CBEP Solar 22, LLC and CBEP Solar 23, LLC have provided notice to all mineral estate owners and lessees of mineral interests. This notice, attached below, includes the time and place of the initial public hearing for Case Number USR23-0024, the nature of the public hearing, the legal descriptions by section, township and range of the properties, and the name of the applicants, being CBEP Solar 22, LLC and CBEP Solar 23, LLC. This notice was provided thirty (30) days before the scheduled public hearing via FedEx and USPS Certified Mail. This narrative will highlight the process CBEP Solar 22, LLC and CBEP Solar 23, LLC used to identify mineral ownership and interest for both properties. First, CBEP Solar 22, LLC and CBEP Solar 23, LLC subcontracted 39North, LLC to identify a list of mineral owners, as well as a list of entities requesting notification, for each property. These lists, including both the names and addresses, are included in Exhibit A: 39North, LLC Mineral Notification Lists. William (Bill) Ormiston, a Title Manager at 39North, was responsible for compiling both lists. Bill has over 10 years of experience in title research in the oil, gas, and energy sectors and has worked in over 120 counties throughout the country. This level of expertise makes us confident that both lists are accurate and up-to-date. CBEP Solar 22, LLC and CBEP Solar 23, LLC then completed internal research to further ensure the validity of these lists. This research was conducted in November and December of 2023 to certify that the collected information was up-to-date. CBEP Solar 22, LLC and CBEP Solar 23, LLC used a deed chain provided by 39North, LLC, the COGIS database, Weld County's Clerk and Recorder online record database, and title commitments for both projects to further identify any possible mineral interest/owner. CBEP Solar 22, LLC and CBEP Solar 23, LLC also used the Colorado Secretary of State's Business Database Search to locate any additional addresses for identified mineral owners/lessees. Given the extensive search, a few additional recipients were included on the mineral notification list for each property. These names/addresses are included in Exhibit B: Final Mineral Notification Lists for each property. The shipping labels and/or USPS Certified Mail receipts are attached in Exhibit D: Mineral Notification Receipts and Labels.
