Theodore A. Buderus and Susan H. Buderus whose address is 3126 Ashton Avenue, Greeley,
Colorado, 80634, and Daniel J. Buderus and Julie Ann Buderus, whose address is 19712 County
Road 50.5, LaSalle, Colorado, 80645, (collectively, the "Grantors" and each, a "Grantor") for
the consideration of $10.00, in hand paid, hereby sell and convey:
AN UNDIVIDED ONE-HALF INTEREST TO THEODORE A. BUDERUS and SUSAN H.
BUDERUS, whose address is 3126 Ashton Avenue, Greeley, Colorado, 80634, as joint tenants
with right of survivorship; and
AN UNDIVIDED ONE-HALF INTEREST TO DANIEL J. BUDERUS and JULIE ANN
BUDERUS, whose address is 19712 County Road 50.5, LaSalle, Colorado, 80645, as joint
tenants with right of survivorship,
the following real property situate in the County of Weld and State of Colorado, to wit:
Parcel 1 as described in the attached Exhibit A; and
Parcel 2 as described in the attached Exhibit B
also known as WCR 63 & 50, KERSEY COLORADO 80644;
with all its appurtenances (Real Property).
Together with 3 shares of Lower Latham Extension Ditch Company; 3 shares of the Lower
Latham Ditch Company; and 2 shares of the Lower Latham Reservoir Company; and all
irrigation and domestic wells and a Central Weld County Water District water tap; and
All right, title, and interest of Grantors in and to the following shall be included as part of the
definition of "Real Property" in this deed:
(a) Any land lying in the bed of any street or highway, opened or proposed, adjoining the Real
Property and in any strips and gores of land adjoining the Real Property; and
(b) All easements, rights of way, privileges, licenses, appurtenances, and other rights and
benefits belonging to, running with the owner of or in any way related to the Real Property; and
(c) All development rights, surveys, consents, authorizations, variances, waivers, public leases,
licenses, permits, and approvals from any governmental authority having jurisdiction with
respect to the Real Property, including, without limitation, certificates of occupancy; and
(d) All percolation and other soil, subsurface and geographical studies and tests relating to the
Real Property; and

(e) All right, title, and interest of Grantor in and to all transferable or assignable warranties,
representations, guarantees, contract rights, and miscellaneous rights if any, with respect to the
Real Property and its operation, and
(f) All books, records, documents of or within the control of Grantor or Grantor's agents relating
to the ownership, development, use, operation, cultivation, and management of the Real
Property; and
(g) All of the water, water rights, water court decree(s), ditches, ditch rights, wells, well rights,
reservoirs, reservoir rights, dikes, dike rights, embankments, embankment rights, pipeline rights,
range rights, oil, gas, coal and other mineral rights, and gravel rights, in or appurtenant to or used
for the benefit of the Real Property, if any, and any and all payments made or to be made to
Grantor in connection therewith; and
(h) All of Grantor's right, title, and interest in and to the improvements on the Real Property
including but not limited to fixtures, leaseholds, leasehold improvements, supplies, office
furniture, equipment, inventory and other property that is used or may be used with the Real
Property and the operation of any business of Grantor conducted on the Real Property, and
together with any other property owned by Grantor located on the Real Property as of the date of
the deed whether such property is a replacement of property or additional items acquired by
Grantor after the effective date of this deed; and
(i) All trade names, trademarks, contract rights, licenses and other proprietary information and
intangible assets, and rights to damages for any claims against others for prior improper use
thereof, if any, owned by Grantor and used in connection with the Real Property or the operation
of any business conducted by Grantor on the Real Property.
