Re: Notice of 60 Days' Comment Period Regarding the Hudson Fire Protection District Board of
Directors' Intent to Establish and Assess Impact Fees
Commissioner Ross and Ms. Koppes,
During the 2024 Legislative Session, the Colorado Legislature enacted, and Governor Polis signed
into law, Senate Bill 24-194. Among other things, the new law authorizes the Hudson Fire
Protection District to establish and assess impact fees on new development within the Fire
District's jurisdiction, which includes unincorporated portions of Weld County. The new law
requires the Fire District to give the Weld County Clerk and Recorder notice that the County has
60 days to comment on the Fire District Board of Directors' intent to establish and assess impact
fees. This letter constitutes the statutory notice that the County has through December 9, 2024 to
submit comments on the Fire District Board's intent to establish and assess impact fees. A copy of
the Impact Fee Schedule the Fire District Board intends to adopt is enclosed. The Impact Fee
Schedule will take effect on January 1, 2025 for the area within the County that is within the Fire
District's jurisdictional boundaries.
The new law requires the County to notify the Fire District whenever the County issues a building
permit for the construction of new buildings, structures, facilities, or improvements, including oil
or gas wells and related equipment, on previously improved or on unimproved real property within
the Fire District's jurisdictional boundaries. In order to make this process as efficient and
streamlined as possible, I would like to meet with the County to discuss how applicants for a
building permit will be notified of the Fire District's Impact Fee and the process by which the
County will notify the Fire District that a building permit has been issued.
Sincerely,
Randon Grimes, Fire Marshal/Division Chief
