RE: APPROVE LIMITED EVENT PERMIT, LEP24-0001 - BENJAMIN MARMON AND
JANNA CZEPIEL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Benjamin Marmon and Janna Czepiel, 5610 Northeast County Line Road,
Erie, Colorado 80516-9310, presented to the Board of County Commissioners of Weld County,
Colorado, an application for a Limited Event Permit on land within the unincorporated portion of
the County of Weld, State of Colorado, to be held on June 1, 2024, from 12:00 p.m. until 5:00
p.m., outside the corporate limits of any town or city in the County of Weld at the location described
as follows:
5610 Northeast County Line Road, Erie, Colorado 80516-9310;
Lot B of Recorded Exemption, RE -3926; being part of S1/2 NW1/4
of Section 6, Township 1 North, Range 68 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the fee for the filing of said Limited Event Permit has been waived due to the
applicant concurrently applying for a Special Event Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and all of the exhibits and
evidence presented in this matter, and having been fully informed, finds the following to support
the issuance of the Limited Event Permit requested:
1. The submitted materials are in compliance with the application requirements of
Chapter 23, Article IV, Division 18, of the Weld County Code.
2. The applicant has demonstrated that the request is in conformance with
Section 23-18-80 of the Weld County Code as follows:
A. The applicant has demonstrated that the limited event is compatible with
existing and allowed land uses in the neighborhood;
B. The applicant has demonstrated that the limited event will comply with all
applicable requirements of the Weld County Code;
C. The applicant has demonstrated that the limited event will result in no
substantial adverse impact to other land uses and/or residences in the
neighborhood, including environmentally sensitive areas or features or
other lands;
D. The applicant has demonstrated that the limited event has addressed the
recommendations of the referral entities, and

WHEREAS, the issuance of said Limited Event Permit is subject to compliance with the
Performance Standards, Inspection, and Enforcement requirements set forth below, with the
terms and conditions set forth in the application materials, and upon the express condition and
agreement that the event will be conducted in strict conformity to all laws of the State of Colorado
and the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Benjamin Marmon and Janna Czepiel for a Limited Event
Permit, LEP24-0001, to be held on June 1, 2024, from 12:00 p.m. until 5:00 p.m., on the parcel
of land described above, be, and hereby is, granted subject to the following conditions:
1. The Limited Event Permit shall adhere to the following Performance Standards:
A. An adequate and safe supply of potable water meeting requirements set
forth by the Colorado Department of Public Health and Environment.
B. Toilets conveniently located throughout the property, sufficient to provide
healthful facilities for the maximum number of people -in attendance, and
meeting all state and local specifications, as determined by the Weld
County Department of Public Health and Environment.
C. A sanitary method of disposing of solid or liquid waste, in compliance with
state and local laws and regulations, sufficient to dispose of the waste
production of the maximum number of persons allowed to attend the limited
event. The applicant shall comply with its plan for holding and collecting
such waste at least once each day of the event. The plan shall provide for
trash cans, dispersed throughout the property, sufficient to prevent solid
wastes from escaping the property. The plan must call for sufficient
personnel to perform such tasks and collecting any wastes that do escape,
and within forty-eight (48) hours of cessation of the limited event, the
property shall be returned to its previous condition, including removal of all
buildings and structures, trash, debris, signage, attention -attracting
devices, or other evidence of the limited event.
D. Two (2) certified emergency medical technicians and one (1) emergency
ambulance for limited events with more than five hundred (500) persons.
One additional certified medical technician provided for every additional
five hundred (500) persons. An enclosed structure where treatment may
be rendered.
E. A licensed practical nurse or registered nurse, licensed to practice in the
state, provided for limited events with more than one thousand (1,000)
persons. One (1) additional nurse provided for every additional
one thousand (1,000) persons.

F. If the limited event is to occur during hours of darkness, illumination
sufficient to light parking and pedestrian areas shall be provided at the rate
of at least five (5) foot-candles. No illumination shall be allowed to shine or
reflect unreasonably beyond the boundaries of the property.
G. No limited event shall extend past 12:00 a.m.
H. No overnight camping is allowed either before or after the limited event.
There shall be a parking area, either on -site or off -site, sufficient to provide
parking space for the maximum number of persons allowed at any limited
time to attend the limited event. At least one (1) parking space measuring
at least nine (9) feet in width shall be provided for every four (4) attendees.
If any parking is to be provided off -site, authorization from the property
owner shall be required. The applicant shall provide a description of the
surface material of the parking areas.
J. There shall be a traffic circulation system sufficient to allow safe and
efficient traffic and pedestrian circulation for the maximum number of
attendees allowed at any limited time. The flow of traffic on roads shall not
be blocked or hindered, and no cars, buses, or bicycles shall be allowed to
park along the side of or in any public road right-of-way. The applicant shall
provide a plan for handling traffic in conformance with the Manual on
Uniform Traffic Control Devices and the Colorado Supplement.
K. Access to and from the property shall be limited to access approved
pursuant to provisions of Chapter 8 of the Weld County Code. Where an
existing access shared with other property owners or lessees is to be used,
authorization of each of the owners or lessees entitled to use the access
shall be required.
L. The applicant must provide adequate facilities for communication with
emergency medical, police, and fire services.
M. The applicant must provide security which, as determined by the Sheriff, is
adequate to control any disturbances which might occur at the limited
event.
N. The applicant shall comply with all requirements of the applicable fire
protection district.
O. The applicant shall ensure that sounds from the limited event do not exceed
the residential noise limits or carry unreasonably beyond the boundaries of
the property. Sound created by the limited event which exceeds any
limitations set by the Weld County Noise Ordinance (Chapter 14, Article IX,
of the Weld County Code) shall be presumed to be unreasonable.

P. The applicant must provide for appropriate on -site dust mitigation.
Q. Food service operations shall comply with the Colorado Retail Food
Establishment Rules and Regulations.
R. Guarantees in the form of an irrevocable letter of credit, bond, or cash
retainer in the amount of three thousand dollars ($3,000.00) may be
required to cover the cost of any required clean-up and restoration following
the limited event where the maximum number of attendees is more than
two hundred fifty (250), or five hundred dollars ($500.00) for any event
where the maximum number of attendees is more than one hundred (100),
but less than two hundred fifty (250). Any letter of credit or bond must be
irrevocable for a period of thirty (30) days after the completion of the event.
The letter of credit, bond, or cash retainer will be released by the County
as soon as possible after the event, after determination that the site has
been adequately cleaned up and restored from any impacts of the event,
but no later than thirty (30) days following the event.
S. Insurance in an amount determined to be adequate and reasonable in light
of the risks and hazards relating to the limited event, but no less than five
hundred thousand dollars ($500,000.00). Such Certificate of Insurance
shall include the County of Weld, by and through its Board of County
Commissioners, its elected officials, and employees, as Additional Named
Insureds.
T. Limited events must occur or operate in compliance with the provisions of
Section 23-18-90 of the Weld County Code, and all applicable provisions
and regulations of Weld County, and applicable state and federal statutes
and regulations.
U. If electrical systems are not self-supporting, electrical systems installation
and maintenance must comply with minimum county and state electrical
standards.
V. The issuance of a Limited Event Permit shall not relieve the landowner or
applicant of the responsibility for securing other permits or approvals
required by Weld County, the applicable fire district, or other applicable
public agency.
W. Any other condition deemed necessary by the Board of County
Commissioners to preserve the health, safety, and welfare of the public and
surrounding properties, residences, and other neighboring land uses.
2. Inspection: pursuant to Section 23-18-100 of the Weld County Code, the
employees of the Weld County Sheriff's Office, the Planning Department, and/or
Health Department may enter the property from time -to -time during the limited
event to inspect and ensure compliance with the Limited Event Permit

Performance Standards and to enforce the provisions of Section 23-18-90 of the
Weld County Code. The Limited Event Permit must be available for inspection on
the property at all times during the limited event.
3. Enforcement:
A. Pursuant to Section 23-18-110.A of the Weld County Code, a Limited Event
Permit may be suspended or revoked by the Board of County
Commissioners at any time if any of the Performance Standards required
of the permit are not complied with, or for violation of any provision of
Section 23-18-90 of the Weld County Code, or any other applicable law,
rule, or regulation, for violation of the specific permit conditions, or for any
misrepresentation by the applicant, his or her agents or employees, or
independent contractors under contract with the applicant. Upon
revocation, the guarantee may also be forfeited. By signing the application,
the applicant agrees that employees of the Sheriff's Office, the Planning
Department, and/or Health Department may enter the property and cause
the limited event to be stopped upon suspension or revocation of the
Limited Event Permit.
B. Pursuant to Section 23-18-110.6 of the Weld County Code, violations of
Section 23-18-90 of the Weld County Code will be enforced by the Weld
County Sheriff and/or through the enforcement procedures set forth in
Article X of Chapter 23 of the Weld County Code.
BE IT FURTHER RESOLVED by the Board that any violation to said terms and conditions
shall be cause for revocation of said permit and forfeiture of the required guarantee.

Summary
The applicant, Janna Czepiel, is proposing to hold an annual event for fundraising. The name of the event
is The Spring Fling, this will benefit the Erie Makerspace Non -Profit organization. The event will have up
to five hundred (500) guests. This event has been successfully held in the subject location for the past
two (2) years. The applicant has also applied for a special event permit for liquor use through Clerk to the
Board and is currently going through the approval process.
The event is proposed for a single day being June 1, 2024, from 12 p.m. — 5 p.m. The applicant has
volunteers that will be CPR certified and there will be fire extinguishers and first aid kits on site. These
volunteers will also handle security. Colorado Portables is contracted to provide port -o -lets and a
handwashing station. There will be filtered water on site from Eldorado Springs Water. All other waste will
be disposed of in the applicant's weekly garbage pickup.
There will be two (2) licensed food trucks on site, Lady in the Wild and High Point Creamery and alcohol
will be sold at the event with proceeds going to the Erie Makerspace. There will also be a live Bluegrass
band playing throughout the day.
The Weld County Department of Planning Services sent notice to twelve (12) referral agencies, (nine) 9
of (twelve) 12 referral agencies had either no concerns or did not return a referral. (Three) 3 referral
agencies had comments. The Weld County Department of Planning Services also sent notice to three (3)
surrounding property owners. No correspondence was received regarding the proposed event.
Department of planning services' staff recommends that this request be approved for the following
reasons:
1. The submitted materials are in compliance with the application requirements of Chapter 23,
Article IV, Division 18, of the Weld County Code.
2. The applicant has demonstrated that the request is in conformance with Section 23-18-80 of the
Weld County Code as follows:
A. The applicant has demonstrated that the limited event is compatible with existing and allowed
land uses in the neighborhood.
B. The applicant has demonstrated that the limited event will comply with all applicable
requirements of the Weld County Code.
C. The applicant has demonstrated that the limited event will result in no substantial adverse

2. Explain the nature and purpose of the request. Describe the site where the event will occur and
whether the event will be managed by the property owner or another person or entity (authorized
agent).
The Spring Fling is a community event focused on supporting local makers, musicians, businesses & non -profits. Money will
be raised for the Erie Makerspace. Vendors will be selling goods and food trucks will be serving food. A bluegrass band will
be playing live music from 2-5pm. The event will take place on a 2.5 acre farmette and will be managed by the property
owners.
3. Describe efforts to contact owners of property within 500 feet of the boundaries of the subject
property, whether a neighborhood meeting was held, and, if so, how notification was provided. (Do
not attempt to contact County Commissioners prior to the hearing.)
We have discussed the event with all property owners within 500 feet of our property.
4. Provide the dates and hours of the event. (Each LEP is valid for up to 3 consecutive days. Events
must end by 10 p.m. each night. No overnight camping.)

5. Maximum number of attendees allowed at any one time. Describe the method of enforcing this limit.
300. Our parking areas will not allow for more than —300 attendees at one time. Attendees will not be allowed if parking is
full. (It is unlikely there will be this many people in attendance at the same time.)
6. Maximum number of tickets to be sold, if any, and anticipated total attendance.
We do not plan on selling tickets. Total attendance is expected to be 300-500.
7. Describe existing and proposed structures. Separate building permits may be required.
The only existing structure that will be used for the event is a small storage building and will be used for storage of alcohol
only. There are no new proposed structures.
8. Describe plans to provide for emergency medical treatment for attendees. Include any first -aid
structures, the names, addresses, and hours of availability of emergency medical technicians and
nurses, and provisions for emergency ambulance services. Attach contract, agreement, or email for
the company providing standby emergency medical services.
We will have a first aid kit on hand. Multiple volunteers are CPR certified. We will call 911 if there is an extreme medical
emergency.
9. Describe plans for communication with hospital, police, and fire services. Including the source,
amount, and location of communication equipment. (In an emergency, call 911.)
We will use our cell phones to call emergency services. All volunteers will have their cell phones on them.
10. Describe plans for fire suppression.
VVc Yvill have numerous fire extinguishers located around the property
11. Describe plans for security. Include the number of guards and attach contract, agreement, or email.
We will have at least 10 volunteers monitoring the event to keep the event under control.
12. Describe plans for communication to attendees during the event. Include the source, amount, and
location of communication equipment.
We will be able to communicate to attendees through the sound system that the band is using.
13. Describe plans for emergency evacuation and/or emergency shelter. Contact the Weld County Office
of Emergency Management at 970-304-6540 or 800-436-9276 (ext. 3809). (In an emergency, call
911.1
This will be an outdoor event. In the event of an emergency, attendees can leave via their vehicles. If emergency shelter is
needed, guests can take cover in their vehicles.
14. Describe plans for supplying drinking water. Include the source, number, and location of facilities.
Filtered water from Eldorado will be available at the bar. We will also have bottled water available for purchase.
15. Describe plans for supplying toilet and hand -washing facilities. Attach contract, agreement, or email
for the company providing portable toilets.
2 porta potties along with 1 hand washing station will be rented from Colorado Portables.
16. Describe plans for waste disposal and control of insects and rodents. Describe plans for clean-up of
any waste resulting from the event.
There will be multiple garbage and recycling cans placed around the event area. The waste will be disposed of in our weekly
garbage pickup. If necessary, excess waste will be taken to the landfill.
17. Describe any plans for restoration of the site.
Our property should not be damaged during the event. If it is, we will restore it.

No illumination is necessary as the event will be held during daylight only.
21. Describe any plans for sound control and sound amplification. Include the number, location, and
power of any amplifiers and speakers.
The band will provide speakers that will only project sound at a reasonable level. The band will use 2 speakers.
22. Describe transportation routes to the event, traffic control, access to the site, and on -site and off -site
parking, including number of spaces and surface material. Include authorization from other
owners/lessees if the access is shared, and authorization from owners for any off -site parking areas.
The parking lot will be accessible via our driveway which is accessible via County Line Rd. County Line Rd is accessible via
Highway 52. There are not dedicated parking spaces as parking will be on grass. Approximately 100 vehicles can be parked
on the property.
We have received authorization from our neighbors, Louie & Meghan Velasquez, who share access with us.
23. Describe plans for dust abatement.
We will hose down dry areas if need be.
24. Describe any plans for an electrical system. Separate permits are required if existing systems are not

The parcel is located in the the 100 -year floodplain of Boulder Creek, as depicted on the FEMA Firm Panel 08123CO-
2058F, revised November 30, 2023.
If all development on the site is temporary (less than 72 hours) and will be removed, then a floodplain permit (FP), that
addresses the temporary development of the site, is required for this event.
If any development associated with this limited event permit is to remain and to be permanent then a floodplain hazard
development permit is required.
CONDITION OF APPROVAL:
Temporary (less than 72 hours) improvements in the floodplain require a floodplain permit (FP). Permanent improvements

Road 1 (Case Number: LEP24-0001). The site is within the boundaries of the Mountain View
Fire Protection District and receives service from the District. The Fire District has no objections
to the use provided the requirements of the Fire District are met. Please see the following
comments.
• Permits shall be obtained from the Fire District for all tents in excess of 400 square feet or
individual vender tents that are not separated by at least 12 feet and the aggregate area of the
tents exceeds 700 square feet.
• The parking area and vender tent area shall be mowed so that ground -cover does not exceed 4 -
inches in height.
• Cooking appliances shall not be located beneath a tent or canopy.
• The vender area shall be provided with 5 -pound ABC extinguishers located within 75 feet of
travel distance.
