Dear Diana,
We would like to remove the building envelope from our lot so that we can build an
accessory structure outside of the current building envelope. The primary residence
is within the current building envelope, but the new accessory structure is planned
to be located outside of this envelope. The location and design of the accessory
structure has already been approved by the HOA, and we need to remove the
building envelope to be able to get a permit and build this accessory structure
outside of this envelope. We would like the stand-alone structure to be located to
the West of the primary residence which is outside of this envelope.
The site is zoned PUD-Estate and as such is subject to the Estate Zone District
building setbacks. If approved, this would be the 4th out of 8 lots in the
neighborhood to have their building envelope removed. The neighborhood and lots
were designed for multiple buildings on each lot, but the building envelopes were
not placed or sized for this, which has resulted in multiple building envelope
removal requests from Owners within the neighborhood. The HOA has agreed that
all primary residence houses must be located within the building envelope, and any
additional structures would be voted on by all members of the HOA. The design and
placement of my proposed accessory structure has already been approved by the
members of the HOA.
In the HOA covenants, there is a piece that describes the building types and use
restrictions, which the addition of my accessory structure fits into the use of these
lots. Below is the respective section from the HOA covenants addressing this issue:
9.2 Building Type and Use Restrictions. Each Lot may be used only for
residential purposes and developed by construction of a Dwelling Unit and a
guest house or caretaker residence ("Guest House') together with accessory
structures, which are incidental to a residential use and which is subordinate
to the Dwelling Unit constructed upon a Lot.
