The Notice below concerns a proposed annexation to the Town of Lochbuie and it is imperative
that the Notice is published on each of the four dates set forth above.

NOTICE OF A PUBLIC HEARING CONCERNING THE ELIGIBILITY OF CERTAIN
PROPERTIES FOR ANNEXATION KNOWN AS THE SOUTH WELD ANNEXATION NO.
1, SOUTH WELD ANNEXATION NO. 2 AND SOUTH WELD ANNEXATION NO. 3
NOTICE IS HEREBY GIVEN, pursuant to C.R.S. § 31-12-108(2), that the Town Board of
Trustees of the Town of Lochbuie, Colorado will hold a public hearing on February 12, 2024 at
5:30 PM (or as soon thereafter as the meeting agenda permits) to consider whether the properties
generally known as the South Weld Annexation No. 1, South Weld Annexation No. 2 and South
Weld Annexation No. 3 and more particularly described in Resolution Nos. 2024-05, 2024-06 and
2024-07, respectively, approved January 12, 2024 (the "Substantial Compliance Resolutions"),
which properties in the aggregate consist of approximately 222.7 acres including portions of Weld
County Roads 4, 41 and 45 as more particularly described in the relevant petitions for annexation
(the "Subject Properties"), meet the applicable requirements of Section 30 of Article II of the
Colorado Constitution and C.R.S. § 31-12-104 and' C.R.S. § 31-12-105, and are eligible for
annexation to the Town of Lochbuie. Copies of the three Petitions for Annexation concerning the
Subject Properties and the corresponding annexation maps are on file at the Town of Lochbuie
Town Clerk's office, 703 WCR 37, Lochbuie Colorado 80603.
All interested persons will be given an opportunity to be heard. The hearing will be held at a
special meeting of the Town Board of Trustees to be held in Lochbuie Town Hall, 703 Weld
County Road 37, Lochbuie Colorado 80603, with a remote attendance option at the above date and
time. Information to attend the meeting via remote teleconferencing technology platform will be
posted on the Town web site at www.lochbuie.org at least 24 hours before the start of the meeting.

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF LOCHBUIE,
COLORADO, ACCEPTING AN ANNEXATION PETITION, MAKING CERTAIN
FINDINGS OF FACT, FINDING SUBSTANTIAL COMPLIANCE FOR SUCH
PETITION, AND SETTING A PUBLIC HEARING FOR ANNEXATION OF
PROPERTY KNOWN AS THE SOUTH WELD ANNEXATION NO. 1
WHEREAS, the Town Board of Trustees of the Town of Lochbuie, Colorado, has received
and examined the filings and Petition for Annexation requesting the annexation to the Town of
Lochbuie of certain real property more fully described in said petition as presented at the meeting
of the Town Board of Trustees on January 12, 2024 ("South Weld Annexation No. 1") which
petition and exhibit thereto is incorporated herein by reference (the "Property"); and
WHEREAS, said Petition for Annexation ("Petition") has been filed of record with the
Town Clerk of the Town of Lochbuie, State of Colorado, who has provided copies of such petition
to the Board of Trustees upon receipt; and
WHEREAS, the Town Board of Trustees finds as follows:
1. That the Petition contains:
(a) An allegation that it is desirable and necessary that such area be annexed to the
Town of Lochbuie and the requirements of C.R.S. ,§§ 31-12-104 and 31-12-105
exist or are met.
(b) An allegation that the signers of the Petition, comprise more than fifty percent
(50%) of the landowners of the area proposed to be annexed and own more than
fifty percent (50%) of the area proposed to be annexed, exclusive of public streets
and alleys and any land owned by the Town of Lochbuie.
(c) A request that the Town of Lochbuie approve the annexation of the Property.
(d) The signature of the landowners that executed the petition.
(e) The mailing address of the landowner signers.
(f) The legal description of the Property and a legal description of the specific real
property owned by the landowners that executed the petition.
(g) The date that the landowners executed the petition.
(h) The affidavit of petition circulator(s); stating that the signature of each landowner
therein is the signature of the person whose name it purports to be.
2. That four (4) copies of the annexation maps corresponding to the Property have been
submitted to the Town with the Petition, and that the annexation map contain the following
information:
(a) A written legal description of the boundaries of the Property proposed to be
annexed.

(b) A map showing the boundary of the Property proposed to be annexed.
(c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks.
(d) Next to the boundary of the Property proposed to be annexed is drawn the
contiguous boundary of the Town of Lochbuie.
3. That no signature on the Petitions is dated more than one hundred eighty (180) days
prior to the date of filing of the Petitions for Annexation with the Town Clerk of the Town of
Lochbuie, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of, Trustees of the Town of
Lochbuie, Colorado that:
Section 1. That the foregoing recitals and findings are incorporated herein as findings
and conclusions of the Town Board of Trustees.
Section 2. That the Petition for Annexation to the Town of Lochbuie of the Property,
which Petition was officially filed of record with the Town Clerk of the Town of Lochbuie on or
prior to January 10, 2024, substantially complies with the requirements of C.R.S. § 31-12-107(1).
Section 3. No election is required under C.R.S. § 31-12-107(2).
Section 4. No additional terms and conditions are to be imposed except as provided in
the Petition for Annexation and in any annexation agreement which may be entered into by and
between the Town of Lochbuie and the petitioner(s), which are not to be considered additional
terms and conditions within the meaning of (31-12-112, C.R.S.
Section 5. That a public hearing shall be held at a special meeting of the Board of
Trustees to be held on Monday, the 12th day of February, 2024, at 5:30 p.m. at the Lochbuie
Town Hall, 703 WCR 37, Lochbuie Colorado 80603 and via teleconference with details on
accessing such teleconference platform to be made publicly available on the Town web site at least
24 hours before the hearing, for the purpose of determining and finding whether the proposed
annexation as described in the Petition complies with Section 30 of Article II of the Colorado
Constitution and the applicable provisions of C.R.S. §§ 31-12-104 and 31-12-105. The Town
Clerk shall publish notice of such hearing in accordance with state law.
Section 6. Any person may appear at such hearing and present evidence pertaining to
the eligibility of the proposed annexation of the Propertyto the Town of Lochbuie.
Section 7. The Town staff and Town Attorney are hereby directed to take all such
actions, including making any legal filings, as are necessary to comply with state law governing
the process for annexing the Property.
Section 8. This Resolution shall be effective immediately upon adoption.

PETITION FOR ANNEXATION
TO
TOWN OF LOCHBUIE, COLORADO
(SOUTH WELD ANNEXATION NO. 1)
TO: THE TOWN CLERK AND THE BOARD OF TRUSTEES OF THE
TOWN OF LOCHBUIE, COLORADO
RE: ANNEXATION OF APPROXIMATELY 194.37 ACRES IN WELD
COUNTY, COLORADO, AS DESCRIBED ON EXHIBIT 1-A,
EXHIBIT 1-B AND EXHIBIT 1-C ATTACHED HERETO
THE UNDERSIGNED PETITIONER, in accordance with Title 31, Article 12, Part 1, of the
Colorado Revised Statutes, as amended (commonly known as the Municipal Annexation Act of
1965), hereby petitions the Town of Lochbuie, a statutory municipality of the State of Colorado
(the "Town"), for annexation of three (3) unincorporated areas more particularly described in
Exhibit 1-A ("Annexation Property No. 1"), Exhibit 1-B ("Annexation Property No. 2"), and
Exhibit 1-C ("Annexation Property No. 3"), attached hereto and incorporated herein by
reference. Annexation Property No. 1, Annexation Property No. 2 and Annexation Property No.
3 are collectively referred to herein as the "Property." In support of this Petition, the undersigned
Petitioner alleges and states the following:
1. That it is desirable and necessary that the Property be annexed to the Town.
2. That the undersigned Petitioner owns the real property legally described in Exhibit 2
attached hereto and incorporated herein by this reference, which is located within the
Property proposed to be annexed.

petition(s) for annexation to the Town for the Property described in Exhibit 1,

than three miles in any direction from any point of the Town's boundary in any one year.

7. That accompanying this Petition are four (4) copies of an annexation map containing the
following information:
A. a written legal description of Annexation Property No. 1, Annexation Property No. 2
and Annexation Property No. 3;
B. a map showing the boundary of each of Annexation Property No. 1, Annexation
Property No. 2 and Annexation Property No. 3;
C. with the annexation boundary map there is shown the location of each ownership tract
in unplatted land, and if part or all of the area is platted, then the boundaries and the
plat number of plots or of lots and blocks are shown; and
D. next to the boundary of the Property is drawn the contiguous boundary of the Town,
' and the contiguous boundary of any other municipality abutting the area proposed to
be annexed and the dimensions thereof.
8. The undersigned and the Town may enter into an annexation and development agreement
in form and substance acceptable to the Town and the undersigned ("Annexation and
Development Agreement") prior to or after the effective date of this annexation, as
provided for in Chapter 31-12-112(2), Colorado Revised Statutes, as amended.
That the Property proposed to be annexed is located within special district(s) identified on
Exhibit 3 and no other(s).
10. That the undersigned Petitioner signed this Petition not more than one hundred and eighty
(180) days prior to the date of the filing of this Petition with the Town Clerk.
11. That, in connection with the processing of this Petition, Petitioner requests that the Town
institute zoning approval processes for the Property in accordance with C.R.S. § 31-12-

115 and Article II of Chapter 19 of the Lochbuie Municipal Code.
12. That, upon the annexation of the Property becoming effective, and subject to the conditions
set forth in this Petition and to be set forth in the Annexation and Development
Agreement, the Property shall become subject to all ordinances, resolutions, rules and
regulations of the Town, except as otherwise set forth in the Annexation and
Development Agreement, and except for general property taxes of the Town, which shall
become effective on January 1 of the next succeeding year following adoption of the
annexation ordinance.
13. The Petitioner hereby reserves the right to withdraw this Petition at any time prior to the
final reading of the ordinance to effectuate the annexation contemplated in this Petition for
Annexation.
14. That this Petition includes the signature of the Petitioner proposing the annexation, the
mailing addresses of the Petitioner, the legal description of the land owned by the
Petitioner, the date on which each Petitioner executed this Petition, and the circulator's
affidavit required by Section 31-12-107(1)(c), C.R.S., certifying that the signatures on this
Petition are the signature of each person whose name it purports to be and certifying the
accuracy of the date of such signatures.
THEREFORE, THE PETITIONER, respectfully requests that the Town Board of Trustees of
the Town, approve the annexation of the Property. To that end, the Petitioner does hereby consent
to the annexation of said area into the Town.

RESOLUTION NO. 2024-06
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF LOCHBUIE,
COLORADO, ACCEPTING AN ANNEXATION PETITION, MAKING CERTAIN
FINDINGS OF FACT, FINDING SUBSTANTIAL COMPLIANCE FOR SUCH
PETITION, AND SETTING A PUBLIC HEARING FOR ANNEXATION OF
PROPERTY KNOWN AS THE SOUTH WELD ANNEXATION NO.2
WHEREAS, the Town Board of Trustees of the Town of Lochbuie, Colorado, has received
and examined the filings and Petition for Annexation requesting the annexation to the Town of
Lochbuie of certain real property more fully described in said petition as presented at the meeting
of the Town Board of Trustees on January 12, 2024 ("South Weld Annexation No. 2") which
petition and exhibit thereto is incorporated herein by reference (the "Property"); and
WHEREAS, said Petition for Annexation ("Petition") has been filed of record with the
Town Clerk of the Town of Lochbuie, State of Colorado, who has provided copies of such petition
to the Board of Trustees upon receipt; and
WHEREAS, the Town Board of Trustees finds as follows:
1. That the Petition contains:
• (a) An allegation that it is desirable and necessary that such area be annexed to the
Town of Lochbuie and the requirements of C.R.S. §§ 31-12-104 and 31-12-105
exist or are met.
(b) An allegation that the signers of the Petition, comprise more than fifty percent
(50%) of the landowners of the area proposed to be annexed and own more than
fifty percent (50%) of the area proposed to be annexed, exclusive of public streets
and alleys and any land owned by the Town of Lochbuie.
(c) A request that the Town of Lochbuie approve the annexation of the Property.
(d) The signature of the landowners that executed the petition.
(e) - The mailing address of the landowner signers.
(I) The legal description of the Property and a legal description of the specific real
property owned by the landowners that executed the petition.
(g) The date that the landowners executed the petition.
(h) The affidavit of petition circulator(s); stating that the signature of each landowner
therein is the signature of the person whose name it purports to be.

2. That four (4) copies of the annexation maps corresponding to the Property have been
submitted to the Town with the Petition, and that the annexation map contain the following
information:
(a)
A written legal description of the boundaries of the Property proposed to be
annexed.
(b) A map showing the boundary of the Property proposed to be annexed.
(c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks.
(d) Next to the boundary of the Property proposed to be annexed is drawn the
contiguous boundary of the Town of Lochbuie.
3. That no signature on the Petitions is dated more than one hundred eighty (180) days
prior to the date of filing of the Petitions for Annexation with the Town Clerk of the Town of
Lochbuie, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of
Lochbuie, Colorado that:
Section 1. That the foregoing recitals and findings are incorporated herein as findings
and conclusions of the Town Board of Trustees.
Section 2. That the Petition for Annexation to the Town of Lochbuie of the Property,
which Petition was officially filed of record with the Town Clerk of the Town of Lochbuie on or
prior to January 10, 2024, substantially complies with the requirements of C.R.S. § 31-12-107(1).
Section 3. No election is required under C.R.S. § 31-12-107(2).
Section 4. No additional terms and conditions are to be imposed except as provided in
the Petition for Annexation and in any annexation agreement which may be entered into by and
between the Town of Lochbuie and the petitioner(s), which are not to be considered additional
terms and conditions within the meaning of §31-12-112, C.R.S.
Section 5. That a public hearing shall be held at a special meeting of the Board of
Trustees to be held on Monday, the 12th day of February, 2024, at 5:30 p.m. at the Lochbuie
Town Hall, 703 WCR 37, Lochbuie Colorado 80603 and via teleconference with details on
accessing such teleconference platform to be made publicly available on the Town web site at least
24 hours before the hearing, for the purpose of determining and finding whether the proposed
annexation as described in the Petition complies with Section 30 of Article II of the Colorado
Constitution and the applicable provisions of C.R.S. §§ 31-12-104 and 31-12-105. The Town
Clerk shall publish notice of such hearing in accordance with state law.
Section 6. Any person may appear at such hearing and present evidence pertaining to
the eligibility of the proposed annexation of the Property to the Town of Lochbuie.
Section 7. The Town staff and Town Attorney are hereby directed to take all such
actions, including making any legal filings, as are necessary to comply with state law governing
the process for annexing the Property.

Section 8. This Resolution shall be effective immediately upon adoption.

THE UNDERSIGNED PETITIONER, in accordance with Title 31, Article 12, Part 1, of the

and the contiguous boundary of any other municipality abutting the area proposed to
be annexed and the dimensions thereof.
8. The undersigned and the Town may enter into an annexation and development agreement
in form and substance acceptable to the Town and the undersigned ("Annexation and
Development Agreement") prior to or after the effective date of this annexation, as
provided for in Chapter 31-12-112(2), Colorado Revised Statutes, as amended.
9. That the Property proposed to be annexed is located within special district(s) identified on
Exhibit 3 and no other(s).
10. That the undersigned Petitioner signed this Petition not more than one hundred and eighty
• (180) days prior to the date of the filing of this Petition with the Town Clerk.
11. That, in connection with the processing of this Petition, Petitioner requests that the Town
institute zoning approval processes for the Property in accordance with C.R.S. § 31-12-
115 and Article II of Chapter 19 of the Lochbuie Municipal Code.
12. That, upon the annexation of the Property becoming effective, and subject to the conditions
set forth in this Petition and to be set forth in the Annexation and Development
Agreement, the Property shall become subject to all ordinances, resolutions, rules and

regulations of the Town, except as otherwise set forth in the Annexation and
Development Agreement, and except for general property taxes of the Town, which shall
become effective on January 1 of the next succeeding year following adoption of the
annexation ordinance.
13. The Petitioner hereby reserves the right to withdraw this Petition at any time prior to the
final reading of the ordinance to effectuate the annexation contemplated in this Petition for
Annexation.
14. That this Petition includes the signature of the Petitioner proposing the annexation, the
mailing addresses of the Petitioner, the legal description of the land owned by the
Petitioner, the date on which each Petitioner executed this Petition, and the circulator's
affidavit required by Section 31-12-107(1)(c), C.R.S., certifying that the signatures on this
Petition are the signature of each person whose name it purports to be and certifying the
accuracy of the date of such signatures.
THEREFORE, THE PETITIONER, respectfully requests that the Town Board of Trustees of
the Town, approve the annexation of the Property. To that end, the Petitioner does hereby consent
to the annexation of said area into the Town.

and examined the filings and Petition for Annexation requesting the annexation to the Town of
Lochbuie of certain real property more fully described in said petition as presented at the meeting
of the Town Board of Trustees on January 12, 2024 ("South Weld Annexation No. 3") which
petition and exhibit thereto is incorporated herein by reference (the "Property"); and
WHEREAS, said Petition for Annexation ("Petition") has been filed of record with the
Town Clerk of the Town of Lochbuie, State of Colorado, who has provided copies of such petition
to the Board of Trustees upon receipt; and
WHEREAS, the Town Board of Trustees finds as follows:
1. That the Petition contains:
(a) An allegation that it is desirable and necessary that such area be annexed to the
Town of Lochbuie and the requirements of C.R.S. §§ 31-12-104 and 31-12-105
exist or are met.
(b) An allegation that the signers of the Petition, comprise more than fifty percent
(50%) of the landowners of the area proposed to be annexed and own more than
fifty percent (50%) of the area proposed to be annexed, exclusive of public streets
and alleys and any land owned by the Town of Lochbuie.
(c) A request that the Town of Lochbuie approve the annexation of the Property.
(d) The signature of the landowners that executed the petition.
(e) The mailing address of the landowner signers.
(f) The legal description of the Property and a legal description of the specific real
property owned by the landowners that executed the petition.
(g) The date that the landowners executed the petition.
(h) The affidavit of petition circulator(s); stating that the signature of each landowner
therein is the signature of the person whose name it purports to be.

2. That four (4) copies of the annexation maps corresponding to the Property have been
submitted to the Town with the Petition, and that the annexation map contain the following
information:
(a) A written legal description of the boundaries of the Property proposed to be
annexed.
(b) A map showing the boundary of the Property proposed to be annexed.
(c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks.
(d) Next to the boundary of . the Property proposed to be annexed is drawn the
contiguous boundary of the Town of Lochbuie.
3. That no signature on the Petitions is dated more than one hundred eighty (180) days
prior to the date of filing of the Petitions for Annexation with the Town Clerk of the Town of
Lochbuie, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of
Lochbuie, Colorado that:
Section 1. That the foregoing recitals and findings are incorporated herein as findings
and conclusions of the Town Board of Trustees.
Section 2. That the Petition for Annexation to the Town of Lochbuie of the Property,
which Petition was officially filed of record with the Town Clerk of the Town of Lochbuie on or
prior to January 10, 2024, substantially complies with the requirements of C.R.S. § 31-12-107(1).
Section 3. No election is required under C.R.S. § 31-12-107(2).
- Section 4. No additional terms and conditions are to be imposed except as provided in
the Petition for Annexation and in any annexation agreement which may be entered into by and
between the Town of Lochbuie and the petitioner(s), which are not to be considered additional
terms and conditions within the meaning of §31-12-112, C.R.S.
Section 5. That a public hearing shall be held at a special meeting of the Board of
Trustees to be held on Monday, the 12th day of February, 2024, at 5:30 p.m. at the Lochbuie
Town Hall, 703 WCR 37, Lochbuie Colorado 80603 and via teleconference with details on
accessing such teleconference platform to be made publicly available on the Town web site at least
24 hours before the hearing, for the purpose of determining and finding whether the proposed
annexation as described in the Petition complies with Section 30 of Article II of the Colorado
Constitution and the applicable provisions of C.R.S. §§ 31-12-104 and 31-12-105. The Town
Clerk shall publish notice of such hearing in accordance with state law.
Section 6. Any person may appear at such hearing and present evidence pertaining to
the eligibility of the proposed annexation of the Property to the Town of Lochbuie.
Section 7. The Town staff and Town Attorney are hereby directed to take all such
actions, including making any legal filings, as are necessary to comply with state law governing
the process for annexing the Property.

10. That the undersigned Petitioner signed this Petition not more than one hundred and eighty
(180) days prior to the date of the filing of this Petition with the Town Clerk.
11. That, in connection with the processing of this Petition, Petitioner requests that the Town
institute zoning approval processes for the Property in accordance with C.R.S. § 31-12-
115 and Article H of Chapter 19 of the Lochbuie Municipal Code.
12. That, upon the annexation of the Property becoming effective, and subject to the conditions
set forth in this Petition and to be set forth in the Annexation and Development
Agreement, the Property shall become subject to all ordinances, resolutions, rules and

regulations . of the Town, except as otherwise set forth in the Annexation and
Development Agreement, and except for general property taxes of the Town, which shall
become effective on January 1 of the next succeeding year following adoption of the
annexation ordinance.
13. The Petitioner hereby reserves the tight to withdraw this Petition at any time prior to the
final reading of the ordinance to effectuate the annexation contemplated in this Petition for
Annexation.
14. That this Petition includes the signature of the Petitioner proposing the annexation, the
mailing addresses of the Petitioner, the legal description of the land owned by the
Petitioner, the date on which each Petitioner executed this Petition, and the circulator's
affidavit required by Section 31-12-107(1)(c), C.R.S., certifying that the signatures on this
Petition are the signature of each person whose name it purports to be and certifying the
accuracy of the date of such signatures.
THEREFORE, THE PETITIONER, respectfully requests that the Town Board of Trustees of
the Town, approve the annexation of the Property. To that end, the Petitioner does hereby consent
to the annexation of said area into the Town.

Annexation Impact Report — South Weld Annexation No.'s 1, 2 and 3
1.0 INTRODUCTION
The following Annexation Impact Report (the "Report") introduces three Petitions for
Annexation described as South Weld Annexation No's. 1, 2 and 3 (the "Petitions"). The
Petitions were submitted to the Town of Lochbuie ("Lochbuie or the "Town") by South
Weld Holdings, LLC ("South Weld" or the "Applicant") on January 10, 2024 and are
included as EXHIBITS 1-A, 1-B, and 1-C of this report. The subject property is
comprised of five land parcels totaling approximately 223 acres, consisting of road right-
of-way (ROW) and unimproved agricultural land owned by South Weld (the "Northern
Property"). These land parcels cover areas generally identified as:
South Weld Annexation No. 1
o Annexation Map No. 1 — 1.17 acres of land owned by South Weld located
adjacent to and east of Weld County Road (WCR) 39, and north of WCR
4;
Annexation Map No. 2 53.73 acres of land owned by South Weld
located adjacent to and east of WCR 39, and adjacent to and north of
WCR 4;
Annexation Map No. 3 — 139.46 acres of road right-of-way and land
owned by South Weld including portions of WCR 4, and lands located
west of WCR 41 and north of WCR 4;
South Weld Annexation No. 2 — 7.166 acres of road right-of-way and land owned by
South Weld including portions of WCR 41, and lands located adjacent to and
west of CR 41; and
South Weld Annexation No. 3 — 20.56 acres of road right-of-way and land owned by
South Weld including portions of WCR 41, WCR 4, and lands located adjacent to
and west of CR 41.
2.0 REPORT PURPOSE AND CONTENT
This Report has been prepared to assist Lochbuie and the Board of County
Commissioners of Weld County with their assessments of the impacts of the proposed
annexations. Accordingly, the intent of this Report is to: (i) provide the Town and the
Board of County Commissioners with adequate information to assess the impacts of the
proposed annexations; (ii) address the Town's general policies for annexation; and (iii)
fulfill the requirements set forth in the State of Colorado Municipal Annexation. Act of
1965 (CRS §31-12-101, et seq., as amended, referred to in this report as the
"Annexation Act"). Pursuant to Section 31-12-108.5 of the Colorado Revised Statutes
(C.R.S.), this Report includes:
■ A map or maps of the municipality and adjacent territory to show the following
information:
o The present and proposed boundaries of the municipality in the
vicinity of the proposed annexation;
o The present streets, major trunk water mains, sewer interceptors and
outfalls, other utility lines and ditches, and the proposed extension of

such streets and utility lines in the vicinity of the proposed annexation;
and
o The existing and proposed land use pattern in the areas to be
annexed;
A statement setting forth the plans of the municipality for extending to or
otherwise providing for, within the area to be annexed, municipal services
performed by or on behalf of the municipality at the time of annexation;
A statement setting forth the method under which the municipality plans to
finance the extension of the municipal services into the area to be annexed;
A statement identifying existing districts within the area to be annexed; and
A statement on the effect of annexation upon local -public school district
systems, including the estimated number of students generated and the
capital construction required to educate such students.
3.0 MAPPING
A map reflecting the present and proposed. Town boundaries in the vicinity of the
annexation is attached to the Petitions in EXHIBITS 1-A, 1-B, and 1-C.
The Northern Property is currently zoned Agricultural by Weld County and
consists of unimproved vacant land located adjacent to and east of Lochbuie.
The Applicant is pursuing a flexible overlaying district with underlying zone
districts of Single -Family Residential (R-1), Two -Family Residential (R-2),
Multiple -Family Residential (R-3), Mixed Use (MU), and Industrial (I). A map
reflecting the existing and proposed land use pattern is attached as Exhibit 2.
4.0 EXTENSION OF MUNICIPAL SERVICES
As currently anticipated, water and sanitary sewer services will be provided by Lochbuie.
If practical, the Applicant will incorporate a dual water system to provide non -potable
water for irrigation of landscaped areas, including lawn watering. The Concept Utility
Map attached as Exhibit 3 reflects current streets, major trunk water and sanitary mains,
and routing for the extension of these facilities to the vicinity of the proposed annexation.
It is also anticipated that other municipal and regional services such as police, fire
protection, street maintenance, and snow removal will be provided by the Town or
established regional providers.
4.1 Water Resources
The Applicant will provide water resources to serve the Property as will be set forth more
fully in an annexation agreement currently being negotiated between the Town and the
Applicant. The Applicant anticipates providing tributary water rights acceptable to the
Town on a phased basis prior to the issuance of building permits for development areas
or as otherwise agreed between the Applicant and the Town.

4.2 Dry Utilities
The Property will be serviced by local utility providers. Natural gas and electric will be
provided by Xcel Energy or United Power. Telephone/data and CATV will be provided
by CenturyLink.
5.0 FINANCING OF MUNICIPAL SERVICES
The Applicant has formed special districts and contemplates inclusion of the Northern
Property in such special districts upon completion of annexation and zoning. The
purpose of these special districts would be to finance and construct public improvements
for the project. Eligible public improvements may include public ROW's (i.e., internal
roads and improvements to WCR's 2, 4 and 39), water distribution and wastewater
collection systems, storm water controls and other improvements. Examples of the
eligible public improvements for the property are described below.
5.1 Public Streets and Drainage
Through an approved special district, the Applicant proposes to design and construct all
public street improvements and proposed public streets (including drainage conveyance
and detention structures) in accordance with Lochbuie standards.
5.2 Potable Water
Through an approved special district, the Applicant proposes to design, purchase and
install a municipally treated water distribution system to fully serve the Property,
including but not limited to water mains, fire hydrants, service line laterals, pipelines, and
all appurtenant facilities necessary to provide treated municipal water service to the
Property. The Town will provide potable water facilities including but not limited to water
treatment, pressurization, pumping and treated water storage facilities.
5.3 Non Potable Water
If feasible and through an approved special district, the Applicant proposes to design,
purchase and install all elements of a non -potable water distribution system to fully serve
the Property, including but not limited to well systems, water mains, pump stations,
laterals, pipelines, and all appurtenant facilities necessary to provide non potable water
to irrigated portions of the Property. The Applicant or a designated special district will be
responsible for constructing and operating the non -potable system.
5.4 Sanitary Sewer
Through an approved special district, the Applicant proposes to design, purchase and
install all elements of a sanitary sewage collection system to fully service the property,
including but not limited to collection piping, lift stations, service lines and all appurtenant
facilities necessary to collect sanitary sewage generated at the Property. This

wastewater collection system shall include all improvements and facilities, structures,
measuring devices, pump stations that will be required, except as may be constructed by
the Town through other investment fees.
7.0 EXISTING DISTRICTS
The Northern Property lies within districts for the Hudson Fire Department, Weld County
RE 3-J School, Central Colorado Water Conservancy ("CCWCD"), CCWCD Subdistrict,
Aims Junior College, High Plains Library, Altamira Metropolitan District and Bromley
Park Metropolitan District No. 6. The Weld County Sheriffs Department currently
provides police protection to the area.
8.0 ANTICIPATED IMPACTS
8.1 Existing Infrastructure
Lochbuie's existing water distribution and wastewater collection systems will be
extended to the Northern Property (as shown in Exhibit 3). Based on anticipated water
demand and wastewater requirements, existing Town infrastructure and capacities will
adequately serve the Northern Property.
8.2 Fire Protection
The Project will be required to meet all Hudson Fire Department access and fire
protection requirements.
8.3 School District Systems
Through a series of land acquisitions starting in 2019, Burlington Northern Santa Fe
("BNSF") has acquired more than 2,000 acres immediately adjacent to and north of the
Northern Property for purposes of constructing a BNSF-served intermodal facility and
industrial park. Given this proximity to the BNSF project, the Applicant anticipates
primarily industrial uses on Northern Property and no impact on the local school district
systems. To the extent these uses change, the Applicant will coordinate with the RE3-J
School District to evaluate student generation assumptions and associated impacts.
