RESOLUTION
I-1
WHEREAS, a public hearing was held on Wednesday, October 15,
at 2:00 p. m. , in the chambers of the Board of County Commissioners of
Weld County, Colorado, for the purpose of hearing a petition of Chris
Schellenberg, Route 1, Box 95, Roggen, Colorado, requesting a change
of zone from "A" Agricultural District to "C" Commercial District, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner, and studied the recommendations of the Weld
County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS that the petition of Chris Schellenberg, Route 1, Box 95,
Roggen, Colorado, for change of zone from "A" Agricultural District to
"C" Commercial District, said area being more particularly described as
follows:
A parcel of land in the Northeast Quarter (NE*) of Section
Four (4), Township One (1) North, Range Sixty-two (62) West
of the 6th P. M. , Weld County, Colorado, containing 20 acres,
more or less,
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with to the satisfaction of the Board of
County Commissioners, Weld County, Colorado.
3, That said change of zone herein granted from "A" Agricultural
District to "C" Commercial District is conditional and shall exist only
so long as subject property is used and occupied as an airstrip. When said
airstrip, in the opinion of the Board of County Commissioners, ceases to
be used as such airstrip, then such area herein rezoned shall revert to
Agricultural District as originally zoned, and any related commercial
enterprise or business in connection therewith shall be removed from the
premises forthwith.
