RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, JUNE 3, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 3, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli El MINUTES: 1) There being no corrections to the Minutes of the Board of County Commissioners meeting of May 13, 2024, as printed, Commissioner Buck moved to approve. Commissioner Freeman seconded the motion and it carried unanimously. El 2) There being no corrections to the Minutes of the Board of County Commissioners meeting of May 15, 2024, as printed, Commissioner James moved to approve. Commissioner Buck seconded the motion and it carried unanimously. • 3) There being no corrections to the Minutes of the Board of County Commissioners meeting of May 20, 2024, as printed, Commissioner Freeman moved to approve. Commissioner Buck seconded the motion and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner James moved to read Code Ordinance #2024-06 by audio. The motion was seconded by Commissioner Buck and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner James moved to approve the Certification of Hearings conducted on May 13, 2024, as follows: 1) LEP24-0001 — Benjamin Marmon and Janna Czepiel, and 2) Petition for Vacation of a Portion of County Road (CR) 78 Between Union Pacific Railroad Right -of -Way and CR 37 — Weld County Department of Public Works. Commissioner Freeman seconded the motion, which carried unanimously. (9IZD Minutes, Monday, June 3, 2024 Page 1 2024-1376 BC0016 • AMENDMENTS TO AGENDA: Commissioner Saine moved to remove the 15 -minute time limit and majority vote provisions under 'Public Comment'. There being no second, the motion failed. There were no further amendments to the Agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. • PROCLAMATIONS: 1) REUNIFICATION MONTH - JUNE 2024: Chair Ross read the proclamation for the record. Jamie Ulrich, Director of the Department of Human Services, thanked the Board for the recognition and took the opportunity to highlight the efforts of families in the reunification process, shared the four main components of reunification goals, and shared this year's national theme, "We Believe in the Resiliency and Strength of Families," which focuses on partnering with families to aid and mitigate concerns when children are removed and placed with foster care providers. She stated reunification remains the primary goal with authentic and equitable family engagement. Ms. Ulrich invited the Board to attend the Department of Humans Services' celebration of National Reunification on June 14, 2024, and introduced Child Welfare staff who were present for the record. The Board extended their appreciation to the Department for their support for families during their times of need. (Clerk's Note: The group gathered for a photo opportunity.) IE WARRANTS: 1) GENERAL WARRANTS — MAY 28, 29, and 31, 2024: Commissioner James moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously. IR 2) COMMISSIONER WARRANTS (SCOTT K. JAMES) - MAY 31, 2024: Commissioner Buck moved to approve the Warrant, as printed. Commissioner Freeman seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried, with Commissioner James recused. BIDS: 1) APPROVE BID #B2400017, 2024 FORD INTERCEPTOR UTILITY BASE (K8A - QTY 2) - DEPARTMENT OF FLEET SERVICES AND SHERIFF'S OFFICE: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Ken Garff Ford of Greeley, for a total amount of $81,790.00. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner Buck and it carried unanimously. el 2) APPROVE BID #B2400092, WELD COUNTY FUEL - DEPARTMENT OF FLEET SERVICES: Mr. Taylor reviewed staffs recommendation to select Team Patroleum, the low bidder meeting specifications for fuel, for a total amount of $2.87 per gallon, at the time of bid. He further reviewed staffs recommendation to select LP Propane, the low bidder meeting specifications for propane, for a total amount of $1.27 per gallon, at the time of bid. Commissioner James moved to approve said bid. The motion was seconded by Commissioner Freeman and it carried unanimously. • 3) APPROVE BID #B2400083, COURTHOUSE AND CENTENNIAL CENTER HOT WATER GENERATOR AND CHILLED WATER PUMP REPLACEMENT - FACILITIES DEPARTMENT: Mr. Taylor introduced Air -Systems Engineering as the low bidder selected by staff and confirmed they met all specifications, with said bid amounting to $207,978.25. Commissioner Saine moved to approve said bid. The motion was seconded by Commissioner Buck and it carried unanimously. Minutes, Monday, June 3, 2024 Page 2 2024-1376 BC0016 • 4) APPROVE BID #B2400091, SECURITY CAMERA EQUIPMENT AND LICENSING ACQUISITION - FACILITIES DEPARTMENT: Mr. Taylor stated seven (7) bids were received and explained the various reasons why the first three (3) bids did not meet specifications. He stated staff recommends selecting Paladin Technologies, the lowest bidder who met specifications, for a total amount of $77,822.00. Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. et 5) APPROVE BID #B2400072, CISCO NETWORK SWITCHES OPERATIONAL TECHNOLOGIES (OT) — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Taylor stated staff recommends selecting, Zivaro, Inc., as the lowest cost solution that meets functionality needs, for a total amount of $77,670.40. Commissioner Saine moved to approve said bid. The motion was seconded by Commissioner Buck and it carried unanimously. le 6) PRESENT BID #B2400087, AUDIO AND VISUAL (AV) CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Taylor stated four (4) bids were recieved and staff will make a recommendation on June 17, 2024. • 7) PRESENT BID #B2400088, SHERIFF'S OFFICE (SO) CAMERA CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Taylor stated three (3) bids were recieved and staff will make a recommendation on June 17, 2024. IR 8) PRESENT BID #62400094, CARBIDE CUTTING BITS - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated five (5) bids were recieved and staff will make a recommendation on June 17, 2024. El 9) PRESENT BID #62400096, 2024 STEEL BID FOR FENCING AND MISCELLANEOUS PRODUCTS - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated one (1) bid was recieved and staff will make a recommendation on June 17, 2024. El 10) PRESENT BID #B2400097, 2024 STEEL BID FOR CORRUGATED METAL PIPE, ALUMINIZED PIPE, AND PLASTIC CULVERTS - DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated one (1) bid was recieved and staff will make a recommendation on June 17, 2024. IR NEW BUSINESS: 1) CONSIDER CONTRACT ID #8203 INTERGOVERNMENTAL AGREEMENT FOR WELD COUNTY DRUG TASK FORCE AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY - CITIES OF GREELEY AND EVANS POLICE DEPARTMENTS: Sonja Kohlgraf, Sheriff's Office, stated the Intergovernmental Agreement with the Cities of Greeley and Evans Police Departments allows for continued Drug Task Force operational services for the next five (5) consecutive years, ending on March 31, 2029. Commissioner Buck moved to approve said agreement and authorize the Chair to sign and submit electronically. The motion was seconded by Commissioner James and it carried unanimously. • 2) CONSIDER STANDARD FORM, RATES, AND PROVIDER LIST FOR INDIVIDUAL PROVIDER CONTRACTS FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN CONTRACTS CONSISTENT WITH SAID FORM: Ms. Ulrich stated the form is an annual requirement for child welfare to purchase out -of -home foster and kinship care for the 2024-2025 State of Colorado fiscal year. Commissioner Freeman moved to approve said form, rates, and provider list, and authorize the Chair to sign contracts consistent with said form. The motion was seconded by Commissioner Buck and it carried unanimously. Minutes, Monday, June 3, 2024 Page 3 2024-1376 BC0016 • 3) CONSIDER STANDARD FORM, RATES, AND PROVIDER LIST FOR AGREEMENTS FOR FOSTER CARE RESPITE SERVICES BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN CONTRACTS CONSISTENT WITH SAID FORM: Ms. Ulrich stated the form is for the previously mentioned foster care providers who also provide respite care services for the 2024-2025 State of Colorado fiscal year. Commissioner James moved to approve said form, rates, and provider list, and authorize the Chair to sign agreements consistent with said form. The motion was seconded by Commissioner Buck and it carried unanimously. (Clerk's Note: Chair Ross inadvertently referred to this item of business as Item #2.) • 4) CONSIDER STANDARD FORM, RATES, AND PROVIDER LIST FOR AGREEMENTS FOR THERAPEUTIC FOSTER CARE RESPITE SERVICES BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN CONTRACTS CONSISTENT WITH SAID FORM: Ms. Ulrich stated the form is for the therapeutic foster care providers who also provide respite care services for the 2024-2025 State of Colorado fiscal year. Commissioner Freeman moved to approve said form, rates, and provider list, and authorize the Chair to sign agreements consistent with said form. The motion was seconded by Commissioner Buck and it carried unanimously. IR 5) CONSIDER CONTRACT ID #8205 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN — BRADLEY AND HILARY KING: Ms. Ulrich stated the contract is for a new foster care provider located in Longmont, Colorado. Commissioner Freeman moved to approve said contract and authorize the Chair to sign. The motion, which was seconded by Commissioner James, carried unanimously. • 6) CONSIDER CONTRACT ID #8248 AMENDMENT #3 TO INTERGOVERNMENTAL AGREEMENT FOR AGING AND DISABILITY RESOURCES FOR COLORADO (ADRC) TRANSITION -RELATED REFERRALS AND OPTIONS COUNSELING, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Ms. Ulrich stated the amendment extends the term through June 30, 2025, updates the contract maximum, and amends the quarterly payment to the Department of Human Services. Commissioner James moved to approve said amendment and authorize the Chair to sign and submit electronically. Commissioner Buck seconded the motion and it carried unanimously. • 7) CONSIDER CONTRACT IDS #8250 - #8254 FIVE (5) MEMORANDUMS OF UNDERSTANDING FOR FRONT RANGE COMMUNICATIONS CONSORTIUM (FRCC) INTEROPERABILITY RADIO CHANNEL SHARING AND USE BETWEEN WELD COUNTY REGIONAL COMMUNICATIONS CENTER (WCRCC) AND VARIOUS AGENCIES, AND AUTHORIZE CHAIR AND DEPARTMENT OF PUBLIC SAFETY COMMUNICATIONS TO SIGN: Cordero Bustos, Department of Public Safety Communications, stated the Memorandum of Understanding (MOU) allows for shared communication channels with first responder agencies that provide additional support for resources to the community at no added cost. Commissioner Commissioner Buck moved to approve the five (5) referenced memorandums of understanding and authorize the Chair and Department of Public Safety Communications to sign. The motion was seconded by Commissioner James, and it carried unanimously. le 8) CONSIDER CONTRACT ID #8120 PROFESSIONAL SERVICES AGREEMENT FOR SECURITY SERVICES AT 2024 WELD COUNTY FAIR AND AUTHORIZE CHAIR TO SIGN - ALL - SEASON EVENTS AND SECURITY, LLC: Mikayla Gabel, CSU Extension Service of Weld County, stated the agreement is for security services and the company has been requested by the City of Greeley as well. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. Minutes, Monday, June 3, 2024 Page 4 2024-1376 BC0016 • 9) CONSIDER GRANT APPLICATION AND WORK PLAN FOR HIGH -IMPACT HUMAN IMMUNODEFICIENCY VIRUS (HIV) PREVENTION PROGRAM, AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY: Jason Chessher, Director of the Department of Public Health and Environment, reported Weld County is the fifth (5th) highest County for new HIV infections in the State of Colorado, based on 2023 statistical data, and requested approval to apply for grant funds to supplement testing services. In response to Commissioner Saine, Mr. Chessher confirmed the services do not require proof of identification to receive treatment. Commissioner James moved to approve said application and authorize the Chair to sign electronically. The motion, which was seconded by Commissioner Freeman, and upon a roll call vote of four (4) to one (1), the motion carried, with Commissioner Saine opposed. e 10) CONSIDER CONTRACT ID #8262 AMENDMENT #1 TO TASK ORDER CONTRACT FOR LOCAL PLANNING AND SUPPORT FOR CORE PUBLIC HEALTH SERVICES, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Chessher stated the amendment provides annual funding allocated from the State of Colorado based on population, in the amount of $866,534.00, for the 2024-2025 fiscal year. Commissioner Freeman moved to approve said amendment and authorize the Chair to sign and submit electronically. The motion was seconded by Commissioner James and it carried unanimously. • 11) CONSIDER CONTRACT ID #8265 STATEMENT OF WORK FOR WASTE TIRE INSPECTION PROGRAM AND AUTHORIZE CHAIR TO SIGN: Mr. Chessher stated the statement of work provides funding to reimburse staff's time to conduct waste tire inspections for facilities and haulers, in the amount of $3,326.00. Commissioner James moved to approve said statement of work and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. le 12) CONSIDER CONTRACT ID #8269 AMENDMENT #3 TO TASK ORDER CONTRACT FOR COMMUNITIES THAT CARE YOUTH SUBSTANCE ABUSE PREVENTION PROGRAM AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Chessher stated the amendment is for the fourth year of a five-year cycle and provides funding to support staff in the Communities That Care model to address youth substance abuse prevention. Commissioner Freeman moved to approve said amendment and authorize the Chair to sign and submit electronically. The motion, which was seconded by Commissioner James, carried unanimously. • 13) CONSIDER CONTRACT ID #8270 TASK ORDER CONTRACT FOR PUBLIC HEALTH PREPAREDNESS AND RESPONSE PROGRAM, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Chessher presented the new five-year contract to support two (2) full-time equivalents (FTE) for a Staff Epidemiologist within the Department of Public Health and Environment, and a Public Health Emergency Specialist within the Office of Emergency Management. He indicated the total maximum funding amount is $307,071.00 for the 2024-2025 State of Colorado fiscal year. Commissioner Buck moved to approve said contract and authorize the Chair to sign and submit electronically. Commissioner Freeman seconded the motion and it carried unanimously. 14) CONSIDER CONTRACT ID #8111 INTERGOVERNMENTAL AGREEMENT FOR TRAFFIC SIGNAL INSTALLATION, OPERATION, AND MAINTENANCE FOR CRS 13 AND 2 INTERSECTION (AKA COLORADO BLVD AND 168TH AVE), AND AUTHORIZE CHAIR TO SIGN - ADAMS COUNTY AND CITY OF THORNTON: Don Dunker, Department of Public Works, stated the agreement with Adams County and the City of Thornton is for the installation, operation, and maintenance a traffic light located at the intersection of County Roads (CRs) 2 and 13, which is also known as Colorado Boulevard and 168th Avenue. He explained the City of Thornton received grant funding in the amount of $614,700.00, and they retain 50% of the overall respective roles and responsbilies for the project. Minutes, Monday, June 3, 2024 Page 5 2024-1376 BC0016 Mr. Dunker explained Weld and Adams Counties are each accountable for 25% of this project, and indicated Weld County's contribution amounts to $17,075.00. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. (Clerk's Note: The title was changed subsequent to the meeting.) • 15) CONSIDER ACCEPTANCE OF DEED OF DEDICATION FOR PUBLIC ROAD RIGHT-OF-WAY FOR PURCHASE OF CERTAIN PROPERTY FOR PUBLIC ROAD IMPROVEMENTS FOR CR 41 AND SH 52 INTERSECTION PROJECT, AND AUTHORIZE CHAIR TO SIGN — MICHAEL DREILING: Erich Green, Department of Public Works, stated the deed is for the northwest quadrant of the County Road (CR) 41 and State Highway (SH) 52 intersection project, and is pursuant to the purchase agreement approved by the Board on April 29, 2024, which allowed payment to the property owner and closing to occur. As a result, he indicated Michael Dreiling signed the deed to convey 0.01 of an acre for public road right-of-way to Weld County, and staff recommends acceptance. Commissioner Buck moved to accept said deed and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. • 16) CONSIDER CONTRACT ID #8267 APPLICATION FOR 2024 HOMELAND SECURITY GRANT PROGRAM FUNDS FOR NORTHEAST ALL -HAZARDS REGION AND AUTHORIZE CHAIR AND DEPARTMENT OF FINANCE TO SIGN ELECTRONICALLY: Chris D'Ovidio, Weld County Controller, stated Weld County is the fiscal agency for the Northeast All -Hazards Region for the Federal Emergency Management Agency (FEMA) and the U.S. Department of Homeland Security, and as such, requested to submit the application for the 2024 Homeland Security Grant Program. Commissioner James moved to approve said application and authorize the Chair and Department of Finance to sign electronically. The motion was seconded by Commissioner Buck and it carried unanimously. • 17) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Mr. D'Ovidio referenced the list of items that are designated as surplus and are to be sent for auction on June 5, 2024. He noted all replacement items have been received and are in use. Commissioner Freeman moved to approve said Resolution and authorize the Controller to sign any necessary documents. The motion, which was seconded by Commissioner Buck, carried unanimously. CI 18) CONSIDER DECLARING WELD COUNTY A "TENTH AMENDMENT SANCTUARY COUNTY": Commissioner Saine moved to continue said Resolution to Wednesday June 5, 2024, so concerned parties can be present; however, the motion failed with no second. After brief discussion, Commissioner Saine moved to approve said Resolution, but due to lack of a second, the motion failed. • PLANNING: 1) FIRST READING OF CODE ORDINANCE #2024-06, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29 BUILDING REGULATIONS OF THE WELD COUNTY CODE (NATIONAL ELECTRICAL CODE): Robert Godin, Department of Planning Services, gave a brief overview of the proposed changes to Chapter 29 regarding building regulations specific to the 2023 National Electrical Code (NEC), the 2021 Energy Conservation Code, and the 2018 Swimming Pool and Spa Code. He stated the purpose for this ordinance is to bring the Weld County Code up-to-date with current international codes. In response to Commissioner James, Mr. Godin discussed variables regarding some of the requirements and reviewed the cost analysis of a six percent (6%) increase to current construction costs. Commissioner Freeman echoed the sentiments of Commissioner James and expressed his concerns regarding the adoption of the international codes, to which Mr. Godin concurred. In response to Commissioner Saine, Mr. Godin confirmed no work session was held for this matter prior Minutes, Monday, June 3, 2024 Page 6 2024-1376 BC0016 to this First Reading. Elizabeth Relford, Interim Director of the Department of Planning Services, indicated she discussed the matter with her Coordinator and stated a work session was not scheduled prior to First Reading due to the timing necessitated to satisfy the deadline set by legislature. She discussed the department deferring these changes as long as possible to allow for adequate review. Commissioner Freeman commented no amount of work sessions will change the outcome of this Ordinance due to it being a statutory requirement to be adopted into the Weld County Code no later than August 1, 2024. In response to Commissioner James, Mr. Godin stated he could not speculate what actions the State of Colorado would likely impose in the event the Board chose not to adopt these changes. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2024-06 on First Reading, with the request for a work session. The motion was seconded by Commissioner Freeman and it carried unanimously. El 2) FINAL READING OF CODE ORDINANCE #2024-04, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING OF THE WELD COUNTY CODE (ACCESSORY DWELLING UNITS AND R-1 REVISIONS): Commissioner James moved to read Code Ordinance #2024-04 by title only. The motion was seconded by Commissioner Commissioner Buck and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Maxwell Nader, Department of Planning Services, displayed a PowerPoint presentation and reviewed the recommended changes since Second Reading as a result of a work session that was held on May 22, 2024, to address concerns received by the public to modify the definition of `Gardening,' and revise provisions for Accessory Dwelling Units (ADUs) in relation to septic systems. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2024-04 on Final Reading. The motion was seconded by Commissioner Buck and it carried unanimously. El 3) FINAL READING OF CODE ORDINANCE #2024-08, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 24 SUBDIVISIONS OF THE WELD COUNTY CODE (RURAL LAND DIVISIONS (RLDF]): Commissioner James moved to read Code Ordinance #2024-08 by title only. The motion was seconded by Commissioner Buck and it carried unanimously. Mr. Barker read the title for the record. Mr. Nader displayed a PowerPoint presentation, reviewed the proposed changes, and stated there have been no additional changes since Second Reading. No public testimony was offered concerning this matter. In response to Commissioner Saine, Chair Ross and Ms. Relford stated staff was directed to perform these proposed changes at Commissioner Saine's request at the Land Use Hearing for the Sharp Trust on April 24, 2024. Commissioner Freeman moved to approve Code Ordinance #2024-08 on Final Reading. The motion was seconded by Commissioner James, and upon a roll call vote, the motion carried unanimously. IR PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda.
