Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: Change of Zone from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District. This project is north of and adjacent to County Road 54 and is west of and adjacent to County Road 17. Parcel number: 095720400010. Access is from County Roads 17 and 54. ACCESS Development Review has reviewed the application materials related to access and determined that the site currently has three (3) existing accesses as described below. • There is an existing, unpermitted, agricultural access on County Road 17 located approximately 750 feet north of County Road 54. This access meets the minimum assess spacing requirement for an arterial road as defined in Table 1, of Section 8-14-30.1., of the Weld County Code (see Table 1 below). This access shall be closed and reclaimed. • There is an existing, unpermitted, agricultural (and formerly oil and gas) access on County Road 54 located approximately 1,040 feet west of County Road 17. This access shall be closed and reclaimed in accordance with the Freedom Parkway Access Control Plan. Per Section 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please refer to Chapter 8 of the Weld County Code for more information regarding access. All preliminarily approved accesses are subject to change during the access permitting process. ROADS AND RIGHTS -OF -WAY County Road 17 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 54 (Freedom Parkway) is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Right -of -Way Use Permit instructions and application can be found at: https://www.weld.gov/Government/Departments/Public-Works/Permits/Right-of-Way-Permits. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. CONDITIONS OF APPROVAL A. The plat shall be amended to delineate the following: 1. County Road 17 is a paved road and is designated on the Weld County Functional Classification Map as an arterial road which requires 140 feet of right-of-way at full buildout. The applicant shall delineate and label on the plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Development Review) 2. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Development Review) 3. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned ponding of stormwater runoff. Little Thompson Water District will provide water, an email was included with the submittal that states, "LTWD is not opposed to serving the subject property". An on -site wastewater treatment system may serve the site as appropriate. We recommend the following appear as notes on the Change of Zone plat: 1. Water service may be obtained from Little Thompson Water District. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by an on -site wastewater treatment system (OWTS) designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Staff has completed review of the proposal and have no conflicts with the proposed activity. We have included additional comments below: 1. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are several oil and gas well sites in the area surrounding the parcel. 2. The parcel includes zero (0) active oil and gas wells. 3. The parcel includes one (1) plugged and abandoned (PA) well listed in Table 1 below. Additional information regarding these plugged and abandoned wells is available from the Energy & Carbon Management Commission (ECMC). OGED recommends that the Applicant review this information and contact the responsible operator regarding well infrastructure that may have been abandoned in place prior to conducting operations in proximity to the wells. Additionally, as stated in the Utilities Water Letter LTWD included in this submittal, we do not currently service the subject property. We own and operate a 2.5 -inch diameter waterline along the eastern portion of the subject property that transitions to a 6 -inch diameter waterline going south to the intersection of WCR 17 and WCR 54. We ask that the applicant reaches out to the District once they reach the design phase of their development to complete the commitment letter process. This process will include the review of their proposed development and will result in a breakdown of the necessary requirements to ensure service can be provided. Pursuant to Section 23-3-230 of the Weld County Municipal Code, "the purpose of the C-3 Zone District is to designate areas of commerce for the benefit of the broader region, such as large-scale regional shopping centers and entertainment districts. C-3 District properties may require large amounts of space or generate high traffic volumes. Properties zoned C-3 are typically located near high -traffic corridors." The functional classification of Weld County Road 17 (WCR 17), pursuant to the Town of Johnstown Transportation Master Plan, is identified as a Regionally Significant Corridor — Major Arterial. Given the intent of the C-3 Zoning District, and the extensive list of uses allowed by right in said zone, the Town requests that the appropriate traffic analysis be conducted when a project is proposed. Right-of- way for the ultimate buildout of WCR 17 should also be dedicated, at no cost, in conjunction with any future project to secure appropriate lands for future improvements. The Town also requests that any future uses that include outdoor storage be sited, screened, and landscaped in ways to minimize visual offense. Likewise, any odor or noise inducing uses should also be mitigated to minimize any offenses. We would like to be notified of any future applications for site development on the subject property.
