The Colorado Liquor Code has undergone several legislative updates, including the creation of
new requirements, license, and permit types. Therefore, the Weld County Code must be updated
accordingly. Staff also has administrative updates to recommend to allow procedure and the Weld
County Code to merge.
Options for the board:
Review the proposed Ordinance language and approve or deny.
Determine the fee amounts for the new permit types to be considered through the County -wide
annual fee Ordinance.
Recommendation to the board:
Approve the language contained in Weld County Code Ordinance #2024-13 and instruct the Clerk
to the Board's Office to schedule First Reading.

The Weld County Clerk to the Board's Office, in conjunction with the County Attorney's
Office, is requesting the Weld County Board of Commissioners review and consider Weld
County Code Ordinance #2024-13, Chapter 12 Licenses and Permits, and
Ordinance #2024-15, Revenue and Finance, to update provisions for Liquor Licensing
and Dance Hall Licensing. Both draft Ordinances are attached for your review.
Public Hearings are scheduled to be held in the Chambers of the Board, located within
the Weld County Administration Building, 1150 O Street, Greeley, Colorado 80631, for
First Reading on Monday, November 4, 2024, Second Reading on Monday,
November 18, 2024, and Third/Final Reading on Monday, December 2, 2024, all at
9:00 a.m. All persons in any manner interested in the readings of said Ordinances are
welcome to attend and may be heard. Written comments can also be added to the file by
emailing said comments to cwhite(�weld.gov.
Summary of Proposed Changes:
1. Amend Chapter 12, Article II, Liquor Licenses and Permits, Fermented Malt
Beverage Licenses, and Fermented Malt Beverage and Wine Licenses:
a. Administrative fixes to match historical staff procedures.
b. The Colorado Liquor Enforcement Division (LED) has established biennial
renewals and Weld County is proposing to likewise allow for biennial
renewal, so applicants can apply to renew their license every other year
instead of every year. However, LED doesn't currently have the ability to
accept fees every other year, so they are still requiring licensees pay their
renewal fees every year. Basically, this just means the licensee doesn't

have to submit their renewal paperwork every year if they apply and are
approved for biennial renewal.
c. Under the 'Refusal to Renew' section, additional clarifying language to
reference licensees are required to adhere to the Weld County Code
(already required).
d. Permits: The permit types are established by LED, but the Local Licensing
Authority (Weld County) can also adopt provisions for these permit types.
i. Special Event Permit: no changes proposed.
ii. Festival Permit: proposed adoption of permit type by Local Licensing
Authority.
iii. Retail Establishment Permit: proposed adoption of permit type by
Local Licensing Authority.
iv. Bed and Breakfast Permit: proposed adoption of permit type by Local
Licensing Authority.
v. Takeout and Delivery Permit: proposed adoption of permit type by
Local Licensing Authority.
vi. Caterer's License Temporary Permit: proposed adoption of permit
type by Local Licensing Authority.
e. Addition of language to reflect procedures concerning the Criminal Justice
Information Services (CJIS) Security Operations Guide.
2. Amend Chapter 12, Article VI, Public Dance Hall, Booth, Pavilion or Other Place
Where Public Dances are Held:
a. Administrative fixes to match historical staff procedures.
i. Notice is published in the bid -awarded newspaper, not posted at the
property via a notice sign.

inspection and report findings to the Weld County Board of
Commissioners.

Summary of Proposed Changes:
1. Amend Chapter 12, Article II, Liquor Licenses and Permits, Fermented Malt
Beverage Licenses, and Fermented Malt Beverage and Wine Licenses:
a. Administrative fixes to match historical staff procedures.
b. The Colorado Liquor Enforcement Division (LED) has established biennial
renewals and Weld County is proposing to likewise allow for biennial
renewal, so applicants can apply to renew their license every other year
instead of every year. However, LED doesn't currently have the ability to
accept fees every other year, so they are still requiring licensees pay their
renewal fees every year. Basically, this just means the licensee doesn't

have to submit their renewal paperwork every year if they apply and are
approved for biennial renewal.
c. Under the 'Refusal to Renew' section, additional clarifying language to
reference licensees are required to adhere to the Weld County Code

The Weld County Clerk to the Board's Office, in conjunction with the County Attorney's
Office, is requesting the Weld County Board of Commissioners review and consider Weld
County Code Ordinance #2024-13, Chapter 12 Licenses and Permits, and
Ordinance #2024-15, Revenue and Finance, to update provisions for Liquor Licensing
and Dance Hall Licensing. Both draft Ordinances are attached for your review.
Public Hearings are scheduled to be held in the Chambers of the Board, located within
the Weld County Administration Building, 1150 O Street, Greeley, Colorado 80631, for
First Reading on Monday, November 4, 2024, Second Reading on Monday,
November 18, 2024, and Third/Final Reading on Monday, December 2, 2024, all at
9:00 a.m. All persons in any manner interested in the readings of said Ordinances are
welcome to attend and may be heard. Written comments can also be added to the file by
emailing said comments to cwhite@weld.gov.
Summary of Proposed Changes:
1. Amend Chapter 12, Article II, Liquor Licenses and Permits, Fermented Malt
Beverage Licenses, and Fermented Malt Beverage and Wine Licenses:
a. Administrative fixes to match historical staff procedures.
b. The Colorado Liquor Enforcement Division (LED) has established biennial
renewals and Weld County is proposing to likewise allow for biennial
renewal, so applicants can apply to renew their license every other year
instead of every year. However, LED doesn't currently have the ability to
accept fees every other year, so they are still requiring licensees pay their
renewal fees every year. Basically, this just means the licensee doesn't

have to submit their renewal paperwork every year if they apply and are
approved for biennial renewal.
c. Under the `Refusal to Renew' section, additional clarifying language to
reference licensees are required to adhere to the Weld County Code
(already required).
d. Permits: The permit types are established by LED, but the Local Licensing
Authority (Weld County) can also adopt provisions for these permit types.
i. Special Event Permit: no changes proposed.
ii. Festival Permit: proposed adoption of permit type by Local Licensing
Authority.
iii. Retail Establishment Permit: proposed adoption of permit type by
Local Licensing Authority.
iv. Bed and Breakfast Permit: proposed adoption of permit type by Local
Licensing Authority.
v. Takeout and Delivery Permit: proposed adoption of permit type by
Local Licensing Authority.
vi. Caterer's License Temporary Permit: proposed adoption of permit
type by Local Licensing Authority.
