FOR RURAL LAND DIVISION FINAL PLAN, RLDF21-0002 - RICHARD AND

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on February 9, 2022, the Weld County Board of Commissioners approved
the application of Richard and Patricia Stahl, 16087 County Road 40, LaSalle, Colorado 80645,
for a Rural Land Division Final Plan, RLDF21-0002, for the Creation of Two (2) Lots in the
A (Agricultural) Zone District, on the following described real estate, being more particularly
described as follows:
Lot A of Recorded Exemption, RE -1748; being part
of the SW1/4 of Section 26, Township 4 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, on April 18, 2022, the Board approved an Improvements and Road
Maintenance Agreement According to Policy Regarding Collateral for Improvements between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and Richard and Patricia Stahl, with further terms and conditions being as stated in
said agreement, and
WHEREAS, additionally on April 18, 2022, the Board accepted project collateral in the
form of personal check #9417, dated March 29, 2022, issued by JPMorgan Chase Bank, N.A., in
the amount of $7,500.00, and
WHEREAS, on June 6, 2022, the Board approved the request of Richard and
Patricia Stahl to release 85% of the project collateral for RLDF21-0002, in the amount of
$6,375.00, and retain warranty collateral in the amount of $1,125.00 for the duration of the
warranty period, and
WHEREAS, on June 24, 2024, the Department of Planning Services received a request
from Richard and Patricia Stahl to release the warranty collateral for the two (2) year warranty
period that ended on June 6, 2024, and
WHEREAS, upon recommendation of staff from the Weld County Departments of Public
Works and Planning Services that conducted a final site inspection, the Board deems it advisable
to release said warranty collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the currently held warranty collateral, in the amount of $1,125.00, procured
in the form of personal check #9417, dated March 29, 2022, issued by JPMorgan Chase Bank,
N.A., be, and hereby is, cancelled and released.

Brief description of the problem/issue:
The Department of Planning Services received a request from Pat Stahl, requesting that the Board of County Commissioners release the
currently held warranty collateral for Richard and Patricia Stahl in the amount of $1,125.00. No further collateral is required to be held.
The two-year warranty period concluded on June 6, 2024. Public Works completed a final warranty inspection and supports the release
of warranty collateral.
Weld County Planning Services and Public Works Departments performed a site inspection, at the above -mentioned site, and observed
the following:
• All items on of the Improvements Agreement According to Policy Regarding Collateral for Improvements Document Tyler
#2022-1107, have been completed and are found to be acceptable.

Thank you for your prompt attention to this matter. I will have the inspector go out again.
As for your question, the County maintains the road surface of the width of the road. If the dirt washes
out from your berm, it would be your responsibility to add more but if there is an issue with the dirt
washing out, a more permanent solution may be best. In most cases where an access needs to be
reclaimed, large objects such as boulders or posts are used to create a barrier or a fence.
In theory, your use of logs was the right idea but there is just the issue of the logs being out of sight. The
small berm created may also still be low visibility from a vehicle, but I will let the inspector make that
call when he is out there.

release said project collateral, in the amount of $6,375.00, and retain warranty collateral in the
amount of $1,125.00 for the duration of the warranty period.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the project collateral in the amount of $6,375.00, be, and hereby is,
released and that the retention of warranty collateral in the amount of $1,125.00, be, and hereby

Busman Excavating has Installed a 120' Tong x 18' driveway with a 1' drainage shoulder on each side at
19050 CR 33. We first cut in the road and borrow ditches, then wheel roll compacted the subbase. We
then brought In 3 semi loads of Class 6 aggregate base, placed and compacted to approximately 6" thick
