RE: DECLARE CERTAIN EQUIPMENT AS SURPLUS PROPERTY, AUTHORIZE SALE OF
SAME TO TOWN OF LOCHBUIE, AND DELEGATE AUTHORITY TO CONTROLLER
TO SIGN ANY NECESSARY DOCUMENTS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Code require that all items disposed of be
declared surplus by the Board of County Commissioners, and
WHEREAS, the County has determined that certain equipment, described as a 2013 John
Deere Motor Grader, VIN No. 1DW772GPLCE650445, being more fully described in said
proposal which is attached hereto and incorporated herein by reference, is no longer required for
County use, and
WHEREAS, the Board has been presented with a bid proposal from the Town of Lochbuie,
703 County Road 37, Lochbuie, Colorado 80603, for the purchase of said equipment, for the sum
of $70,000.00, and
WHEREAS, the Board deems it advisable to declare said equipment as surplus, approve
said bid proposal, and delegate authority to the Weld County Controller to sign any necessary
documents.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned equipment be, and hereby is, declared surplus.
BE IT FURTHER RESOLVED by the Board that the bid proposal for purchase of said
equipment from the Town of Lochbuie in the amount of $70,000.00, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the authority to sign any necessary
transfer documents, be, and hereby is, delegated to the Weld County Controller to sign as the
Agent for the Weld County Board of Commissioners, Weld County, Colorado.

Brief description of the problem/issue:
The Town of Lochbuie has proposed the purchase of one Motor Grader (15820168) that is at end of life with
Weld County. See attached offer letter.
What options exist for the Board?
Consequences:
The sale of this Motor grader at the proposed price would assist The Town of Lochbuie in
replacement of their current machine.
Impacts:
Weld County would forego sending this unit to auction.
Costs (Current Fiscal Year/Ongoing or Subsequent Fiscal Years):
This deal would be at zero cost to Weld County.
Recommendation:
Fleet Services recommends the sale of Motor Grader (15820168) to the Town of Lochbuie at the proposed price
of $70,000.

Honorable Board of County Commissioners,
I have been honored to serve local communities within Weld County for over 20 years. During
my career, I have worked closely with the county on many projects and during emergencies like
the floods of 2013. I have always viewed Weld County as a great partner for local agencies.
The Town of Lochbuie needs a motor grader to maintain our miles of unpaved roads. Our current
motor grader is a 1986 Dresser model. This unit experienced a catastrophic drivetrain failure and
is inoperable. Due to the age and obscurity of this machine, parts are not available to repair this
unit. The Weld County Department of Public Works has been gracious and has helped us
maintain our roads while we search for a suitable replacement machine.
The Town has limited resources and is not able to afford a new machine at this time. Town and
County staff have worked together and identified a motor grader that will be retired from service
in Weld County as a suitable replacement for the Town. Weld County unit number 15820168
will be an excellent machine for the Town. The Town would like to offer $70,000.00 to purchase
this unit.

KNOW ALL MEN BY THESE PRESENTS, that the COUNTY OF WELD, a body
politic and corporate of the STATE OF COLORADO, of the first part, for and inconsideration
of the sum of Seventy Thousand and no/ISO Dollars ($70,000.00), in hand paid by Town of
Lochbuie, of the second part, the receipt whereof is hereby acknowledged, has bargained and
sold, and by these presents does grant and convey, unto the said party of the second part, its
executors, administrators, successors or assigns, the following property, goods and chattels, to
wit:
One 2013 John Deere motor Grader, VIN #1 DW772GPLCE650445. The party of the
second part accepts the 2013 John Deere motor Grader in an "as is - where is" condition, without
warranty, including the absence of warranty of fitness or marketability.
TO HAVE AND TO HOLD the same unto the said party of the second part, its
executors, administrators, successors or assigns, forever.
IN WITNESS WHEREOF, THE PARTY OF THE FIRST PART has hereunto set its
