HomeMy WebLinkAbout20242225.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, AUGUST 21, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 21, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Clerk to the Board, Esther Gesick Interim Controller, Chris D'Ovidio - -' MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of August 7, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. le AMENDMENTS TO AGENDA: There were no amendments to the Agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Freeman seconded the motion and it carried unanimously. • WARRANTS: 1) GENERAL WARRANTS - AUGUST 15, AND 20, 2024: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. ▪ BIDS: 1) PRESENT BID #B2400113, GALETON GRADER SHED BACKUP GENERATOR - FACILITIES DEPARTMENT: Toby Taylor, Purchasing Department, stated three (3) bids were received and staff will make a recommendation on September 4, 2024. • NEW BUSINESS: 1) CONSIDER ACCEPTANCE OF 2024 ABSTRACT OF ASSESSMENT AND ASSESSED VALUATION OF ALL TAXABLE PROPERTY AND MASTER PROTEST LOG - REAL AND PERSONAL PROPERTY: Brenda Dones, Weld County Assessor, presented the 2024 preliminary evaluation of assessment, a q o Minutes, Wednesday, August 21, 2024 Page 1 2024-2225 BC0016 listing of real and personal property protested at the Assessor's level, a listing of accounts that did not report a personal property declaration, and a list of oil and gas drilling rigs valued by Weld County. She explained 2024 is an intervening year, so they only assess certain types of property, and recalled that through the legislative session the 2023 reductions were carried forward, including the typical changes due to new construction, which reflects an aggregate overall decrease in value of 20%. Ms. Dones provided an overview of the number of property tax appeals and non -filing companies, which will be audited for accurate amounts to be included in the final Abstract to be presented in November, which will also be conveyed to the special districts for their budget planning needs. The Board expressed its appreciation for the quality work completed by the Assessor's Office. No public testimony was offered. Commissioner James moved to accept said documents. The motion was seconded by Commissioner Buck and it carried unanimously. • 2) CONSIDER UPDATED LIST OF ARBITRATORS FOR PROPERTY VALUATION APPEALS: Karin McDougal, Deputy County Attorney, stated the list of individuals who are eligible to serve as Arbitrators has been updated for appeals beyond the County Board of Equalization. Commissioner Freeman moved to approve said updated list. The motion was seconded by Commissioner Buck and it carried unanimously. • 3) CONSIDER CONTRACT ID #8578 EXPENDITURE AUTHORIZATION AND WORK PLAN FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) FOR QUALITY JOBS, EQUITY, STRATEGY, AND TRAINING (QUEST) RECOVERY DISLOCATED WORKER GRANT (DWG), AND AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT BOARD TO SIGN: Jamie Ulrich, Director of the Department of Human Services, stated this is an updated budget for the capture of licenses for the workforce readiness system. Commissioner Buck moved to approve said expenditure authorization and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. • 4) CONSIDER CONTRACT ID #8589 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - FREDY ARNULFO DIAZ COREAS AND KENIA GUEVARA-GUERRA: Ms. Ulrich stated the contract is for a new provisional foster care home located in Denver, Colorado. Commissioner Buck moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. ▪ 5) CONSIDER CONTRACT ID #8624 GRANT CLOSEOUT CHECK LIST FOR VARIOUS WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) PROGRAMS, AND AUTHORIZE CHAIR TO SIGN: Ms. Ulrich recommended approval of the annual report of 2023-2024 close-out activities for the Colorado Department of Labor and Employment. Commissioner Freeman moved to approve said grant closeout check list and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. ▪ 6) CONSIDER CONTRACT ID #8626 INTERGOVERNMENTAL AGREEMENT FOR DISABILITY PROGRAM NAVIGATOR AND AUTHORIZE CHAIR TO SIGN: Ms. Ulrich stated this agreement is with the Division of Vocational Rehab, which outlines the responsibilities, expectations and obligations of the Disability Program Navigator initiative. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. Commissioner James seconded the motion and it carried unanimously. Minutes, Wednesday, August 21, 2024 Page 2 2024-2225 BC0016 E 7) CONSIDER MINI -GRANT APPLICATION FOR PREVENTATIVE BLOCK GRANT (PBG) PROGRAM FUNDS FOR NORTHERN COLORADO REGIONAL ASSESSMENT COLLABORATIVE PARTNERSHIP AND AUTHORIZE DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT TO SUBMIT ELECTRONICALLY: Jason Chessher, Director of the Department of Public Health and Environment, requested approval of the grant application, in the amount of $50,000.00, for the term of one (1) year, to complete the project that was initiated last year to assess the feasibility of a regional collaboration, versus each entity doing the work independently and redundantly. He noted there will be no new staff required, and they will continue to use a temporary contractor. Commissioner Buck moved to approve said application and authorize the Department of Public Health and Environment to submit electronically. The motion was seconded by Commissioner Freeman and it carried unanimously. • 8) CONSIDER CORRECTED RESOLUTION RE: SUB -MERCHANT APPLICATION, SIGNATURE AUTHORIZATION FORM, SERVICES AGREEMENT, AND SPECIAL PROVISIONS FOR ACH ADDENDUM, FOR HS GOV TECH HEALTHSPACES SYSTEM, AND AUTHORIZE CHAIR, DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT, AND CONTROLLER TO SIGN - WONDERWARE, INC., DBA CORE BUSINESS TECHNOLOGIES: Mr. Chessher stated this is a request to correct the associated paperwork which will allow the Health Department to accept American Express credit card payments under their new software. Commissioner Freeman moved to approve said corrected resolution and forms, and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. • 9) CONSIDER AIRPORT IMPROVEMENT PROGRAM (AIP) GRANT AGREEMENT FOR REHABILITATION OF WEST APRON (DESIGN AND CONSTRUCTION PHASE I) PROJECT, AND AUTHORIZE CHAIR AND COUNTY ATTORNEY TO SIGN: Cooper Anderson, Greeley -Weld County Airport Director, stated the Federal Aviation Administration (FAA) issued the yearly entitlement grant, in the amount of $150,000.00, for joint projects among the Airport Authority, Weld County, and City of Greeley. He explained this amount will be applied towards the rehabilitation of the main ramp in front of the airport terminal building. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. 10) CONSIDER AIRPORT IMPROVEMENT PROGRAM (AIP) GRANT AGREEMENT FOR REHABILITATION OF MAIN RAMP (CONSTRUCTION PHASE 2) PROJECT, AND AUTHORIZE CHAIR AND COUNTY ATTORNEY TO SIGN: Mr. Anderson stated, similar to the previous item, this grant agreement is for an entitlement of $292,000.00, for the main ramp capital project. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. • 11) CONSIDER SETTLEMENT AND RELEASE AGREEMENT FOR CRS 74 AND 33 ROUNDABOUT PROJECT, AND AUTHORIZE CHAIR TO SIGN - MERCHANTS NATIONAL BONDING, INC., LAWSON CONSTRUCTION COMPANY, AND RLI INSURANCE COMPANY: Bruce Barker, County Attorney, stated this agreement will settle claims against Lawson Construction Company, as well as Merchants National Bonding (funding company). He explained the original contract was terminated due to non-performance and the County hired another firm, as well as staff from the Department of Public Works to correct errors and complete the outstanding work. Mr. Barker stated Weld County paid $1.8 Million, but the terms of the settlement stipulate the County will retain $1.3 Million, plus receive $300,000.00 from Merchants, which is close to the overall $1.6 Million to make the County's expenditure whole. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner James. Chair Ross commended staff for monitoring and tracking the work to get the project done, which resulted in the funding being almost completely restored. There being no further discussion, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
