The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning Services. Staff comments made during this phase of the application process may
not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for a Church
(Church, associated classroom, rectory and office spaces - St. Scholastica Catholic Church) in the A
(Agricultural) Zone District.
This project is north of and adjacent to State Highway 52 and is east of CR 1.
Parcel number 131331400016.
Access is from State Highway 52.
ACCESS
Development Review has reviewed the application materials related to access.
The applicant has proposed closing and reclaiming the two existing accesses in the southwestern corner
of the parcel and constructing a single right -in right -out access in the southeastern corner of the parcel.
State Highway 52 is governed by a Planning and Environmental Linkage Study and Access Control Plan
(ACP), November 2021. The ACP calls for the closing of the two southwestern access points if there is
redevelopment of the property and/or if traffic using the access point(s) increases by 20% or greater. The
Revised Traffic study has been forwarded to CDOT for their review in approving and permitting the
proposed access point.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways.
Please contact Mr. Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any
additional requirements that may be needed. (State Highway 52)
ROADS AND RIGHTS -OF -WAY
The property is bounded by State Highway 52. Contact the Colorado Department of Transportation (CDOT)
to determine what right-of-way shall be shown on the submitted plat. Reference the documents creating
the right-of-way. Please contact Tim Bilobran at the Greeley office, phone number: 970-350-2163.
SH 52 is governed by a Planning and Environmental Linkage Study and Access Control Plan. The link to

TRAFFIC
The preliminary Traffic Impact Study submitted with the revised application materials has been forwarded
to CDOT for review.
An accepted final Traffic Impact Study, stamped and signed by a profession engineer licensed in the State
of Colorado, shall be submitted.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention Pond summarized in a Drainage Report:
The applicant has submitted a preliminary drainage report. A final drainage report and detention pond
design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR
map. The drainage report must include a certification of compliance stamped and signed by the PE. A
Certification of Compliance form can be found on the Public Works Development Review website. General
drainage report checklist is available on the engineering website. More complete checklists are available
upon request.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Development Review)
B. A Final Traffic Impact Statement, stamped and signed by a Professional Engineer registered in the
State of Colorado is required. (Development Review)
C. The plan shall be amended to delineate the following:
1. Show the Colorado Department of Transportation (CDOT) right-of-way on the plat along with the
documents creating the right-of-way. (Development Review)
2. Show the approved Colorado Department of Transportation (CDOT) access(es) on the site plan
and label with the approved access permit number if applicable. (Development Review)
3. Show and label the accepted drainage features. Stormwater ponds should be labeled as
"Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume.

4. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Development Review)

Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use by Special Review Permit for a Church (church, associated
classroom, rectory, and office spaces - St. Scholastica Catholic Church) in the A
(Agricultural) Zone District.
Left Hand Water District provides water to the site.
An on -site wastewater treatment system (SP -0400264) sized for 5 bedrooms currently
provides sewer. The existing OWTS will be replaced with an OWTS sized for 236
attendees. An on -site wastewater treatment system design completed by Church On -
site Wastewater Consultants, LLC was submitted with the application.
We recommend that the following requirement be met prior to certificate of occupancy
for the proposed Church structure.
1. An On -Site Wastewater Treatment System (OWTS) is required for the Church
and shall be designed and installed according to the Weld County On -Site
Wastewater Treatment System Regulations. The OWTS is required to be
designed by a Colorado Registered Professional Engineer.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.

2. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
3. Adequate drinking, hand washing, and toilet facilities shall be provided for
employees and patrons of the facility, at all times. A permanent, adequate water
supply shall be provided for drinking and sanitary purposes.
4. Any on -site wastewater treatment system located on the property must comply
with all provisions of the Weld County Code, pertaining to On -site Wastewater

a. The NWRF needs continuous access at all time for any potential

b. Granting use of the access would require relocating the access gate and
fence line layout which would also need to accommodate the weight
scales right off the access road.
2. A Colorado Department of Transportation (CDOT) Access Permit will be required

Town of Frederick staff reviewed the above -mentioned application and have provided the following
comments:
Engineering Department: Any access alteration shall be in compliance with the HW52 ACP for access(s)
identified at 7.8-N and 7.81-N with approval provide by CDOT Region 4 Access Manager. Proposed access
improvements should anticipate and incorporated ROW preservation corridor as identified in the HW52 PEL
for this segment of highway.
Planning Department: Planning staff would like to see a landscape buffer with evergreen trees between the
parking lot and property to the east. The existing fence is not a screen fence. Berming with landscaping to
block headlights and views of the parking lot are also encouraged. Any parking lot light poles should be
minimized in height to avoid potential future conflicts with the Shores on Plum Creek residential subdivision
under review directly to the east of this project area.
