RURAL LAND DIVISION FINAL PLAN (RLDF)
QUESTIONNAIRE
Answer the following questions per Section 24-6-30.A.8 of the Weld County Code. Please type on a
separate sheet.
1. Explain the reason for the Rural Land Division request.
- The purpose of the RLD is to allow each existing residence to be located on a separate lot.
Currently, the site addressed as 21588 is under parcel number 096134100051 and the site
addressed as 21842 is under parcel number 096134100050. Both of these parcels are within the
boundaries of the proposed RLD.
2. Explain the reason of the proposed division layout.
- The proposed layout allows each home to be situated adequately within each new lot, meeting
setbacks and generally leaving the site as -is.
3. Describe the existing and proposed uses of the property.
-The properties are being used for residential purposes. The property also contains farm
animals/livestock for personal use. There is no proposed development or changes to land use
on the site.
4. Describe the existing and proposed potable water source.
-Central Weld County Water District provides water to the site and can be referenced on
the key map provided with the Sketch Plat. The site at 21588 contains water tap#577, the site
at 21712 contains water tap#3174 and the site at 21842 contains water tap#3175.
5. Describe the existing and proposed sewage disposal system.
-A Septic system exists on the site and can be referenced with the Septic permits provided with the
Sketch Plat. The site addressed as 21588 is supplied by SP -0800181, the site at 21712 is supplied by
SP -1600033 and the site at 21842 is supplied by SP -1600032.
6. Describe existing and proposed improvements.
-There are no proposed improvements with this application. Existing improvements include a
variety of buildings (barn, shop, shed, office trailer and residential homes) as well as a parking area
and fencing.
7. Describe any existing and proposed easements and rights -of -way.
-Existing easements can be better observed within the plat, these include a joint access easement
and a ditch right of way easement. No additional easements are being proposed.
8. Describe the existing and proposed access to the site.
-There is a singular 60' access ROW proposed and shown within the RLD Plat.
9. Describe the current irrigation practices occurring on the site.
-There is no agricultural irrigation on the property.
10. Describe the
unique physical characteristics of the property,

CRP lands, vegetation, floodplains, geohazard
areas, MS4 and
airport
overlay district.
-The properties fall within the Airport Overlay zone, the Lower Latham Seepage Ditch borders the
southern perimeter of the properties.
11. Detail the location of any on -site oil and gas facilities, irrigation ditches/laterals, pipelines, overhead
lines, railroads, etc. Provide the names and addresses of any owner or operator of any oil and gas
facilities, irrigation ditches/laterals, pipelines, overhead lines, railroads, etc.
-There are no active oil & gas facilities on the site at this time, however there is more detailed
information within the Title Commitment outlining previous Mineral interest owners. The Lower Latham
Seepage Ditch borders the southern perimeter of the properties.

7. Excerpts from the trust document that establish the trust, designate the Trustee, and
set forth the powers of the Trustee will be provided upon request. The powers of the
Trustee include the power to acquire, sell, assign, convey, pledge, encumber, lease,
borrow, manage, and deal with real and personal property interests.
8. The terms of the trust provide that a third party may rely upon this Certification of
Trust as evidence of the existence of the trust and is specifically relieved of any
obligation to inquire into the terms of this trust or the authority of my Trustee, or to
see to the application that my Trustee makes of funds or other property received by
my Trustee.
9. The trust has not been revoked, modified, or amended in any way that would cause
the representations in this Certification of Trust to be incorrect.

The project site is currently located on (2) parcels (096134100051 and 096134100050). The properties lie on the
south side of CR 52 between CR 43 and Cr 45. This project involves creating 3 new parcels for 3 existing residential
structures. No physical changes are planned as far the existing residential structures are concerned. The Weld
County RLD process is requiring a central access road to be placed for the 3 lots, but that is the only change that
may occur to the existing situation.
We are asking for a waiver from a drainage report under section 8-11-40 of the Weld County Code Exception #7.
#7 Residential lots where the following exist:
Nine (9) lots or fewer. (We have 3)
The average lot size is equal to, or greater than, three (3) acres per lot. (Our smallest lot is over 5 acres)
Downstream roadway criteria are not exceeded. (The lot drains south away from CR 52)
The total post -development imperviousness for the rural residential development does not exceed ten percent
(10%), assuming that all internal roads and driveways are paved, or will eventually be paved. (If the development is
required to place a paved internal road that would require approximately 45,000 s.f. of asphalt. This would
increase imperviousness approximately 2% for the entire site. It is our hope that the road, if it has to be placed,
would be gravel and the imperviousness would increase approximately 1%).
