECHNOLOGIES, INC.,
DBA TRANSACTRX: Jason Chessher, Director of the Department of Public Health and Environment,
stated the contract is with a Medicare billing company for the narrow scope of services provided to senior
citizens of Weld County for immunizations, which are at the cost of approximately $1.50 per immunization.
Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was
seconded by Commissioner James, and it carried unanimously.
2) CONSIDER CONTRACT ID #8042 MASTER SERVICES AGREEMENT FOR FLOCK SAFETY
PLATFORM AND AUTHORIZE CHAIR TO SIGN - FLOCK GROUP, INC.: Sonja Kohlgraf, Sheriffs
Office, stated the agreement allows for the purchase of seven (7) license plate readers and their service
maintenance. She stated the purchase, in the amount of $46,550.00, is funded by the 2023 Justice
Assistance Grant (JAG) and the agreement terms cover 24 -months after installation. Commissioner Buck
moved to approve said agreement and authorize the Chair to sign. The motion was seconded by
Commissioner James, and it carried unanimously.
!l 3) CONSIDER CONTRACT ID #8043 MEMORANDUM OF AGREEMENT FOR PURCHASE OF
CERTAIN PROPERTY FOR PUBLIC ROAD IMPROVEMENTS FOR CR 41 AND SH 52
INTERSECTION PROJECT, AND AUTHORIZE CHAIR TO SIGN — MICHAEL DREILING: Erich Green,
Department of Public Works, stated the agreement for is for acquired road right-of-way and a temporary
construction easement located in the northwest quadrant of the County Road 41 and State Highway 52
intersection improvements project. He detailed the costs associated with said acquisitions, which are
funded by the departments' 2024 budget. Commissioner Freeman moved to approve said agreement
and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried
unanimously.
4) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR MAY 29, 2024: Commissioner James moved to approve said Resolution. The motion
was seconded by Commissioner Buck. Chair Ross stated the cancellation is due to the Board's
attendance at the spring Colorado Counties, Inc. (CCI), conference. There being no further discussion,
the motion carried unanimously.

4 5) FIRST READING OF CODE ORDINANCE #2024-05, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE OF THE WELD
COUNTY CODE (NO APPROPRIATION FOR EMERGENCY SHELTERING OF ILLEGAL ALIENS):
Bruce Barker, County Attorney, reviewed the details of the proposed changes to Chapter 5 of the Weld
County Code. He provided language to refute statements made on the Center for Immigration Studies
website. In addition, he indicated the Ordinance establishes a new Section 5-1-70 of the Weld County
Code regarding no appropriations from County funds for the specified purpose of emergency sheltering
of illegal aliens within Weld County, and defines the prohibition of purchasing or leasing properties for

said specified purpose. Mr. Barker noted the only exception is in the event of an Emergency Ordinance
due to a natural disaster. Commissioner Saine mentioned a Resolution she proposed earlier this year to
declare Weld County a non -sanctuary county and moved to amend Code Ordinance #2024-05 to include
language to ensure no expenditures shall be made by Weld County departments for housing,
transportation, or meals. Due to lack of a second, the motion failed. Natalee Tennant, Town of Severance
resident, expressed the urgency of this matter and shared her appreciation for the Board and staff's
diligence to address her concerns. Commissioner James extended his appreciation for Ms. Tennant for
bringing this forward and asked Mr. Barker if it would be possible to amend the Ordinance to establish it
as an Emergency Ordinance, due to the urgency of the matter. In response to Commissioner James,
Mr. Barker advised the Board as to the proper policies and procedures regarding the transformation of
Code Ordinance #2024-05 into an Emergency Ordinance. Commissioner James stated said
transformation, thus, was not possible today. Commissioners Buck and Ross echoed the sentiments of
Commissioner James. In response to Chair Ross, Steve Reams, Weld County Sheriff, confirmed he has
not been contacted by the Center for Immigration Studies to clarify Weld County's policies and ensure
accuracy of the information stated on their website. Commissioner Saine stated that she is glad measures
are being taken in -writing and expressed the importance of action in addition to words.
Commissioner Buck moved to approve Code Ordinance #2024-05 on First Reading. The motion was
seconded by Commissioner James, and upon a roll call vote of five (5) out of five (5), the motion carried
unanimously.
rig PUBLIC COMMENT:
1) Natalee Tennate, Town of Severance resident, offered her comments to the Board.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2024-05 was approved on First Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:30 a.m.
These Minutes were approved on the 13th day of May, 2024.
