HomeMy WebLinkAbout20240644.tiffHEARING CERTIFICATION DOCKET NO. 2024-25 RE: PETITION FOR VACATION OF A PORTION OF COUNTY ROAD 78 BETWEEN UNION PACIFIC RAILROAD RIGHT-OF-WAY AND COUNTY ROAD 37 - WELD COUNTY DEPARTMENT OF PUBLIC WORKS A public hearing was conducted on May 13, 2024, at 9:00 a.m., with the following present: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Department of Public Works representative, Curtis Hall The following business was transacted: • I hereby certify that pursuant to a notice dated May 2, 2024, a public hearing was conducted to consider the request of the Weld County Department of Public Works, for a Petition for Vacation of Right -of -Way for County Road 78, being 1,267 feet in length, more or less, between Union Pacific Railroad right-of-way (adjacent to U.S. Highway 85) and County Road 37. Bruce Barker, County Attorney, made this a matter of record. ▪ Curtis Hall, Director of the Department of Public Works, presented a brief summary of the petitioner's request. Mr. Hall entered the favorable recommendation of the department into the record, in conjunction with the surrounding landowner, based on the previous and adjacent vacation of County Road (CR) 78 right-of-way between U.S. Highway (HWY) 85 and the Union Pacific Railroad (UPRR). He stated the right-of-way is 60 feet in width, it is not located within municipality limits or another County's boundaries, no accesses are impacted, the right-of-way is currently maintained by Weld County, it is a local road, and he reviewed the existing utilities, which are not affected by the vacation. Mr. Hall stated the last vehicle count on the roadway prior to the UPRR closure was 40 vehicles per day. • In response to Chair Ross, Mr. Hall reviewed the property owners adjacent to the portion of CR 78 right-of-way being discussed and their access. ▪ No public testimony was offered concerning this matter. • Commissioner Freeman moved to accept the petition and authorize the Vacation of a Portion of County Road 78 between Union Pacific Railroad Right -of -Way and County Road 37, based on the recommendation of the Department of Public Works. There being no further discussion, the hearing was completed at 9:51 a.m. This Certification was approved on the 3rd day of June, 2024.
