Staff comments made during this phase of the application process may not be all-inclusive as other issues may arise during the remaining application process. COMMENTS: Parcel: 020127005001 The project proposes to create: Resubdivision of Lots 1 through 8 and Right of Way of Block 4 of Carr Town, resulting in one lot. Access for this project will be from: Stevenson Avenue ACCESS Development Review has reviewed the application materials related to access. The subject parcel has two (2) existing access points on Stevenson Avenue as described below: EXISTING ACCESSES Eastern Access • The eastern access (which is the eastern access of an existing horseshoe access) is a permitted access (AP18- 00572) located approximately 55 feet west of the 5th Street/Stevenson Avenue intersection. This access does not meet the 660' minimum access spacing requirement between an intersection and an access on a collector road or the 330' minimum access spacing requirement between two accesses on a collector road. • Per an agreement with the applicant, this access shall be closed and reclaimed on or before October 31, 2025, after the existing house located at 9391 Stevenson Avenue has been demolished and the access is no longer needed. Western Access • The western access (which is the western access of an existing horseshoe access) is a permitted access (AP18-00572) located approximately 145 feet west of the 5th Street/Stevenson Avenue intersection. Like the eastern access described above, this access does not meet the 660' minimum access spacing requirement between an intersection and an access on a collector road or the 330' minimum access spacing requirement between two accesses on a collector road. • Per an agreement with the applicant, this access shall be closed and reclaimed on or before October 31, 2025, after the existing house located at 9391 Stevenson Avenue has been demolished and the access is no longer needed. PROPOSED ACCESS According to the application materials, the applicant was proposing to move the existing western access 40 feet to the west of its current location. After discussions with the applicant and his agreement to close and reclaim the two (2) existing accesses on Stevenson Avenue on before October 31, 2025, the County has agreed to permit a new access on Stevenson Avenue located approximately 260 feet west of the 5th Street/Stevenson Avenue intersection. This access is to be used during and after the construction of a new house on the subject parcel. ROADS AND RIGHT-OF-WAY Stevenson Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the required setback is measured from the right-of-way line. The physical location of Stevenson Avenue may not be centered in the right-of-way. This road is maintained by Weld County. 5th Street is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the required setback is measured from the right-of-way line. The physical location of 5th Street may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at: https://www.weld.gov/Government/Departments/Public-Works/Permits/Right-of-Way-Permits VACATION OF RIGHT-OF-WAY Any vacation of right-of-way associated with this resubdivision shall be in accordance with Section 24-9-90, of the Weld County Code. Please note that a title commitment is required when vacating right-of-way. The resubdivision plat shall include the following right-of-way vacation statements: • Any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated by this plat, shall not be affected by the right-of-way vacation. • Weld County shall retain any mineral interests it may possess in the rights -of -way vacated by this plat. Rights -of -way vacated by this plat shall in no way affect such mineral interests. • Existing utilities within any rights -of -way to be vacated by this plat shall be protected. The resubdivision plat shall provide and delineate a utility easement (at a width specified by the utility owner) for any existing utility located within any right-of-way to be vacated. DRAINAGE REQUIREMENTS This area is within a Non -urbanizing Drainage Area. Non -urbanizing Drainage Areas typically require detention of stormwater runoff from the 1 -hour, 100 -year storm event falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm event falling on the undeveloped site having a 2% impervious value. Detention Pond Waived This project does not require a drainage report or a stormwater detention pond. Historic Flows The applicant will be required to maintain the historic drainage flows and run-off amounts that exist from the property. CONDITIONS OF APPROVAL: The plat shall be amended to delineate the following: 1. Stevenson Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way. The applicant shall delineate and label on the plat the existing right-of-way (along with its creating documents) and the physical location of Stevenson Avenue. Show and label the proposed residential access on Stevenson Avenue located approximately 260 feet west of 5th Street. Label the access as "PROPOSED RESIDENTIAL ACCESS". (Development Review) 6. Provide reception numbers for all previously vacated right-of-way located within the proposed resubdivision. 7. Provide a right-of-way vacation statement to protect all utilities located within proposed right-of-way being vacated by this plat. 8. Include language for the vacated right-of-way in the plat title. 9. Provide Board of County Commissioner signature block. 10. Provide and delineate a utility easement (at a width specified by the utility owner) for any existing utility located within any right-of-way to be vacated. DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Access to the site shall be maintained to mitigate any impacts to Stevenson Avenue including damages and/or offsite tracking. (Development Review) 3. The historical flow patterns and stormwater runoff amounts on the site will be maintained on the subject property. The parcel will consist of 4 acres and is served by an individual well (permit 333014) and an on -site wastewater treatment system (G19850112). The existing residence will be used as storage, and a new residence constructed. Environmental Health Services recommends the following condition prior to issuance of the Certificate of Occupancy: 1. An on -site wastewater treatment system is required for the proposed residence and shall be installed according to the Weld County on -site wastewater treatment system regulations. The existing residence shall be disconnected from the on - site wastewater treatment. Environmental Health Services recommends the following appear as notes on the resubdivision plat: 1. Water service may be obtained from an appropriately permitted individual well. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by on -site wastewater treatment systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the on -site wastewater treatment systems must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. The owners should be aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e., domestic use only, etc. Also, the applicant/owner should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time.
