County, Colorado, at 9:00 o'clock A. M., with the following present:

AUTHORIZING CHAIRMAN TO SIGN AGREEMENT

SAUNDERS PETROLEUM COMPANY:
BE IT RESOLVED, that the Chairman of the Board of County Commissioners of
Weld County, Colorado, be and he is hereby authorized to sign an agreement for
asphalt road materials with Saunders Petroleum Company, P. O. Box 129, Greeley,
Colorado, for delivery of asphalt materials to and including March 31, 1970:

AUTHORIZING COUNTY TREASURER TO DISTRIBUTE FUNDS
RECEIVED UNDER BANKHEAD-JONES FARM TENANT ACT
$22,835.19:
WHEREAS, the County Treasurer, Francis M. Loustalet, has received a
check in the amount of $22,835.19 representing net revenue due Yield County for
the calendar year, 1968, from government -owned lands administered by the Forest
Service under provision of Title Three of the Bankhead-Jones Farm Tenant Act,
said Act provides these payments of condition that they be used for school or
road purposes or both:
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that the County Treasurer, Francis M. Loustalet, be
and he is hereby authorized to distribute funds in the amount of $22,835.19,
received under provisions of the aforementioned Bankhead-Jones Act, to the
special schoolfund to be used for school purposs.

RESOLUTION
RE: REGULATING, WARNING AND GUIDING TRAFFIC ON COUNTY ROADS
AND AT COUNTY ROAD INTERSECTIONS IN WELD COUNTY, COLORADO.
WHEREAS, a multitude of complaints have been made to the Board of
County Commissioners of Weld County, Colorado, that drivers of motor vehicles
habitually drive on County roads and through County road intersections without
regard for the general safety of drivers of other motor vehicles, and
WHEREAS, the Board is authorized by the statutes of the State of Colorado
to regulate, warn and guide traffic on County roads, and
WHEREAS, said Board, pursuant to such complaints has determined
upon the basis of traffic and personal investigations that conditions exist which
make it necessary to regulate, warn and guide vehicular traffic on County roads
by posting signs thereon.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the Board deems it necessary to
regulate, warn and guide traffic on County roads and any intersections thereof,
and it hereby authorizes and orders the posting of such traffic control devices
as shall be reasonably necessary to regulate, warn and/or guide traffic thereon
for the safety of the general public and that said traffic control devices shall
conform to the State Manual and specifications.
The above and foregoing Resolution was, on motion duly made and sec-
onded, adopted by the following vote on the 19tbf March, A. D. 1969.

RESOLUTION
WHEREAS, Thomas L. Roach and Eudora Roach, 1128 East 20th Street,
Greeley, Colorado, have requested permission for a dog kennel operation on the
following described property, to -wit:
The Northeast Quarter (NE4) of Section Fourteen (14),
Township Five (5) North, Range Sixty-seven (67)West
of the 6th P. M. , Weld County, Colorado containing 140
acres more or less, and
WHEREAS, the said requested location for a dog kennel operation is
located in an agricultural zone as set forth by the Weld County Zoning Resolution,
and,
WHEREAS, according to Section 3. 3 (3) of the Zoning Resolution of Weld
County, said dog kennel operation may be authorized on approval of the Board
of County Commissioners of Weld County, and
WHEREAS, the Weld County Planning Commission has recommended
that said site for this dog kennel operation be approved.
NOW, THEREFORE, BE IT RESOLVED, that Thomas L. Roach and
Eudora Roach, 1128 East 20th Street, Greeley, Colorado, are hereby authorized
to locate a dog kennel operation on the following described property, to -wit:

LEASE AGREEMENT
THIS AGREEMENT made and entered into this /414day of -Zdiis
1965, between the CITY OF GREELEY and THE COUNTY OF WELD
acting by and through its agent, WELD COUNTY MUNICIPAL AIRPORT
BOARD, hereinafter referred to as Lessor, and LAWRENCE EMERY of
LaSalle, Colorado, hereinafter referred to as Lessee, WITNESSETH:
That for and in consideration of the rental herein agreed to be
paid by Lessee to Lessor and the covenants and agreements herein agreed
to be kept and performed, Lessor hereby leases to Lessee, for the term
hereinafter designated, the following described property:
1. That certain building 25 feet by 30 feet (metal) known as the
old office building located upon said Weld County Municipal Airport. d �
known as space No. 5.
2. The term of this lease shall be from the 1st day of May, A.D.
1965, to and until the 30th day of April, A.D. 1966, and Lessee agrees
to pay Lessor as rent for the term aforesaid, the sum of Seven Hundred
Twenty Dollars ($720. 00), payable in equal monthly installments of Sixty
Dollars ($60. 00) each, in advance, commencing on the 1st day of May,
1965.
3. It is further agreed that Lessee agrees to abide by the provisions
of the Weld County Municipal Airport Board operating policy as presently
adopted by said Board, and as may be amended.
4. And the Lessee further agrees to pay the rent for said premises
as hereinabove provided promptly when due and payable; to keep all the
improvements upon said premises, including all sewer connections, plumb-
ing, heating appliances, wiring and glass, in good order and repair at the
expense of said Lessee, to order no repairs at the expense of the Lessor;
and, at the expiration of this lease, to surrender and deliver up said
premises, including all heating appliances, plumbing, sewer connections,
wiring and glass, in as good order and condition as when the same were
entered upon, loss by fire excepted; to sublet no part of said premises,
nor assign this lease or any interest herein, without the written consent
of the Lessor first being obtained; to use said premises for no purpose
prohibited by the laws of the United States, the State of Colorado, or the
ordinances of the City of Greeley, County of Weld, now in force or here-
after enacted, and for no improper or questionable purpose whatsoever;
to pay all utilities concerning the use and occupancy of the above described
leased premises; to occupy the same as an office, keep the sidewalks in
front of and around said premises free from ice and snow, and said side-
walks and premises free from all litter, dirt, debris, and obstructions;
to keep said premises clean and in the sanitary condition required by the
ordinances and the health, sanitation and police regulations of the City of
Greeley, County of Weld; to neither permit nor suffer any disorderly
conduct, noise or nuisance, whatever, about said premises having a
tendency to annoy or disturb any persons occupying adjacent premises;
to neither hold nor attempt to hold the Lessor liable for any injury or damage
either proximate or remote occuring through or caused by any repairs.

premises or other parts of the above premises not herein demised, or by
reason of the negligence or default of the owners or occupants thereof
or any other person, nor liable for any injury or damage occasioned by
defective electric wiring, or the breaking or stoppage of the plumbing or
sewerage upon said premises or upon adjac nt premises, whether said
breaking or stoppage results from freezing or otherwise; to neither permit
nor suffer said premises, or the walls or f oors thereof to be endangered
by overloading nor said premises to he used for any purpose which would
render the insurance thereon void or the insurance risk more hazardous, nor
make any alteration or change in, upon, or,about said premises without first
obtaining written consent therefor; to place no signs on exterior of demised
premises without first securing the written consent therefor; that, in case
said premises shall become untenantable by reason of fire, the rent shall
cease while the same are being repaired, but that nothing herein contained
shall be construed so as to compel the Lessor to rebuild or repair said
premises in case of destruction unless it so desires; that no assent, expressed
or implied to any breach of any one or more of the covenants and agreements
hereof, shall be deemed or taken to be a waiver of any succeeding or other
breach; to permit the said Lessor at any reasonable hour of the day, to enter
into or upon and go through and view said premises; to surrender and deliver
up the possession of said premises promptly at the expiration of this lease.

5. And the said Lessee further covenants and agrees that if the rent
above reserved, or any part thereof, shall be in default, or in case of a breach
of any of the covenants or agreements herein, the said Lessor may declare
this lease terminated, and after the expiration of three days from the date
of the service of a written notice to that effect, be entitled to the possession
of said premises without further notice or demand; and further, that in case
the Lessor shall become entitled to the possession of said premises either
by the expiration of this lease or by any termination of said term as herein
provided for, and the said Lessee shall refuse to surrender and deliver up
the possession of said premises, after the service of said notice as afore-
said, then and in that event the said Lessor may, without further notice or
demand, enter into and upon said premises, or any part thereof, and take
possession thereof and repossess the same as of the Lessor's former estate,
and expel, remove and put out of possession the Lessee, using such help,
assistance, and force in so doing as may be needful and proper, without
being liable for prosecution or damages therefor, and without prejudice to
any remedy allowed by law, available in such cases.
6. The tenant hereby declares that in entering into this lease he
relied solely upon the statements contained in this lease and fully understands
that no agent or representative of the Lessor has authority to in any manner
change, add or detract from the terms of this lease.
7. It is mutually agreed, that if after the expiration of this lease the
Lessee shall remain in possession of said premises and continue to pay rent,
without any express agreement as to such holding, then such holding over
shall be deemed and taken to be a holding upon a tenancy from month to month,
and the party holding be regarded as a tenant from month to month at a monthly
rental equivalent to the monthly installments hereinabove provided for,
payable in advance on the same day of each calendar month.
8. It is further agreed that all the covenants and agreements in this
lease contained shall be binding upon and apply to the heirs, assigns and legal
representatives of said Lessor and said Lessee or any person claiming by,
through or under either of them or their agents or attorneys.
IN WITNESS WHEREOF, the parties hereto have hereunto set their
hands and seals the day first written above.
The above and foregoing lease is hereby extended to May 10, 1970.

best interest of the County to allow said increase.

WHEREAS, the Board of County Commissioners, Weld County, Colo-
rado, has determined that additional facilities are needed for expansion of
County shops, District No. 1, or Ault, Colorado, and
WHEREAS, certain property suitable for such expansion is available
and located adjacent to the present existing county shop facilities, District
No. 1 at Ault, Colorado, and consisting of four lots, and
WHEREAS, the Board deeming it advisable and in the best interests
of the County, has entered into a contract with the Sellers for the purchase
of said lots, including all buildings thereon for the total purchase price of
$5,000.00, and
WHEREAS, close proximity of these lots to the present county shop
facilities, District No. 1, at Ault, Colorado, makes it convenient and desir-
able for needed expansion and therefore, it is in the best interests of the
County to purchase said property.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners, Weld County, Colorado, hereby affirms and ratifies the

WHEREAS, the Board of County Commissioners, Weld County, Colo-
rado, has determined that such building is necessary and needed to house
County vehicles and equipment in District No. 1 at Ault, Colorado, and
WHEREAS, a certain, large steel quonset type building, Butler
Steel , is available and located at Hereford, Colorado, and
WHEREAS, the Board deeming it advisable and in the best interests
of the County, has entered into a contract with the Seller for the purchase of
said building, including all appurtenances thereto for the total purchase price
of $15,500.00 , and
WHEREAS, said building can be easily moved from its present location
and is very much needed and desirable for extra housing of County shop equip-
ment and vehicles for District No. 1 at Ault, Colorado, and therefore, it is in
the best interests of the County to purchase said building.

WHEREAS, Raymond Berg, Route 2, Box 328, Greeley, Colorado,

that the best interests of the County will be subserved by the acceptance of

RESOLUTION
WHEREAS, Union Pacific Railroad Company is presently serving the
nuclear power plant near Platteville, Colorado, under construction by Public
Service Company, and
WHEREAS, Union Pacific Railroad Company has been requested by
Public Service Company to construct an additional spur track into the Public
Service Company's property to further serve it, and
WHEREAS. Union Pacific Railroad Company has requested permission
to cross County Road No. 19. 5 along the north -south midline of Section 10, Town-
ship 3 North, Range 67 West, Weld County at a point 807. 3 feet south from the
north quarter corner of said Section 10, and
WHEREAS it is desirable and in the best interest of Weld County to
grant said request of Union Pacific Railroad Company.
NOW, THEREFORE, BE IT RESOLVED that Union Pacific Railroad
Company is hereby granted permission to construct a railroad crossing over
County Road No. 19. 5 running north and south in the middle of Section 10,
Township 3 North, Range 67 West, at a point 807. 3 feet south from the north
quarter corner of said Section 10 for the purpose of constructing a spur track
to serve the Public Service Company property east of said county road.
BE IT FURTHER RESOLVED that all expenses in connection with the
construction of such crossing, the laying of rails over the county road, con-
struction of drainage facilities, if necessary, and the installation of railroad
warning signs at the crossing for the protection of the general public shall be
borne by the railroad company and no expense for such construction or installa-
tion shall be borne by Weld County.
BE IT STILL FURTHER RESOLVED that the foregoing permission
granted by this Resolution is contingent upon the approval of said crossing by
the Public Utilities Commission of Colorado and any such crossing shall be con-
structed and warning signals shall be installed as may be prescribed by said
Public Utilities Commission.

After investigation and pursuant to Order and Notice heretofore issued and
served on March 26 , 1969, to show cause why the above -numbered Certificate of
License should not be suspended or revoked, public hearing was duly held in the
office of the Board of County Commissioners of Weld County, sitting as the Weld
County licensing authority, at 10:30 A. M. on Monday, the 14th day of April, 1969,
and the Board of County Commissioners of Weld County, sitting as the Weld County
licensing authority, having heard the testimony and evidence adduced upon said
hearing and having considered the testimony and evidence filed with said Board, and
having carefully weighed the same, now makes the following findings:
That the above -named licensee did violate the provisions of the Solid Waste
Disposal Sites and Facilities Act, 1967, Permanent Cumulative Supplement to '63
CRS 36-23-10 in the following particulars, to -wit:
1. By failing to properly cover waste material;
2. By failing to adequately fence the facility, thereby permitting waste
materials and debris to escape therefrom; and
3. By other violations in the conduct of operation of said disposal facility
contrary to the provisions of Paragraphs (b), (e), (f), and (g) of the
hereinabove mentioned act.
THE BOARD FURTHER FINDS that said licensee was found to have violated
the provisions of said statute on October 28, 1468, and ORDER OF SUSPENSION
entered with six months probationary period grhuted; and that licensee did violate
the provisions of the terms of said ORDER of the Board of October 28, 1968.
NOW, THEREFORE, in consideration of the foregoing, and pursuant to
authority of law, the Board of County Commissioners of Weld County, as the Weld
County licensing authority, hereby Orders that the above -numbered Certificate of
License of Designation for Waste Disposal Site be and the same hereby is revoked
upon each of the grounds set forth in the Board's findings therein; that said Certi-
ficate of License #11 be returned for cancellation; and that said licensee shall have
30 days from date hereof to cover with dirt the dump or dump sites operated by it
to the complete satisfaction of the Board.

RESOLUTION
WHEREAS, the County of Weld, State of Colorado, has been requested
to Relinquish and Quitclaim its surface rights to the present Owners of the sur-
face of the following described property, to -wit:
Lot 19, Block 5, First Filing Arrowhead, being
a subdivision of a part of the North Half (ND of
Section 27, Township 5 North, Range 66 West of
the 6th P. M. , Weld County, Colorado, accord-
ing to the recorded map or plat thereof, and
WHEREAS, Weld County has acquired certain rights to said surface by
virtue of its gas and mineral reservation as contained in deed dated December 9,
1943, Recorded January 3, 1944, in Book 1124, Page 214, Weld County Records,
and
WHEREAS, it has come to the attention of the Board that the Owners of
the hereinabove described property cannot obtain a loan without a release from
Weld County of the surface rights, and
WHEREAS, the Board believes it to be in the best interest of the County

A G R E E M E N T
THIS AGREEMENT, made and entered into by and between CITY OF GREELEY,
COLORADO, hereinafter referred to as CITY, and COUNTY OF WELD, hereinafter
referred to as COUNTY,
WITNESSETH
WHEREAS, the CITY and COUNTY desire to have proper ambulance service
for the citizens of Greeley and Weld County, and
WHEREAS, the CITY has proposed the attached agreement marked exhibit
"A" to establish an ambulance service for GREELEY and WELD County, and
WHEREAS, the parties hereto are in agreement as to the services desired
as set forth in said exhibit "A",
NOW, THEREFORE, IT IS MUTUALLY AGREED as follows:
1. That the attached agreement, exhibit "A" is hereby approved and the
COUNTY shall reimburse the CITY for the monies paid by the CITY under exhibit
"A" for calls requested by the Colorado State Patrol, Town Marshal, Sheriff's
Office and rural fire departments or districts after the CITY has paid same
and so certifies to the COUNTY, and the CITY shall pay to the COUNTY any monies
paid to the CITY pursuant to exhibit "A" that are collections from calls that
the COUNTY reimburses the CITY pursuant to this Agreement.
2. That all other payments to be made to the ambulance service pursuant
to exhibit "A" shall be paid one-half by the City of Greeley and one-half by
the County of Weld.
3. That any modification or changes of exhibit "A" shall also be ap-
proved by the COUNTY.

WHEREAS, Evelyn G. Brewster, 1944 - 8th Avenue, Greeley, Colorado,
and Allen L. Corn, Jr., 1005 - 19th Street, Greeley, Colorado, a partner-
ship, have applied for a license to conduct a public dance hall to provide en-
tertainment for junior and senior high school students in the Metro -Greeley
area, at a location to be known as the STROBE, 2630 - 6th Avenue, Greeley,
Weld County, Colorado, and
WHEREAS, said partners have submitted a statement dated April 16,
1969 reciting in detail the proposed operation of said entertainment center,
and
WHEREAS, it is apparent to the Board of County Commissioners, Weld
County, Colorado, that there is a need for such a proposed youth entertain-
ment center, and
WHEREAS, the Board believes it to be in the best interest of the County
to grant a public dance hall license to said applicant's on the basis as recited
in said proposal of operation of the proposed entertainment center.
NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF COUNTY
COMMISSIONERS, Weld County, Colorado, that the application of Evelyn G.
Brewster and Allen Corn, Jr., dba the STROBE, 2630 6th Avenue, Greeley,
Colorado, and the proposal of operation as submitted therewith, copy of
which is attached hereto and made a part hereof by reference, be, and it
hereby is approved.
BE IT FURTHER RESOLVED, that a license to conduct a public dance

RESOLUTION
IN THE MATTER OF WELD COUNTY MUNICIPAL AIRPORT BOARD
PURCHASING A T -HANGAR FACILITY AT THE WELD COUNTY MUNI-
CIPAL AIRPORT ON A LEASE -OPTION PURCHASE AGREEMENT.
WHEREAS, the Weld County Municipal Airport Board has determined
that there is a definite need for future expansion of Airport facilities and
a need to provide for additional hangar facilities, and
WHEREAS, the Greeley Recreation Company, known as GRC has offered
to construct a T -hangar facility at the Airport on land owned jointly by the
City of Greeley and Weld County, Colorado, and
WHEREAS, upon construction of said T -hangar, same will be leased to
the City on a lease -option purchase agreement payable over a fifteen (15)
year period and for a sum to be negotiated between the City and GRC, and
WHEREAS, said lease -option to purchase agreement between the City
and Greeley Recreation Company (GRC) is convenient and desirable and in
the best interest of Weld County.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Com-
missioners of Weld County, Colorado, hereby affirms and ratifies the action
of the Weld County Airport Board and the City of Greeley in entering into a
lease -option agreement to purchase said T -hangar facility; that if and when
said option to purchase is exercised, record title of said improvements (T -
hangar facility) be in the name of the City of Greeley and the County of Weld,
State of Colorado, however, with the proviso that there be created no obligation
on the part of Weld County to pay any of the balance of the purchase price out-
standing and payable as may be evidenced.
The above and foregoing Resolution was, on motion duly made and sec-

MALT BEVERAGE LICENSE OF
JERRY C. McDONALD
The application of Jerry C. McDonald, 1003 East 18th Street, Greeley,
Colorado, for retail 3. 2 fermented malt beverage license (for sale and con-
sumption off premises only) came on for hearing April 30, 1969 at 2:00 P. M.
and the Board of County Commissioners of the County of Weld having heard
the testimony and evidence adduced upon said hearing and having considered
the testimony, evidence, petitions and remonstrances filed with said Board,
and having carefully weighed the same, now makes the following findings:
1. The evidence discloses that the applicant is the owner of said premises
sought to be licensed within the meaning of the statutes.
2. That no question was raised nor objection offered as to the applicant's
concerning the standing, character or motives of said applicant.
3. The applicant has proven a prima facie case as to the reasonable re-
quirements of the neighborhood.
4. The desires and needs of the inhabitants of the immediate neighborhood,
as well as the needs of others in the area are not fulfilled, inasmuch as there
presently is no retail 3. 2 fermented malt beverage license (for sale and con-
sumption off premises only) in the area designated as the neighborhood.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of Weld,
has heard the application of Jerry C. McDonald for a retail 3. 2 fermented
malt beverage license, for sale and consumption off premises only, at a loc-
ation described as follows:
East Half (E4) of Lot 7 of the Northwest Quarter
(NW4) of the Southeast Quarter (SEn) of Section 9,
Township 5 North, Range 65 West of the 6th P. M.
Weld County, Colorado, except beginning at the
Southwest Corner of the East Half (El) of Lot 7,
thence East 90 feet, thence North 180 feet, thence
West 90 feet, thence South 180 feet to the true
point of beginning, and
WHEREAS, the said Board has made its findings on the evidence, testi-
mony, petitions and remonstrances submitted to it, which findings recede
this Resolution and by reference are incorporated herein and made a part

WHEREAS, Longmont Red -D -Mix Company, a Colorado corporation,
dba Windsor Red -D -Mix, Windsor, Colorado, has requested permission
to locate a Red -D -Mix concrete plant on the following described property,
to -wit:
A parcel of land in the NW4 of Section 22, Township
6 North, Range 67 West of the 6th P. M. , Weld County,

to Great Western Railway Company, located East of

RESOLUTION
IN THE MATTER OF BOARD OF TRUSTEES FOR THE WELD COUNTY
PUBLIC HOSPITAL PURCHASING A TRACT OF LAND TO BE USED FOR
FUTURE WELD COUNTY HOSPITAL EXPANSION.
WHEREAS, the Board of Trustees for the Weld County Public Hospital
has determined that there is a definite need for future County Hospital expan-
sion and to provide for needed future medical facilities at said Hospital, and
WHEREAS, the certain tract of land suitable for such Hospital expan-
sion and development is available and located adjacent to the Weld County
Hospital on 16th Street, and
WHEREAS, the Board of Trustees, deeming it advisable and in the
best interests of the Hospital and of the County, has entered into an Option
Contract on March 31, 1969, with the Seller for the purchase of said prop-
erty for the total purchase price of $150,000.00, upon the following terms
and conditions, to -wit: $20, 000.00 on delivery of the Deed, and the balance
of $120,000.00, evidenced by a Note and secured by First Deed of Trust, at
5% per annum interest, payable in installments of $1,272.80 per month and
amortized over a period of ten years, as provided for in Note and Deed of
Trust, and
WHEREAS, close proximity of subject property to the Hospital makes
it convenient and desirable for anticipated Hospital expansion and, therefore,
it is in the best interests of the Hospital and the County to purchase said prop-
erty.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners of Weld County, Colorado, hereby affirms and ratifies the
action of the Hospital Board of Trustees in entering into an Option Contract
for the purchase of the aforementioned property; that if and when said Option
to purchase is exercised, record title of said real estate be in the name of
the County of Weld, State of Colorado, however, with the proviso that there
be created no obligation on the part of Weld County to pay any of the balance
of the purchase price presently outstanding and payable as evidenced by copy
of Note and Deed of Trust attached hereto.

2:30 P. M. in the chambers of the Board of County Commissioners of Weld
County, Colorado, for the purpose of hearing a petition of United States Steel
Corporation, P. O. Box 14, Gilcrest, Colorado, requesting a change of zone
from "A" Agricultural District to "C" Commercial District, and
WHEREAS, the petitioner was present and represented by Mr. Leonard

for the Director of the Weld County Department of Public Welfare,

AGREEMENT FOR TRASH REMOVAL
JOHN KLINE:
WHEREAS, John Kline has submitted an agreement for trash removal
from the Weld County Court House, Weld County,Jail, Weld County Services
Building and the Weld County Library at a rate of One Hundred Dollars ($100.00)
per month, for a term beginning June 1, 1969 and ending May 31, 1970, and
WHEREAS, the Board believes it to be in the best interests of the
County to accept said agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that an agreement for trash removal as submitted by
John Kline be and the same is hereby accepted.

CONCERNING CHANGE OF ZONE
PETITION OF I. C. ARWOOD
The petition of I. C. Arwood, 1213 Francis Street, #6, Longmont,
Colorado, requesting a change of zone from "A" Agricultural District
to"M-Hr Mobile Home District of a tract of land located in the South-
west Cuarter (SW4) of Section Eight (8), Township Two (2) North, Range

and adequate supply of potable water for said mobile home subdivision.
4. That each of the preceding findings in and of themselves and in-
dependent of each other constitutes a separate and individual ground for
denial of the change of zone.

FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF WHITE ACRES,
ARAPAHOE FARMS AND DEVELOPMENT COMPANY
The petition of White Acres, Arapahoe Farms and Development Company,
2920 Pearl Street, Boulder, Colorado, requesting a change of zone from "A"
Agricultural District to "M -H" Mobile Home District of a tract of land located
in the Northwest Quarter (NW4) of Section Three (3), Township Three (3) North,
Range Sixty-eight (68) West of the 6th Principal Meridian, Weld County, Colo-
rado, containing Ninty-four acres, more or less, for a proposed trailer court,
came on for hearing on Wednesday, May 14, 1969 at 2:00 P. M. o'clock, and
the Board of County Commissioners of the County of Weld having heard the testi-
mony and evidence adduced upon said hearing, and having considered the testi-
mony, evidence, and the recommendations of the Weld County Planning Com-
mission filed with said Board, and having carefully weighed the same, now makes
the following findings:
1. The evidence discloses that the applicant failed to sustain the burden
of proof as to the need for a change of zone or that the present zone is erroneous
or that circumstances warrant a change of zone at this time.
2. The evidence shows that the inhabitants of the immediate vicinity of
the area sought to be rezoned are unanimously opposed to the change of zone.
3. The evidence shows that there is no assurance of a continous and
adequate supply of potable water for said trailer court complex.
4. The evidence shows that there would be a large ditch lateral bisecting
said proposed trailer court which would be an attractive nuisance if such trailer
court were allowed, and additionally, would deprive vested owners of said ditch
to the continous use and enjoyment of the irrigation water.
5. The evidence shows that users of water running through said ditch
lateral have a proprietary interest in and to certain headgates both on and off
the property sought to be rezoned, and that they would be subjected to unreason-
able and undue hardship to properly divide their fair share of the water in said
ditch lateral.
6. The evidence shows that petitioner already has a tract containing
approximately Fifty-three (53) acres, more or less, that has already been zoned
"M -H", and plat filed as Fairway's Living Ranchettes, a mobile home subdivision.
7. The evidence shows that the same issues herein were decided against
applicant on February 19 , 1969, by Resolution of the Board of same date, and
the Board finds no change of circumstance warranting a different decision at
this time.
8. That each of the preceding findings in and of themselves and independ-
ent of each other constitutes a separate and individual ground for denial of the
change of zone.

WHEREAS the Board of County Commissioners of the County of Weld
has heard the application of White Acres, Arapahoe Farms and Development
Company, 2920 Pearl Street, Boulder, Colorado, for a change of zone from
"A" Agricultural District to "M -H" Mobile Home District, of a tract of land
for a proposed trailer court, said are being more particularly described as
follows:
A parcel of land designated as Lot A on plat, containing
94 acres m/1 and and located in the NW4 of Section 3,
Township 3 North, Range 68 West of the 6th P. M. ; except

WHEREAS, the Dunwick Company of 776 Lincoln Tower Building, Denver,
Colorado, has presented an Oil and Gas Lease, covering the following tract of
land, situate in Weld County, Colorado, more particularly described as follows:
A strip of land identified as Parcel No. 31 in decree recorded
in Book 983 at page 30 of Weld County Records, as follows:
A strip of land 20 feet wide, adjacent and south of the present
Highway right-of-way, extending westward approximately 7,920 feet
from the North and South centerline of Section 25 to the west
boundary line of Section 26, Township 8 North, Range 61 West of
the 6th P. M., containing 3.64 acres, more or less,
and
WHEREAS, the Board believes it to be in the best interest of the
County to sign said lease.

authorization to cancel County certificate #319 of the 1967 tax sale for the

Lots 17 to 22, Block 58, Milliken; also, certificate #294 of the 1968 tax sale
for the taxes of 1967 on improvements only on the West 105 acres of the NW4

APPRECIATION OF SERVICES RENDERED
WELD COUNTY MUNICIPAL AIRPORT BOARD
DR. ROBERT L. HOFF:
WHEREAS, by resolution dated July 5, 1967, Dr. Robert L. Hoff
was appointed as a member of the Weld County Municipal Airport Board, and
WHEREAS, Dr. Hoff has expressed his desire to retire from said
Board, and
WHEREAS, Dr. Hoff by his wise counsel has contributed greatly in
public service to the County as a member of said Board.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that it does hereby express its appreciation to Dr.
Hoff for the faithfully services rendered, having been most beneficial to the
Weld County Municipal Airport Board, to the taxpayers of Weld County and to
the patrons of the Airport.
