A public hearing was conducted on February 21, 2024, at 10:00 a.m., with the following present:

The following business was transacted:
._ = I hereby certify that pursuant to a notice dated December 21, 2023, and duly published
December 27, 2023, in the Greeley Tribune, a public hearing was scheduled for January 31, 2024,
to consider the request of ECO Properties, LLC, for a Site Specific Development Plan and Use
by Special Review Permit, USR23-0043, for Oil and Gas Support and Service including
establishments principally engaged in serving the oil and gas industry (fabricating, installing and
maintaining containment liners for oil and gas operations) outside of subdivisions and historic
townsites in the A (Agricultural) Zone District. On January 16, 2024, the Weld County Offices were
closed due to inclement weather conditions and the scheduled Planning Commission hearings
were rescheduled to later dates; therefore, an updated notice dated January 18, 2024, and duly
published January 20, 2024, in the Greeley Tribune, rescheduled this matter to February 21,
2024, at 10:00 a.m., to allow the case to be heard by the Planning Commission on February 6,
2024. Karin McDougal, Deputy County Attorney, made this a matter of record.
El Chair Ross reviewed for the applicant and the public, the procedures to follow should this
case result in a tie vote due to four (4) Commissioners being present and Commissioner Freeman
being excused, and Hannah Dutrow, AGPROfessionals, agreed to proceed. In response to
Chair Ross, Ms. Dutrow indicated she had not had contact with any of the Commissioners
regarding this case.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, the
general location of the site, distance to the nearest residence, and surrounding uses. He stated

notice was sent to nine (9) surrounding property owners (SPOs), no correspondence was
received, described the improvements on the site and iterated the number of employees and
hours of operations. He shared, per the Development Review staff, there is an existing, permitted,
agricultural access onto County Road (CR) 53; however, given the use will change upon approval
of this USR, a new Access Permit must be obtained, and the access will have to be upgraded to
meet current Code. He provided traffic information associated with the site, stated Development
Review is requesting a Road Maintenance Agreement, and relayed a Final Drainage Report was
accepted with the approval of the previous USR on the site. Mr. Ogle indicated 14 referrals were
sent out, three (3) agencies responded, he entered the favorable recommendation of the Planning
Commission into the record, as written, and displayed images of the site and surrounding views.
Lauren Light, Department of Public Health and Environment, stated the existing residence is
served by the North Weld County Water District for water, the site has an existing septic system,
permitted for four (4) people and if the restroom is to be used for employees, the applicant will
have it reviewed by an engineer. She relayed on -site fabrication will take place indoors, which will
decrease any noise concerns, and indicated the on -site fuel tank will have secondary
containment.
Ms. Dutrow represented the applicant, presented a PowerPoint presentation (Exhibit E), and
stated the USR permit will be for fabrication, as well as repair and storage of vehicles. She
provided the general location of the site and relayed the previous USR, which has been
discontinued, was for a hemp operation. She described on -site buildings, and equipment and
vehicle storage locations and indicated the majority of operations occur offsite. She provided the
number of employees and hours of operation and outlined how the application meets each of the
Weld County Code requirements. She described the traffic associated with the site and in
response to Commissioner James, clarified that fabrication means they are sizing the liners
onsite.
No public testimony was offered concerning this matter.
' = In response to Chair Ross, Ms. Dutrow indicated the applicant is agreeable to Conditions of
Approval and Development Standards, and the Board agreed to adding the language, "up to" to
Development Standard (DS) #5 (number of on -site employees).
El No public testimony was offered regarding the change made to DS #5.
Commissioner James moved to approve the request of ECO Properties, LLC, for a Site
Specific Development Plan and Use by Special Review Permit, USR23-0043, for Oil and Gas
Support and Service including establishments principally engaged in serving the oil and gas
industry (fabricating, installing and maintaining containment liners for oil and gas operations)
outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Buck,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:59 a.m.
