Staff finds that this Use by Special Review is consistent with Section 23-2-220.A.
S ection 23-2-220.A.1. - That the proposal is consistent with Chapter 22 of this Code and any other
applicable code provision or ordinance in effect.
S ection 23-2-220.A.2. - That the proposal is consistent with the intent of the district in which the use is
located.
S ection 23-2-220.A.3. - That the uses which would be permitted will be compatible with the existing
surrounding land uses.
S ection 23-2-220.A.4. - That the USES which would be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the future
development as projected by Chapter 22 of this Code or Master Plans of affected municipalities.
S ection 23-2-220.A.5. - That the application complies with Articles V and Xl of this Chapter if the
proposal is located within an Overlay Zoning District or a Special Flood Hazard Area identified by maps
officially adopted by the County.
S ection 23-2-220.A.6. - That if the use is proposed to be located in the A (Agricultural) Zone District, the
applicant has demonstrated a diligent effort has been made to conserve prime farmland in the locational
decision for the proposed use.
S ection 23-2-220.A.7. - That there is adequate provision for the protection of the health, safety and
welfare of the inhabitants of the neighborhood and the County.

• DRMS Permit M-2023-001 — Received
Approval on April, 2023
• Mining Plan — Area to be mined and reclaimed
(includes areas disturbed that will be re-
seeded) is 84.47 acres. The total USR permit
area is 85.17acres.
• Mining will begin in Phase 1 and move from
east to west. Pit run will be extracted using
dozers, excavators, loaders, haul trucks,
scrapers and be placed on conveyor to be
transferred to the processing facility. Dust
control will include watering with a water truck
on haul roads and stockpiles and/or chemical
stabilizer (magnesium chloride) on haul roads.

Mining will start with mining the Phase 1
surface prior to exposing ground water moving
from west to east. A slurry wall will be
constructed prior to exposing groundwater and
Phase 1 mining will continue from east to west
until mining is completed for the first reclaimed

Reclamation Plan — Reclamation will occur as
mining progresses leaving 3:1 slopes for the
finished reservoirs (same as the mining
slopes). The Phase 1 reservoir is 43.4 surface
acres and approximately 2,500 acre -ft of
storage.

Roadway and Traffic — 8th Street - The gravel mine will utilize
a new access onto 8th Street that we are working with the City
of Greeley (COG) on the placement of the access was agreed
to by coordinating with their staff to be directly across from an
existing access to the south side of 8th Street.
. A traffic study and site distance evaluation have been
completed by STS. The pit traffic will not require any
additional lanes and the site distance is acceptable for the
types of vehicles at the intersection per COG criteria.
Traffic into and out of the pit can be accommodated by the
improvements. The maximum traffic will include 200 semi
trucks (25 ton), 50 tandem dump trucks (16 ton), 20
passenger vehicles, and 5 mechanic/fuel truck/delivery
vehicles per day.
• Haul route will be from the access on to 8th Street going east
or west.
• Scale House is going be located on the interior of the mine.

• 6,000 Gallon Water Truck — Water truck will
water haul roads that are interior to the mine
and stock piles. An employee will be operating
the water truck at all times during business

Groundwater Impacts — Monitor Wells have been
installed along the perimeter of the property and
have been measured to define a baseline for the
existing water table depth surrounding the
property. Groundwater modeling has also been
completed.
The model shows that impacts will not be greater
than an increase of 24 inches near the slurry wall
down to 6 inches on the west and north and side
of the property and a decrease of 12 inches near
the slurry wall down to 6 inches on the south and
east side of the property.
