HomeMy WebLinkAbout20242944.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, NOVEMBER 6, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 6, 2024, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of October 23, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on October 23, 2024, as follows: 1) ZPAG23-0003 — Roger and Sheryl Hill, 2) USR24-0012 — Janus Solar, LLC, and 3) USR24-0013 — Prospect Solar, LLC. Commissioner James seconded the motion, which carried unanimously. El AMENDMENTS TO AGENDA: There were no amendments to the Agenda. El CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. PROCLAMATIONS: 1) VETERANS DAY - NOVEMBER 11, 2024: Chair Ross read the proclamation for the record. Tami Grant, Deputy Director of the Department of Human Services, thanked the Board for the opportunity to recognize those present who have sacrificed and served in the armed forces to defend the United States. She reported significant changes and shared the commitment to continuous improvements which have resulted in 249 more veterans served to date than in 2023. indicated more flags were installed, and veteran parking spaces were designated outside of the Department of Human Services, Build B. Ms. Grant shared positive feedback from community -based members and partnerships who indicated 1!125 Minutes, Wednesday, November 6, 2024 Page 1 2024-2944 BC0016 there has been a vast improvement in how veterans are able to access available services. She noted there were two (2) fully accredited Veterans Service Officers and one (1) fully accredited Veterans Services Navigator present who are committed to providing on -going services to veterans throughout the county. Each Commissioner, in turn, expressed their appreciation for the service and sacrifice of the men and women who have selflessly served our country to preserve our freedoms and defend our Constitution and the foundation that this country has been built upon. (Clerk's Note: The group gathered for a photo opportunity.) WARRANTS: 1) GENERAL WARRANTS - NOVEMBER 5, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. BIDS: 1) PRESENT BID #62400134, CRS 6 AND 13 INTERSECTION ROUNDABOUT PROJECT - DEPARTMENT OF PUBLIC WORKS: Toby Taylor, Purchasing Department, stated three (3) bids were received and staff will make a recommendation at a future date, yet to be determined. El 2) PRESENT BID #B2400139, GENERATOR MAINTENANCE AT VARIOUS LOCATIONS - FACILITIES DEPARTMENT: Mr. Taylor stated four (4) bids were received and staff will make a recommendation on November 20, 2024. Ei NEW BUSINESS: 1) CONSIDER CONTRACT ID #8793 WORK PLAN AND NOTICE OF FUNDING ALLOCATION (NFA) FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) FOREIGN LABOR CERTIFICATION GRANT PROGRAM, AND AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT BOARD TO SIGN: Ms. Grant stated the work plan is a requirement to receive funding, in the amount of $15,221.00, from the Colorado Department of Labor and Employment to assist agricultural -based employers to fill positions with non-immigrant workers, provide housing inspections, assists with routine housing, field, and sanitation inspections, and provide training. She clarified these are requirements to work alongside the employers before the department is allowed to recruit on their behalf. Commissioner Buck moved to approve said workplan and NFA, and authorize the Chair, Department of Human Services, and Workforce Development Board to sign. The motion was seconded by Commissioner James. In response to Commissioner Saine, Ms. Grant reiterated the department is to work alongside the employers to fulfill needs in the agricultural community, confirmed the employers are responsible for vetting the individuals they choose to employ, and clarified the department is not responsible for verifying that migrant workers return to their origin once the season has ended. After further discussion, it was suggested Commissioner Saine obtain the answers she desires through a Colorado Open Records Act (CORA) request since staff has indicated the answers are not readily available and falls under the employer's responsibilities. There being no further discussion and upon a roll call vote of four (4) to one (1), the motion carried with Commissioner Saine opposed. 2) CONSIDER CONTRACT ID #8794 WORK PLAN AND NOTICE OF FUNDING ALLOCATION (NFA) FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) RESKILLING, UPSKILLING, AND NEXT-SKILLING (RUN) WORKERS PROGRAM, AND AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT BOARD TO SIGN: Ms. Grant stated the workplan will provide additional funding, in the amount of $171,660.00, for the continuance of career services, economic exploration planning, work -based learning, and other training related activities. Commissioner James moved to approve said workplan and NFA, and authorize the Chair, Department of Human Services, and Workforce Development Board to sign. The motion was seconded by Commissioner Buck and it carried unanimously. Minutes, Wednesday, November 6, 2024 Page 2 2024-2944 BC0016 • 3) CONSIDER CONTRACT ID #8826 MEMORANDUM OF UNDERSTANDING FOR REALIZING APTITUDES PROGRAM AND AUTHORIZE CHAIR TO SIGN - FORWARD STEPS: Ms. Grant stated the program is designed to provide unlimited virtual reality and career exploration sessions through career coaching services for students engaged in the Weld County Youth Conservation Corps program with no financial commitment for the county. Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. Eli 4) CONSIDER CONTRACT ID #8833 TASK ORDER CONTRACT FOR FEDERAL DRUG ADMINISTRATION (FDA) TOBACCO RETAIL COMPLIANCE CHECK INSPECTION PROGRAM AND AUTHORIZE CHAIR TO SIGN: Jason Chessher, Director of the Department of Public Health and Environment, stated the Federal Food and Drug Administration (FDA) requires local governments to perform audits for retailers that sell tobacco products. He further stated funds, in the amount of $127,636.68, supplements one (1) full-time and three (3) temporary part-time positions. Commissioner Buck moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. • 5) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - N1/2 NW1/4 NE1/4 SE1/4 S24, T3N, R63W: Bruce Barker, County Attorney, stated this, and the following five (5) items of business, are all for Verdad Resources, LLC, at five (5) acres each and for the bonus amount of $2,000.00 apiece. He indicated the extension provides the company an additional six (6) months to begin drilling, and clarified the only difference between the items of business is the specified locations. Commissioner James moved to approve said extension. The motion was seconded by Commissioner Freeman, and it carried unanimously. • 6) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - N1/2 SE1/4 NW1/4 SE1/4 S24, T3N, R63W: Commissioner Freeman moved to approve said extension. The motion was seconded by Commissioner James, and it carried unanimously. EI 7) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - S1/2 SE1/4 NW1/4 SE1/4 S24, T3N, R63W: Commissioner James moved to approve said extension. The motion was seconded by Commissioner Freeman, and it carried unanimously. 8) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - S1/2 NE1/4 NW1/4 SE1/4 S24, T3N, R63W: Commissioner Freeman moved to approve said extension. The motion was seconded by Commissioner Buck, and it carried unanimously. 9) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - S1/2 SW1/4 SW1/4 SE1/4 S24, T3N, R63W: Commissioner Buck moved to approve said extension. The motion was seconded by Commissioner James, and it carried unanimously. The motion was seconded by Commissioner Buck, and it carried unanimously. 1.1 11) CONSIDER RENEWAL APPLICATION FOR A VINTNER'S RESTAURANT (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - SALT AND ACRES, LLC, DBA SALT AND ACRES: Matthew Conroy, Assistant County Attorney, reviewed the location and history of the establishment, indicated there are no concerns from referral agencies, and recommended approval. Commissioner Freeman moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. El PLANNING: 1) SECOND READING OF CODE ORDINANCE #2024-17, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 24 SUBDIVISIONS OF THE WELD COUNTY CODE (UTILITIES COORDINATING ADVISORY COMMITTEE): Commissioner James moved to read Code Ordinance #2024-17 by audio. The motion was seconded by Commissioner Buck, and it carried unanimously. Mr. Barker read the title for the record. Maxwell Nader, Department of Planning Services, reviewed the proposed changes to Chapter 24 regarding subdivisions of the Weld County Code. He further stated there have been no changes since First Reading and staff recommends approval. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2024-17 on Second Reading. The motion was seconded by Commissioner Freeman, and it carried unanimously. PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2024-17 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
