DEPARTMENT: DATE: 11/20/2024 PERSON REQUESTING: Brief description of the problem/issue: Due to confusion on the part of staff following a worksession, changes to Appendix 5-N, County -wide Road, Facilities, and Drainage Impact Fee Schedules, were inadvertently omitted from Ordinance 2024-14 and the oversight was not noticed until after second reading. On October 16, 2024, the Board of County Commissioners held a worksession with staff regarding the annual review of fees found in the appendices of Chapter 5. It was determined that certain fees charged by the Department of Planning Services should remain unchanged, pending a fee study to be performed next year. This fee study pertains to fees found in Appendix 5-J, Planning Fee Schedule, and 5-K, Building Permit and Inspection Fee Schedule. The study will not cover the impact fees in Appendix 5-N, which were the subject of an independent study in 2021. At that time, the Board decided to implement the road impact fee increases over a period of six years. Please see attached the table. The table does not cover facilities or drainage impact fees. Section 20-1-60 of the Weld County Code states the impact fees shall be adjusted annually for inflation on or before June 30th each year, which has not occurred in 2024. The facilities impact fees would increase by 1.9% based on an August 14, 2024, press release from the United States Bureau of Labor Statistics Consumer Price Index for the Denver -Aurora -Lakewood area, which is the only index on the Front Range. Staff is not proposing any increase in the drainage impact fee, which is currently 21 cents ($0.21) per square foot of impervious cover added, because adding another penny to the fee would be an increase of 4.76% and the fee was increased last year. What options exist for the Board? 1. Have staff present the attached changes to Appendix 5-N on third reading of Ordinance 2024-14 on December 2, 2024, for the Board's consideration. If there is a motion and second to amend the ordinance, the Board would vote whether to include the changes prior to voting on the ordinance as a whole. 2. Direct staff to schedule a worksession. Consequences: Ideally, the changes to the impact fees would take effect on January 1, 2025, along with the other changes in Ordinance 2024-14. If the changes to Appendix 5-N are not included in the ordinance, they would likely need to be implemented by a separate ordinance and take effect later. Impacts: Leaving the impact fees unchanged would mean less money available for road and facilities projects. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): Including the changes on third reading would not cost the County. Before you take too much time creating the separate readings, we are presenting everything to the board on the 16th in the afternoon. Let's have a more in depth conversation about the liquor fees, Public Trustee and the Planning fees, and see how the board would like to have them presented? Attached are the responses I got. One small change from the SO. The Public Trustee isn't in there currently, so we would add them, if the board wants. Planning really has the only other changes. Also, Carly will have changes to her fees, but she is re -writing the bill so it won't be effective until July, and she's not sure what will change and what remains. So I was going to tell them that she will be requesting a midyear reading of the code changes when that is resolved. Regarding the Proposed Budget — I will have the 2025 Proposed Budget online to be available for public comment during the readings. I hope to have that done by Friday. We posted the FML on the bulletin board, so that's handled. I need to create the LEA and E-911 notices.
