BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, MARCH 25, 2024
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, March 25, 2024, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Kevin D. Ross, Chair — EXCUSED
Commissioner Perry L. Buck, Pro-Tem
Commissioner Mike Freeman
Commissioner Scott K. James
Commissioner Lori Saine

MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of March 11, 2024, as printed, Commissioner James moved to approve. Commissioner Saine
seconded the motion and it carried unanimously.
• AMENDMENTS TO AGENDA: Commissioner Saine moved to amend the agenda by removing the
15 -minute time limit from the public comment section. There being no second, the motion failed. There
were no further amendments to the agenda.
le CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Freeman seconded the motion and it carried unanimously.
• WARRANTS:
1) GENERAL WARRANTS - MARCH 21, AND 22, 2024: Commissioner James moved to approve the
General Warrants, as printed. Commissioner Saine seconded the motion and it carried unanimously.
El BIDS:
1) APPROVE BID #B2400028, CONCRETE, WASHED ROCK, AND SQUEEGEE - DEPARTMENT OF
PUBLIC WORKS: Toby Taylor, Purchasing Department, stated staff recommends awarding the bid for
squeegee for northern Weld County to Holcin, the low bidder who met specifications, for a total amount
of $12.00 per ton, from their location in Greeley, Colorado; and further stated staff recommends awarding
the bid for squeegee for southern Weld County to Northern Colorado Constructors, the low bidder who
met specifications, for a total amount of $17.00 per ton, from their location in Fort Lupton, Colorado.
Likewise, Mr. Taylor stated staff recommends awarding the bid for washed rock for northern Weld County
to Holcin, the low bidder who met specifications, for a total amount of $35.00 per ton, from their location

in Longmont, Colorado; and further stated staff recommends awarding the bid for washed rock for
southern Weld County to J-2 Contracting, the low bidder who met specifications, for a total amount of
$33.00 per ton, from their location in Platteville, Colorado. He indicated there were no bids received for
Class D, Class E, or Flow Fill material, and the total budgeted amount is $40,000.00. Commissioner
Freeman moved to approve said bid for the various materials and vendors, as recommended by staff.
The motion was seconded by Commissioner James, and it carried unanimously.
• 2) APPROVE BID #B2400029, RECYCLED ASPHALT SCREENING AND CONCRETE
CRUSHING - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor reviewed staffs recommendation to
select Engineered Paving, dba Apricity, Inc., the sole bidder meeting specifications, for a total amount of
$137,818.00. Commissioner James moved to approve said bid. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
• 3) APPROVE BID #62400031, JAIL BOOKING AREA CONSTRUCTION PROJECT - FACILITIES
DEPARTMENT: Mr. Taylor introduced TCC Corporation as the low bidder selected by staff and confirmed
they met all specifications, with said bid totalling $2,538,584.00. Commissioner Freeman moved to
approve said bid. The motion was seconded by Commissioner Saine, and it carried unanimously.
--- NEW BUSINESS:
1) CONSIDER CONTRACT ID #7956 AMENDMENT #1 TO SETTLEMENT AGREEMENT FOR
BRIDGE 54/13A RECONSTRUCTION PROJECT AND AUTHORIZE CHAIR PRO-TEM TO SIGN -
DUSTIN AND JAMIE CHRISTENSEN: Clay Kimmi, Department of Public Works, stated this amendment
to the right-of-way (ROW) settlement agreement is for a Temporary Construction Easement (TCE)
allowing the County to install bollards to protect one of the gas valves located on the Christensen
property. He indicated the cost for the TCE is in the amount of $500.00, which is accounted for in the
2024 budget. Commissioner James moved to approve said amendment and authorize the
Chair Pro-Tem to sign. The motion was seconded by Commissioner Freeman, and it carried
unanimously.
• 2) CONSIDER SPECIAL EVENT PERMIT AND AUTHORIZE CHAIR PRO-TEM TO SIGN - THE
WILD ANIMAL SANCTUARY, A COLORADO NON-PROFIT CORPORATION: Matthew Conroy,
Assistant County Attorney, stated for the Board's consideration is a Special Event Permit for The Wild
Animal Sanctuary located in Keenesburg, Colorado. He further stated there are no concerns with the
application, a sign was posted at the location as notice of this public hearing, and staff recommends
approval. Michelle McGraw, representative of The Wild Animal Sanctuary, explained this event is for their
annual fundraiser dinner, "Summer Safari", and "Run into the Wild", run/walk event hosting around 1,500
people. She thanked the Board for their consideration and support of the sanctuary. There was no public
testimony offered concerning this matter. Commissioner Saine moved to approve said Special Event
Permit and authorize the Chair Pro-Tem to sign. Seconded by Commissioner James, the motion carried
unanimously.
• PLANNING:
1) CONSIDER IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT ACCORDING TO
POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR PRO-TEM TO
SIGN, AND ACCEPT COLLATERAL FOR ACCESS PERMIT, AP20-00070 - OMAHA TRACK, INC.:
Jazmyn Trujillo -Martinez, Department of Planning Services, stated in regard to the Improvements and
Road Maintenance Agreement for Access Permit, AP20-00070, staff requests the Board's acceptance of
Project Collateral in the amount of $1,897,262.25, procured in the form of a Performance Bond (#147512)
issued by Universal Surety Company. She stated the applicant understands the required improvements
to be completed, per the scope of work provided. Commissioner James moved to approve said
agreement, authorize the Chair Pro-Tem to sign, and accept collateral. The motion was seconded by
Commissioner Freeman, and it carried unanimously.

PUBLIC COMMENT: No public comment was offered; however, Commissioner Saine stated the
language stated for the record by Chair Pro-Tem Buck was considered at a work session that was closed
to the public, and requested a public work session on said language. In response, Commissioner
Freeman stated the language produced for the Public Comment section was done so by the Weld County
Attorney, Bruce Barker, and further recommended that Commissioner Saine request said work session
with the Chair, Commissioner Ross, for further discussion.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:13 a.m.
