The request for permission to install a cattle guard, location described as follows:
16' steel grid cattleguard across County Road 629-A (12-11-15) between NWT of Section 3,
T. 8N., R. 58W. and SWI of Section 31;, T. 9N., R. 58W. 6th P.M. (Nap attached showing
location)
is granted subject to the following conditions and restrictions and agreements:
That you restore the disturbed portions of all of the right-of-way and roadway to its ori-
ginal condition, backfiiling to be well tamped and packed, and the last 12 inches of back -
fill on crossings to be stable granular material, such as crushed rock or gravel, and all
dirt and debris to be removed from all the rights -of -way when work is completed; that all
roadway signs taken down be replaced immediately; that you check and maintain backfill af-
ter all storms and assume full responsibility for any damage it may cause.
That all labor and material will be furnished by you at no expense to Weld County and that
this work will be completed within a reasonable time after construction is started; that
you will protect the traveling public during the installation with ,proper warning signs
and signals, i.e., flares, both day and night; that you assume full responsibility for all
damages resulting from this installation; that in any event any changes are made in these
highways in the future that would necessitate the removal or relocation of this installa-
tion you will so remove or relocate at your own expense upon written request from Weld
County.
That you save Weld County harmless from any and all claims of any nature whatsoever which
may arise by reason of granting permission to construct saL. cattle guard including costs,
if any are incurred, in the defense of any claims made by any person, firm or corporation
by reason of the installation of said cattle guard and the maintenance thereof.
Weld County will not he responsible for any damages caused in the maintenance of the high-
ways to installations placed inside the highway right-of-way.
This understanding and agreement wil.lbe binding upon your respective agents, heirs, exec-
utors, administrators, successors and assigns.
Nothing herein contained shall be construed
to obligate the Forest Service beyond the
extent of available funds allocated or pro-
grammed for this work, or to create or auth-
orize an expenditure or obligation for the
payment of money in excess of or in advance
of appropriations made for such purpose, or
contrary to applicable laws, rules and
regulations.
