a. Following ARTICLE IX — Resubdivision, Secs. 24-9-10, 20, 30 this resubdivision complies with the
recorded plat and all codes, covenants and restrictions associated with the subdivision. This
package is completed in accordance all with these codes. I met with the planning department on
Oct 6, 2023 to ensure this is all in accordance with these codes. Vacated easements are in
accordance with these codes. 24-9-10 A.2. This is one lot. A.4. There is an adequate water source.
A.5. There is an on -site wastewater treatment system (OWTS). AM. There are no additional lots
created. Sec. 24-9-30 - Submittal requirements are ready.

DEVELOPMENT REVIEW
QUESTIONNAIRE
This questionnaire is to be submitted with every application when accessing onto a Weld County
maintained road. See the instructions below the questionnaire for how to determine if a road is
maintained by Weld County.
Answer the following questions per Section 8-14-10 and Appendix 8-Q of the Weld County Code if
accessing onto a County maintained road. Please respond in a separate document. If a question does not
pertain to your proposal, please respond with an explanation — do not leave items blank.
1. Describe the access location and applicable use types (i.e., agricultural, residential,
commercial/industrial, and/or oil and gas) of all existing and proposed accesses to the parcel.
Include the approximate distance each access is (or will be if proposed) from an intersecting county
road. State that no existing access is present or that no new access is proposed, if applicable.
2. Describe any anticipated change(s) to an existing access, if applicable.
3. Describe in detail any existing or proposed access gate including its location.
4. Describe the location of all existing accesses on adjacent parcels and on parcels located on the
opposite side of the road. Include the approximate distance each access is from an intersecting
county road.
5. Describe any difficulties seeing oncoming traffic from an existing access and any anticipated
difficulties seeing oncoming traffic from a proposed access.
6. Describe any horizontal curve (using terms like mild curve, sharp curve, reverse curve, etc.) in the
vicinity of an existing or proposed access.
7. Describe the topography (using terms like flat, slight hills, steep hills, etc.) of the road in the vicinity
of an existing or proposed access.
Development Review Questionnaire:
1. The property has two accesses which are residential (see pic below). The West access will be moved
further to the West. The East access is 40 feet from being across 5th street (see pic below).
2. The West driveway will be moved approximately 60 feet to the west just past the current shop.
a. The existing West driveway will be removed as the new West driveway is set (same dirt).
b. Red (original location). Blue (new Location). Yellow (location of new house).
3. No gates will be added.
4. Three residential accesses are across the street, all within 120' from 5th street (see picture below).
5. No difficulties seeing traffic from any of the above locations (see pic below).
6. Mild curve is outside the property lines approximately 1/4 mile to the West (see pic below).
7. The Land is flat, no hills or such (see pic below).
Drainage Narrative:
1. Any existing and proposed improvements to the property.
a. Existing: House, shed, garage, shop, greenhouse
b. Proposed: New house and barn.
i. Repurpose shed.
ii. Temporarily repurpose old house until demo (approximately one year).
iii. Immediately tear down the garage and greenhouse.
2. The exemption being considered for consideration.
a. Citing: Exemption 3. A second dwelling permit in the A zone district.
3. Where the water originates as it flows onto the property.
a. The land is fiat all around and throughout the town. I suppose water runs off Stevenson Ave at
times as it is higher.
4. Where the water flows as it leaves the property.
a. The north end of the property drops down to plat R, owned by Arvid DePorter.
5. The direction of flow across the property.
a. If it were to ever flow (hasn't in the 70 years the family has owned it), I suppose water would flow
from Stevenson Ave on the south, to the drop off on the north.
6. Previous drainage problems with the property, if any.
a. No drainage problems in 70 years.
7. The location of any irrigation facilities adjacent to the development.
a. No irrigation facilities adjacent to the development.
8. Any additional information pertinent to the development.
a. No additional information pertinent to the development.
Traffic Narrative:
1. Once the new home construction is complete, two (2) 5 passenger car roundtrips/day.
2. In and out one of the driveways is the routes these two (2) vehicles wilt use.
3. 50% each driveway access.
4. 0600 hours is the highest traffic.
Aside from the easements to be vacated (the reason for this re -subdivision), there are no covenants, grants of
easements or restrictions imposed on the land and/or structures within the redistribution.

RESUBDIVISION (RES)
STANDARDS CERTIFICATION
Per Section 24-9-20 of the Weld County Code, all the foregoing standards shall be met to apply for a
Resubdivision. Please read and initial each item.

A Resubdivision is permitted within any Zone District included in Chapter 23, Article Ill, Division
1 of the Weld County Code, as amended.
The Resubdivision process shall not be utilized to create more than two (2) additional buildable
lots.
The minimum parcel size of any Resubdivision Lot shall be determined by the underlying zone
district or Historic Townsite requirements per Chapter 23, Articles Ill and V of the Weld County
Code, as amended.
Resubdivision lots shall be served by an adequate water source.
Resubdivision lots shall be served by an on -site wastewater treatment system (OWTS).
Parcels created by a Resubdivision are not eligible for another Resubdivision which creates
additional lots.
A Resubdivision that result in additional lots with additional uses will required a drainage report
and detention pond design unless they qualify for an exemption to stormwater detention as
defined in Section 8-11-40.1 of the Weld County Code, as amended
