HomeMy WebLinkAbout20240120.tiffRESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR COORDINATION OF IN -KIND SERVICES AND AUTHORIZE CHAIR TO SIGN - PROJECT SELF-SUFFICIENCY OF NORTHERN COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for the Coordination of In -Kind Services among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, the Workforce Development Board, and the Project Self -Sufficiency of Northern Colorado, commencing upon full execution of signatures, and ending December 31, 2026, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for the Coordination of In -Kind Services among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Employment Services of Weld County, the Workforce Development Board, and the Project Self -Sufficiency of Northern Colorado, be, and hereby is, approved. Project Self -Sufficiency of Northern Colorado will be given an office space in the Department one day a week to conduct participant meetings for Weld County Participants. In return, Project Self -Sufficiency of Northern Colorado will provide referrals to the Department for counseling and guidance, training services, placement services and supportive services. The term of this MOU is the date of execution through December 31, 2026, unless previously terminated or updated by one of the Parties pursuant to the terms of the MOU. What options exist for the Board? Approval of the MOU between ESWC and Project Self -Sufficiency of Northem Colorado. Deny approval of the MOU between ESWC and Project Self -Sufficiency of Northern Colorado. Consequences: There will not be a MOU between ESCW and Project Self -Sufficiency. Impacts: Weld County residents will not be provided the services that Project Self -Sufficiency has to offer. Purpose The purpose of this Memorandum of Understanding (MOU) is to establish a framework for cooperation and collaboration between Department and Contractor through a non -financial agreement of in -kind services. The Contractor will be given office space in the Department one day a week to conduct participant meetings for Weld County participants. In return the Contractor will provide referrals to the Departments services. Term of this Memorandum of Understanding This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning the date this MOU becomes fully executed (the "Effective Date"), and shall remain in effect until December 31, 2026, unless previously terminated or updated by one of the Parties pursuant to the terms of this MOU. Roles and Responsibilities of both the Department and Contractor Responsibilities of the Contractor: 1. Train the County and/or other Partner staff in the roles and mission, goals, and philosophy of the Contractor. 2. Provide program specific assessments for participants that become co -enrolled in both Department and Contractor programs and have signed a Release of Information (ROI). 3. Assist clients in accessing ConnectingColorado at the Department office or provide information to customers on accessing ConnectingColorado at a point of entry that the customer desires. 4. Provide opportunities for the County staff to attend Contractor's training as appropriate. 5. Assist the Weld County Workforce Development Board (WCWDB) to better understand the Contractor's program and services provided by giving an annual report that Employment Services of Weld County can share with the WCWDB. 6. Develop methods of collaboration, coordination and service delivery enhancement leading to optimal use of resources within the One -Stop system that promotes employment, earnings, and training opportunities to the Contractor's participants. 7. Provide the full range of services available as appropriate for co -enrolled participants which would include: a. Counseling and guidance provided directly by a counselor during the individual's plan of services. b. Training services. c. Placement services. d. Supportive services. Responsibilities of the Department: 1. Provide opportunities for cross training staff, which may include but is not limited to: a. Use of the One -Stop Resources. b. Utilization of the open job orders list distributed weekly. oZo�� - O/.2 -O c. Assisting job seekers with accessing and completing applications in ConnectingColorado. ciProviding the following information regarding services available at the Department for participants co -enrolled in partner programs: i. Orientation to the programs. ii. Intake and eligibility processing. iii. Basic assessment. iv. Career planning. v. Case management. vi. Coordinated job search, job development, and job placement activities. vii. Hiring and career development events. viii. Follow-up as required by funding sources. 2. Main_ain a website that provides on-line information regarding services that are available at the Depa-tment. Modifications. This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination. This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availability of funding. Therefore, the Department may terminate this MOU at any time if the source of funding for the services made available to Contractor is no longer available to the Department, cr for any other reason. Contractor reserves the right to suspend services to clients if funding is no longer available. Entire Agreement. This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Contractor and the Department may not assign any of its rights or obligations hereunder without the prior consent of boll parties. No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the terms and conditions of :his MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Immunity. No term or condition of this contract shall be construed or interpreted as a waiver, exprem or implied, of any of the immunities, rights, benefits, protections, or other provisions, of the Colorado Governmental Immunity Act 0024-10-101 et seq., as applicable now or hereafter amended. Independent Contractor. Contractor agrees that it is an Independent Contractor, and that the Contractor's cfficers, agents, or employees will not become employees of the Department, nor entitled to any employee benefits from the Department as a result of the execution of this MOU. Contractor shall perform its dudes hereunder as an Independent Contractor. Contractor shall be solely responsible for its acts and thoseaf its agents and employees for all acts performed pursuant to this MOU. Contractor, its employees, and agents are not entitled to unemployment insurance or workers' compensation benefits through the Department and the Department shall not pay for or otherwise provide such coverage for Contractor or any of its agents or employees. Unemployment insurance benefits will be available to Contractor and its employees and agents only if such coverage is made available by Contractor or a third party. Contractor shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severability. If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties.
