HomeMy WebLinkAbout20241490.tiffRESOLUTION RE: APPROVE LIMITED EVENT PERMIT, LEP24-0002 - DANIEL AND GLORIA TIMMONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Daniel and Gloria Timmons, 3448 County Road 4, Erie, Colorado 80516, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Limited Event Permit on land within the unincorporated portion of the County of Weld, State of Colorado, to be held on July 13, 2024, from 6:00 p.m. until 10:00 p.m., outside the corporate limits of any town or city in the County of Weld at the location described as follows: Allegiance Ranch and Equine Rescue, Inc., 3448 County Road 4, Erie, Colorado 80516; being further described as Lot 4, Block 2 of Ranch Eggs, Inc., Subdivision, Filing #2; being part of Section 34, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the fee for the filing of said Limited Event Permit has been waived due to the applicant concurrently applying for a Special Event Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter, and having been fully informed, finds the following to support the issuance of the Limited Event Permit requested: 1. The submitted materials are in compliance with the application requirements of Chapter 23, Article IV, Division 18, of the Weld County Code. 2. The applicant has demonstrated that the request is in conformance with Section 23-18-80 of the Weld County Code as follows: A. The applicant has demonstrated that the limited event is compatible with existing and allowed land uses in the neighborhood; B. The applicant has demonstrated that the limited event will comply with all applicable requirements of the Weld County Code; C. The applicant has demonstrated that the limited event will result in no substantial adverse impact to other land uses and/or residences in the neighborhood, including environmentally sensitive areas or features or other lands; D. The applicant has demonstrated that the limited event has addressed the recommendations of the referral entities, and cc. APP L , PLCtY)w/Mt71 ER), CAC C ic) O-7rt5194 2024-1490 PL2891 LC0022 LIMITED EVENT PERMIT, LEP24-0002 - DANIEL AND GLORIA TIMMONS PAGE 2 WHEREAS, the issuance of said Limited Event Permit is subject to compliance with the Performance Standards, Inspection, and Enforcement requirements set forth below, with the terms and conditions set forth in the application materials, and upon the express condition and agreement that the event will be conducted in strict conformity to all laws of the State of Colorado and the Weld County Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Daniel and Gloria Timmons for a Limited Event Permit, LEP24-0002, to be held on July 13, 2024, from 6:00 p.m. until 10:00 p.m., on the parcel of land described above, be, and hereby is, granted subject to the following conditions: 1. The Limited Event Permit shall adhere to the following Performance Standards: A. An adequate and safe supply of potable water meeting requirements set forth by the Colorado Department of Public Health and Environment. B. Toilets conveniently located throughout the property, sufficient to provide healthful facilities for the maximum number of people in attendance, and meeting all state and local specifications, as determined by the Weld County Department of Public Health and Environment. C. A sanitary method of disposing of solid or liquid waste, in compliance with state and local laws and regulations, sufficient to dispose of the waste production of the maximum number of persons allowed to attend the limited event. The applicant shall comply with its plan for holding and collecting such waste at least once each day of the event. The plan shall provide for trash cans, dispersed throughout the property, sufficient to prevent solid wastes from escaping the property. The plan must call for sufficient personnel to perform such tasks and collecting any wastes that do escape, and within 48 hours of cessation of the limited event, the property shall be returned to its previous condition, including removal of all buildings and structures, trash, debris, signage, attention -attracting devices, or other evidence of the limited event. D. Two (2) certified emergency medical technicians and one (1) emergency ambulance for limited events with more than 500 persons. One additional certified medical technician provided for every additional 500 persons. An enclosed structure where treatment may be rendered. E. A licensed practical nurse or registered nurse, licensed to practice in the state, provided for limited events with more than 1,000 persons. One (1) additional nurse provided for every additional 1,000 persons. F. If the limited event is to occur during hours of darkness, illumination sufficient to light parking and pedestrian areas shall be provided at the rate of at least five (5) foot candles. No limited event shall extend past 12:00 a.m. H. No overnight camping is allowed either before or after the limited event. I. There shall be a parking area, either on -site or off -site, sufficient to provide parking space for the maximum number of persons allowed at any limited time to attend the limited event. At least one (1) parking space measuring at least nine (9) feet in width shall be provided for every four (4) attendees. If any parking is to be provided off -site, authorization from the property owner shall be required. The applicant shall provide a description of the surface material of the parking areas. J. There shall be a traffic circulation system sufficient to allow safe and efficient traffic and pedestrian circulation for the maximum number of attendees allowed at any limited time. The flow of traffic on roads shall not be blocked or hindered, and no cars, buses, or bicycles shall be allowed to park along the side of or in any public road right-of-way. The applicant shall provide a plan for handling traffic in conformance with the Manual on Uniform Traffic Control Devices and the Colorado Supplement. K. Access to and from the property shall be limited to access approved pursuant to provisions of Chapter 8 of the Weld County Code. Where an existing access shared with other property owners or lessees is to be used, authorization of each of the owners or lessees entitled to use the access shall be required. L. The applicant must provide adequate facilities for communication with emergency medical, police, and fire services. M. The applicant must provide security which, as determined by the Sheriff's Office, is adequate to control any disturbances which might occur at the limited event. N. The applicant shall comply with all requirements of the applicable fire protection district. O. The applicant shall ensure that sounds from the limited event do not exceed the residential noise limits or carry unreasonably beyond the boundaries of the property. Sound created by the limited event which exceeds any limitations set by the Weld County Noise Ordinance (Chapter 14, Article IX, of the Weld County Code) shall be presumed to be unreasonable. P. The applicant must provide for appropriate on -site dust mitigation. Q. Guarantees in the form of an irrevocable letter of credit, bond, or cash retainer in the amount of $3,000.00 may be required to cover the cost of any required clean-up and restoration following the limited event where the maximum number of attendees is more than 250, or $500.00 for any event where the maximum number of attendees is more than 100, but less than 250. Any letter of credit or bond must be irrevocable for a period of 30 days after the completion of the event. The letter of credit, bond, or cash retainer will be released by the County as soon as possible after the event, after determination that the site has been adequately cleaned up and restored from any impacts of the event, but no later than 30 days following the event. S. Insurance in an amount determined to be adequate and reasonable in light of the risks and hazards relating to the limited event, but no less than $500,000.00. Such Certificate of Insurance shall include the County of Weld, by and through its Board of County Commissioners, its elected officials, and employees, as Additional Named Insureds. T Limited events must occur or operate in compliance with the provisions of Section 23-18-90 of the Weld County Code, and all applicable provisions and regulations of Weld County, and applicable state and federal statutes and regulations. U. If electrical systems are not self-supporting, electrical systems installation and maintenance must comply with minimum county and state electrical standards. V. The issuance of a Limited Event Permit shall not relieve the landowner or applicant of the responsibility for securing other permits or approvals required by Weld County, the applicable fire district, or other applicable public agency. W. Any other condition deemed necessary by the Board of County Commissioners to preserve the health, safety, and welfare of the public and surrounding properties, residences, and other neighboring land uses. 2. Inspection: pursuant to Section 23-18-100 of the Weld County Code, the employees of the Weld County Sheriff's Office, the Planning Department, and/or Health Department may enter the property from time -to -time during the limited event to inspect and ensure compliance with the Limited Event Permit Performance Standards and to enforce the provisions of Section 23-18-90 of the Weld County Code. Enforcement: A. Pursuant to Section 23-18-110.A of the Weld County Code, a Limited Event Permit may be suspended or revoked by the Board of County Commissioners at any time if any of the Performance Standards required of the permit are not complied with, or for violation of any provision of Section 23-18-90 of the Weld County Code, or any other applicable law, rule, or regulation, for violation of the specific permit conditions, or for any misrepresentation by the applicant, his or her agents or employees, or independent contractors under contract with the applicant. Upon revocation, the guarantee may also be forfeited. By signing the application, the applicant agrees that employees of the Sheriff's Office, the Planning Department, and/or Health Department may enter the property and cause the limited event to be stopped upon suspension or revocation of the Limited Event Permit. B. Pursuant to Section 23-18-110.6 of the Weld County Code, violations of Section 23-18-90 of the Weld County Code will be enforced by the Weld County Sheriff and/or through the enforcement procedures set forth in Article X of Chapter 23 of the Weld County Code. BE IT FURTHER RESOLVED by the Board that any violation to said terms and conditions shall be cause for revocation of said permit and forfeiture of the required guarantee. The name of the event is Heroes and Horses Hoedown, this will be benefitting Allegiance Ranch and Equine Rescue, a 501 (c)3 nonprofit organization. The event will have up to two hundred and fifty (250) guests. The applicant has also applied for a special event permit for liquor use through Clerk to the Board and is currently going through the approval process. The event is proposed for a single day being July 13, 2024, from 6 p.m. — 10 p.m. The applicant has volunteers that will be CPR certified and there will be fire extinguishers and first aid kits on site. These volunteers will also handle security. United Site Services is contracted to provide port -o -lets and a handwashing station. All other waste, that is not recyclable, will be disposed of in the applicant's weekly garbage pickup or disposed at the Front Range Landfill in Erie. Recyclable waste will be picked up by the residential service. Catering will be provided by Word -of -Mouth Catering in which the caterer provides staff to manage the buffet and ensures proper refrigeration and heat for the food being served. Alcohol will also be provided at the event. The Weld County Department of Planning Services sent notice to seven (7) referral agencies, five (5) of seven (7) referral agencies had either no concerns or did not return a referral. Two (2) referral agencies had comments. The Weld County Department of Planning Services also sent notice to five (5) surrounding property owners. No correspondence was received regarding the proposed event. Department of planning services' staff recommends that this request be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Chapter 23, Article IV, Division 18, of the Weld County Code. 2. The applicant has demonstrated that the request is in conformance with Section 23-18-80 of the Weld County Code as follows: A. The applicant has demonstrated that the limited event is compatible with existing and allowed land uses in the neighborhood. B. The applicant has demonstrated that the limited event will comply with all applicable requirements of the Weld County Code. C. The Heroes and Horses Hoedown is a fundraising event benefiting Allegiance Ranch and Equine Rescue, a 501(c)3 nonprofit organization. The event is hosted on the back of the property in the open pasture (grass) area. The event is managed by the property owner with the assistance of an event planner hired by the nonprofit. 3. Otherwise, Mountain View Fire would be called via 911. 11. There will be 2-3 individuals (volunteers) assigned to security who are responsible for patrolling the property and the event. One individual stationed at the sole entrance to the event space monitoring coming and going. The other individuals will patrol the event area, parking area, and perimeters of the property. The security team will rotate as needed. 12. Erik Branine with MJX Denver serves as the emcee of the event. He brings sound equipment, speakers, and a microphone to make announcements throughout the evening. The equipment is located in the event area. 13. In the event of an emergency requiring evacuation from the property, the Emcee will announce two exits from the event area. There is an exit from the property (via gate) to the neighboring property and access to a large indoor arena (in the event of inclement weather). The other exit is to the front of the property with access to the parking area (cars). We'll conduct a pre -briefing with the security team and volunteers to prepare for unexpected occurrences. 14. Overflow parking is available in our arena (dirt/sand) and at a property near CR 7 and CR 4, which belongs to Rocky Mountain Rabbit Rescue. The complete application including proof of insurance and financial gusraitee (if attendance will be more than 100 people) must be submitted to the Weld County Planning Department at least 30 days prior to the event. Submitting earlier is encouraged. In some circumstances, the Board of County Commissioners (BOCC) may continue the hearing to a later date. If you need other permits, such as building permits, additional time may be required in order to ensure inspections are complete prior to the event. A Limited Event Permit may be for up to three consecutive days. No more than one event is allowed on a property in a single month. No more than four events are allowed on a property in a single year.
