HomeMy WebLinkAbout20241852.tiffWELD COUNTY CODE ORDINANCE 2024-12 IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of revision and clarification with regard to procedures, terms, and requirements therein. WHEREAS, on July 1, 2024, S.B. 24-131 becomes effective, which enacts Section 18-12-105.3(1)(b), C.R.S., as follows: Section 18-12-105.3. Unlawful carrying of a firearm in government buildings - penalty - definitions. (1) A person shall not knowingly carry a firearm, whether loaded or not loaded, in any of the following locations, including their adjacent parking areas: (b) Unless permitted by a local government, as described in subsection (4)(b) of this section, on the property or within any building in which: (i) the chambers or galleries of a local government's governing body are located; or (ii) a meeting of a local government's governing body is being conducted; or (iii) the official office of any elected member of a local government's governing body or of the chief executive officer of a local government is located; and WHEREAS, Section 18-12-105.3(4)(b), C.R.S., authorizes the Board of County Commissioners to enact an ordinance permitting a person to carry a firearm at the places described in Section 18-12-105.3(1)(b), C.R.S., and PAGE 1 CC: CTBCE6/GH) CA(AL.-), FICSS/cr/So). A CT(a) 0'7/25/2H 2024-1852 ORD2024-12 WHEREAS, to that end, the Board of County Commissioners believes that Chapter 2 Administration of the Weld County Code needs revision to permit a person to carry a firearm at the places described in Section 18-12-105.3(1)(b), C.R.S., as that Section pertains to the Board of County Commissioners of the County of Weld. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that Chapter 2 Administration of the Weld County Code be, and hereby is, repealed, reenacted, and amended to include the following Section 2-2-65: CHAPTER 2 ADMINISTRATION ARTICLE II — General Policies Add Sec. 2-2-65. Permission to carry firearm at place described in Section 18-12-105.3(1)(b), C.R.S. A. Carrying of a firearm in the following places is permitted: 1. The Weld County Administration Building and property located at 1150 O Street, Greeley, Colorado. 2. Any building and property where the Board of County Commissioners is conducting a meeting as that term is defined in Section 24-6-402((1)(b), C.R.S. B. The term "firearm" as used in this Section shall mean the same as defined in Section 18-1-901(3)(h), C.R.S.: "Firearm" means any handgun, automatic, revolver, pistol, rifle, shotgun, or other instrument or device capable or intended to be capable of discharging bullets, cartridges, or other explosive charges. BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
