HomeMy WebLinkAbout20243092.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, NOVEMBER 25, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 25, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine — EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli • AMENDMENTS TO AGENDA: There were no amendments to the Agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. • PROCLAMATIONS: 1) EATON REDS DAY, CLASS 3A GIRLS SOFTBALL STATE CHAMPIONSHIP - NOVEMBER 25, 2024: Chair Ross read the proclamation for the record. Chad Shaw, Coach, thanked the Board for the recognition of the team's unwavering dedication and hard work that led to them winning the state championship. The team introduced themselves for the record, thanked the Commissioners for supporting them and recognizing their accomplishments. Each of the Commissioners extended their congratulations to the team for their accomplishments and applauded their outstanding leadership skills and hard work as a part of Team Weld. (Clerk's Note: The group gathered for a photo opportunity). WARRANTS: 1) GENERAL WARRANTS - NOVEMBER 22, 2024: Commissioner James moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously. El BIDS: 1) PRESENT BID #62400151, GRADER BLADES - DEPARTMENT OF PUBLIC WORKS: Toby Taylor, Purchasing Department, stated six (6) bids were received and staff will make a recommendation on December 9, 2024. 17 -ho Minutes, Monday, November 25, 2024 Page 1 2024-3092 BC0016 • NEW BUSINESS: 1) CONSIDER CONTRACT ID #8875 ENERGY AND MINERAL IMPACT ASSISTANCE FUNDS (EIAF) PROGRAM AND SPECIAL INCENTIVES FUNDING GRANT APPLICATION FOR CR 29 IMPROVEMENTS PROJECT BETWEEN CR 74 AND SH 14 (TIER II - DECEMBER CYCLE), AND AUTHORIZE DEPARTMENT OF PUBLIC WORKS TO SUBMIT ELECTRONICALLY: Elizabeth Relford, Grant Project and Support Officer, requested to submit a Tier II application to the Department of Local Affairs (DOLA), on behalf of the Department of Public Works, for the County Road (CR) 29 full depth reconstruction improvements project, between CR 74 and State Highway (SH) 14. She indicated the county's application request, in the amount of $950,000.00, will go towards the project's overall estimated $1.95 Million in costs. Commissioner Freeman moved to approve said application and authorize the Department of Public Works to submit electronically. The motion was seconded by Commissioner James and it carried unanimously. • 2) CONSIDER CONTRACT ID #8879 ENERGY AND MINERAL IMPACT ASSISTANCE FUNDS (EIAF) PROGRAM AND SPECIAL INCENTIVES FUNDING GRANT APPLICATION FOR WELD COUNTY 2025 COMPREHENSIVE PLAN (TIER I - DECEMBER CYCLE), AND AUTHORIZE DEPARTMENT OF PLANNING SERVICES TO SUBMIT ELECTRONICALLY: Ms. Relford requested to submit a Tier I application to DOLA, on behalf of the Department of Planning Services, for the Weld County 2025 Comprehensive Plan update. If awarded, she indicated, the amount will be $200,000.00, which will go towards the Plan's overall estimated cost of $600,000.00, and will allow for a qualified consultant to be obtained through the county's procurement process. Commissioner James moved to approve said application and authorize the Department of Planning Services to submit electronically. The motion was seconded by Commissioner Buck and it carried unanimously. --' 3) CONSIDER CONTRACT ID #8839 AMENDMENT #1 FOR STAFFING REVISION AND CONSENT TO ASSIGNMENT AND ASSUMPTION OF CLIENT AGREEMENT FOR ONSITE MEDICAL CLINIC SERVICES FROM EVERSIDE HEALTH, LLC, TO MARATHON HEALTH, LLC, AND AUTHORIZE CHAIR TO SIGN: Jill Scott, Director of the Department of Human Resources, alongside Allison Palmer, Department of Human Resources, stated the amendment allows for the County to employ an additional part-time Registered Dietician at the Weld County Employee Medical Clinic, and to assign all contractual obligations to Marathon Health, LLC, as a result of their business merger. Commissioner Freeman moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. Fi 4) CONSIDER CONTRACT ID #8884 SUBSCRIPTION ORDER FORM PURSUANT TO MASTER SERVICES AGREEMENT FOR ENTERPRISE RESOURCE PLANNING (ERP) SOFTWARE IMPLEMENTATION AND INTEGRATION SERVICE, AND AUTHORIZE CHAIR TO SIGN - WORKDAY, INC.: Ms. Scott stated the purpose of the form is to accurately reflect the number of workers and subscription rights, as applicable, for the use of services provided by Workday, Inc., pursuant to the provisions set forth in the Master Services Agreement. Additionally, she noted the Order Form takes effect as of January 1, 2025, and will go through January 16, 2026, for the total amount of $88,366.00. Commissioner James moved to approve said order form and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. • 5) CONSIDER TEMPORARY CLOSURE OF CR 46 BETWEEN CRS 1 AND 3: Amy Mutchie, Department of Public Works, stated the closure will begin December 2, 2024, and go through December 5, 2024, for the replacement of an irrigation culvert. She indicated water will be used, as needed, for dust control on the one (1) mile stretch of the detour route. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner James and it carried unanimously. Minutes, Monday, November 25, 2024 Page 2 2024-3092 BC0016 6) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO INTERIM CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Cheryl Pattelli, Chief Financial Officer, stated the equipment listed on Exhibit A are set for auction on December 4, 2024, replacements have already been placed into production, and staff recommends approval. Commissioner Freeman moved to approve said declaration as surplus equipment, sale of same at auction, and authorize Interim Controller to sign any necessary documents. The motion was seconded by Commissioner Buck and it carried unanimously. 7) FINAL READING OF CODE ORDINANCE #2024-16, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE OF THE WELD COUNTY CODE (PURCHASING CARDS): Commissioner James moved to read Code Ordinance #2024-16 by title only. The motion was seconded by Commissioner Freeman, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Ms. Pattelli indicated there have been no additional changes since Second Reading, and stated staff recommends approval. No public testimony was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2024-16 on Final Reading. The motion was seconded by Commissioner Buck and it carried unanimously. El PLANNING: 1) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF COUNTY COMPLIANCE VIOLATION PENALTIES AS SPECIAL ASSESSMENT - MARCO ANTONIO RUIZ SOTO AND MARIA DEL CARMEN BEJARANO-BARRAZA (CONT'D FROM 9/30/2024): Matthew Conroy, Assistant County Attorney, reviewed the location, court -ordered daily penalties, and violations on the property for the record. He reported the property owners have removed the commercial equipment and vehicles from the property, but they still need to have an accessary building permitted for the property to be compliant with the Weld County Code. Cynthia Villanueva, Code Compliance Officer for the Department of Planning Services, displayed photographs taken on November 14, 2024, which reflect the current status of the property; therefore, staff recommends dismissal of the certification of penalties from February 5, 2024, up to and including October 27, 2024, (a period of 266 days), in the amount of $13,300.00, with the understanding the property owners are to follow through with the permitting process for the accessary building. The property owners were present and stated their concerns with their inability to pay the amount. Mr. Conroy reiterated it is staff's recommendation to not certify at this time. Commissioner James moved to dismiss said certification. The motion was seconded by Commissioner Buck. In response to Commissioner Freeman, Mr. Conroy confirmed the permit for the accessary building is still required of the property owners to bring their property into compliance with the Weld County Code, and should they not follow through, they will start the court -assessed penalties all over again. There being no further discussion, the motion carried unanimously. PUBLIC COMMENT: No public comment was offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2024-16 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
