Staff comments made during this phase of the application process may not be all- inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel: 096110309002 Lot 2 RES21-0008; 09611309001 Lot 1 RES21-00008. The project proposes to: Change of Zone. ACCESS: Weld County Development Review has reviewed the application materials related to access. The parcel has a permitted residential access point onto Cherry Avenue — AP21-00524. No other access is requested. While the draft plat included two residential access points, the application materials specifically state no additional access is requested. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHT-OF-WAY: Cherry Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/Government/Departments/Public-Works/Permits Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4) This site is located in a Municipal Separate Storm Sewer System (MS4) Area which may trigger specific water quality requirements or other drainage improvements. In addition to compliance with applicable Weld County regulations, property owner may be required to be compliant with any additional MS4 requirements. No MS4 requirements are triggered with this Change of Zone. Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-304- 6496. CONDITIONS OF APPROVAL: The plat shall be amended to delineate the following: 1. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Development Review) 3. The historical flow patterns and runoff amounts will be maintained on the site. (Development Review) 4. This site is located in the MS4 area and is subject to the regulations of the state -issued MS4 Permit. (Development Review) 5. Once the permanent control measure has passed final inspection by Public Works, the site shall be routinely inspected at a frequency determined by Public Works, usually on an annual basis unless otherwise noted, for the life of the control measure. Inspections occur to ensure the permanent control measure remains fully operational and is being adequately maintained according to the site's Operation and Maintenance Plan. Upon sale of the property, the responsibility of maintaining permanent control measures shall be transferred to the new owner. Lot 1 currently consists of 1.97 acres and will be served by City of Greeley for water and an on - site wastewater treatment system. An OWTS permit was applied for but has not received final approval and is expired (OWTS, SP -2100345). Lot 2 consists of 1 acre and is currently vacant and will be served by the City of Greeley for water and an OWTS when a residence is constructed. The City of Greeley in a letter dated September 21, 2021, indicated due to the topography connecting to sewer for lots that are adjacent to Cherry Street would not be feasible and OWTS would be acceptable. We recommend the following appear as notes on the resubdivision plat: 1. Water service may be obtained from the City of Greeley. 2. Lots 1 and 2 are currently not served by a municipal sanitary sewer system. Sewage disposal may be by on -site wastewater treatment systems (OWTS) designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. The subject site is located within Greeley's Long Range Expected Growth Area (LREGA), the area in which the community anticipates annexation and urban development to occur in the future. Prior to the contractor beginning construction (excluding grading), all contracts, bonds, insurance, permits (excluding grading permit), and licenses must be fully executed by the Contractor. [Volume I — 1.02(A. 6)] Construction Plans 3) Potable water service curb stops shall be located + one (1) foot from the property line or easement boundary. Potable water service meter pits/vaults shall be located as close as possible beyond the curb stop. See City of Greeley Standard Drawings for additional service and meter installation requirements. [ Volume III — 3.17(B.10)] Water/Sewer 4) Advisory. Water and Sewer standard details are in the process of being updated. Currently, it is acceptable to use either the details from the City of Greeley Design Criteria and Construction Specifications, Volume III (Potable Water Distribution, Sanitary Water Page 1 of 2 Collection, and Non -Potable Irrigation Systems) or updated details that will be used exclusively in the future (a draft form of these details is included with this comment letter). Note that there may be benefits to the development by using the updated criteria. 5) Advisory. Non-residential domestic water services are subject to an annual water allotment based on the dedicated raw water. A surcharge will be applied for consumption over the allotted amount. [Chapter 14.24.100 (b)] 6) All proposed underground infrastructure installed on or after August 8, 2018 must be electronically locatable when installed, per Colorado Revised Statute 9-1.5-103. Include details and specifications that meet this requirement. See City of Greeley standard details NP - 1, W-1, and attached detail for reference. [Volume III, Details] For Stormwater infrastructure requirements, see Section 6.2.6 of the City of Greeley Design Criteria and Construction Specification, Volume II. 7) A notarized "Outside City Water Agreement" is needed before ROW permit can be issued 8) Water Service Agreement is needed concurrent with tap installation Permits (Advisory) 9) A Public Works Right -of -Way Permit will be required for improvements within the public right-of-way or public easements. This form shall be completed by the applicant, signed and sealed by a Professional Engineer currently licensed in the State of Colorado, and accepted by Engineering Development Review concurrent with the issuance of final steps for EDR acceptance of the project. 10) Prior to building construction, a Building Permit will be required from the Building Inspections Department. Final Steps 11) A pre -construction meeting is required.
