Introduction This impact report is provided pursuant to C.R.S. § 31-12-108.5. The Town of Lochbuie, Colorado (the "Town"), has received annexation petitions for approximately 83 acres of real property, more or less, located in unincorporated Weld County, owned by: BNSF Railway Company ("Property"). The Property is generally located at the southeast corner of CR41 an,d CR6. The property is adjacent to and east of I-76 and south of WCR 6, comprising a portion of Section 28 of Township IN, Range 65W, County of Weld, State of Colorado and is legally described in Exhibit A. The existing land use pattern of the Property is comprised of vacant, agricultural land, and the proposed land use pattern is anticipated to be an intermodal transportation facility that will provide for a combination of rail and transport service activities. The Property is proposed for zoning as industrial under Article 2 of Chapter 19 of the Lochbuie Municipal Code, as shown on Exhibit F-2. On September 17, 2024, the Town's Board of Trustees will hold a public hearing to consider whether it can annex the Property (eligibility and contiguity) considering the requirements and limitations under the Municipal Annexation Act of 1965. II. Exhibits The Property is depicted on the Annexation Map, attached hereto as Exhibit B. Pursuant to C.R.S. § 31-12-108.5, the annexation maps also include the present and proposed boundaries of the Town in the vicinity of the proposed annexation. Exhibits C -1 and C-2 and D-1 and D-2, collectively, show the following: the present streets, major trunk water mains, sewer interceptors and outfalls, other utility lines and ditches, and the proposed extension of such streets and utility lines in the vicinity of the proposed annexation. Exhibit E is the 2018 Comprehensive Plan, showing existing and proposed land use patterns in the vicinity of the property being annexed. However, the Town is currently in the process of updating its Comprehensive Plan. Exhibit F-1 is the Town's current Zoning Map, showing existing zoning in the vicinity of the proposed annexation. III. Utilities/Municipal Services Water and Wastewater The annexation will require the extension of water services to the property. The Town will provide water utility services to the Property, after the Property owner, or the then -current owner of the Property at the time of development application approval, satisfies all requirements of the Lochbuie Municipal Code, including the construction of all water infrastructure and facilities required to deliver the projected treated and non -potable water needs of the proposed development, including pressure and flow for normal operation of plumbing fixtures, water using appliances, requirements set by the responsible fire protection agency, and irrigation. The annexation will require the extension of wastewater services to the property. The Town will provide wastewater utility services to the Property, after the Property owner, or the then -current owner of the Property at the time of development application approval, satisfies all requirements of the Lochbuie Municipal Code, including the construction of all sanitary sewer infrastructure and facilities required to accommodate the sewage disposal needs of the proposed development. Other Utilities CenturyLink currently provides telephone service within the proposed annexation vicinity. No change in this service is proposed. United Power/Xcel Energy currently provides electrical service to the Property, and Xcel Energy provides natural gas service to the Property. No change in this service is proposed. Police and Fire Protection The Town provides its police protection and will extend police protection services to the Property, to the same extent and on the same terms and conditions as such services are provided to other properties throughout the Town. These services will be financed from the Town's general fund or other available revenues. Hudson Fire Protection District will provide fire protection services to the Property. These services will be financed through the Fire District's mill levy assessed against the Property. Street Maintenance and Improvements Any new streets or roadways to be constructed on the Property or off -site, based on the annexation proposal, will be the financial responsibility of the Property owner or developer. The Property owner will maintain all private streets serving the proposed development. The Town will maintain any such new public right-of-way after their construction and preliminary acceptance by the Town, indicating they have become part of the Town's municipal street system. The Town will provide all customary public roadway and maintenance services to any existing public streets or roadways that are being annexed, upon the same terms and conditions as such services are provided to other existing streets that are part of the Town's municipal street system. All customary roadway and maintenance services will be financed from the Town's general fund or other available revenues. Other Municipal Services Upon annexation, the Town shall provide all customary public safety (but excluding fire protection) services to the Property, to the same extent and on the same terms and conditions as such services are provided to other properties throughout the Town. These services will be financed from the Town's general fund or other available revenues. IV. Municipal Services Financing The property owner will be financially responsible for any required on -site and off -site public infrastructure and utility extensions to ensure the proposed development will be served by adequate water, sewer, and other utility services. The development and construction of future sewer, water, and storm sewer infrastructure may also be accomplished by one or more of the following financing methods: (a) Lochbuie development impact fees; (2) Lochbuie utility enterprise impact fees; (c) metropolitan districts; (d) downtown development or urban renewal authorities; (e) special improvement districts; and/or (f) otherwise by agreement between the Town and the developer as deemed appropriate. To the extent any other additional infrastructure construction is required, such construction can be accommodated within the Town's current budget. V. Special Districts The proposed annexation area is encompassed within the following districts: Hudson Fire Protection District Weld County RE -3J School District Aims Junior College Central Colorado Water (CCW) Central Colorado Water Subdistrict (CCS) High Plains Library West Adams Conservation All taxing entities are identified with the current 2023 property tax mill levy attached hereto as Exhibit G. VI. School District Impact The annexation's impact on the school district in terms of the number of students to be generated is as follows: The Property is anticipated to be developed for rail and transport service uses and, thus, the annexation proposal is not expected to generate a student -aged population and no additional capital construction by the school district is anticipated to be required. Consequently, annexing the Property will likely not negatively affect the local -public school district system. Any future development proposals will be sent to the School District for review and comments. That the Petition contains: (a) An allegation that it is desirable and necessary that such area be annexed to the Town of Lochbuie and the requirements of C.R.S. §§ 31-12-104 and 31-12-105 exist or are met. (b) An allegation that the signers of the Petition, comprise more than fifty percent (50%) of the landowners of the area proposed to be annexed and own more than fifty percent (50%) of the area proposed to be annexed, exclusive of public streets and alleys and any land owned by the Town of Lochbuie. (c) A request that the Town of Lochbuie approve the annexation of the Property, as more particularly described in Exhibit A. (d) The signature of the landowners that executed the petition. (e) The mailing address of the landowner signers. (f) The legal description of the Property and a legal description of the specific real property owned by the landowners that executed the petition. (g) The date that the landowners executed the petition. ;. That four (4) copies of the annexation map corresponding to the Property have been submitted to the Town with the Petition, and that each annexation map contains the following information: (a) A written legal description of the boundaries of the property proposed to be annexed. (b) A map showing the boundary of the property proposed to be annexed. (c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks. (d) Next to the property proposed to be annexed, a drawing of all contiguous municipal boundaries. 3. That no signature on the Petition is dated more than one hundred eighty (180) days prior to the date of filing of the Petition for Annexation with the Town Clerk of the Town of Lochbuie, State of Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Lochbuie, Colorado that: Section 1. That the foregoing recitals and findings are incorporated herein as findings and conclusions of the Town Board. Section 2. The Petition for Annexation of the real property described and shown in Exhibit A, attached hereto and incorporated herein by this reference, to be known as the Burlington Northern Santa Fe Annexation No. 4, is determined to be in substantial compliance with C.R.S. § 31-12-107(1). Section 3. No election is required under C.R.S. § 31-12-107(2). Section 4. No additional terms and conditions are to be imposed except as provided in each Petition for Annexation and in any annexation agreement which may be entered into by and between the Town of Lochbuie and the petitioner(s), which are not to be considered additional terms and conditions within the meaning of C.R.S. §31-12-112. Section 5. The Town Board shall hold a public hearing on the proposed annexation at a special meeting to be held on Tuesday, September 17, 2024, at 6:30 p.m., or as soon as thereafter possible, at the Lochbuie Town Hall, 703 WCR 37, Lochbuie Colorado 80603 and via teleconference with details on accessing such teleconference platform to be made publicly available on the Town web site at least 24 hours before the hearing, to determine if the proposed annexation as described in the Petition complies with Section 30 of Article II of the Colorado Constitution and C.R.S. §§ 31-12-104 and -105, or such parts thereof, as may be required to establish eligibility for annexation. Section 6. The Town Clerk shall publish a Notice of Public Hearing once a week for four successive weeks in a newspaper of general circulation in the area proposed to be annexed, Page 3 with the first publication of such notice to be at least thirty days prior to the date of the hearing. The Town Clerk shall further provide notice to the Clerk of the Board of County Commissioners of Weld County, the Weld County Attorney, and to any special district or school district having territory within the area proposed to be annexed, in the manner and within the time provided in C.R.S. § 31-12-108(2). Section 7. The Town staff and Town Attorney are hereby directed to take all such actions, including making any legal filings, as are necessary to comply with state law governing the process for annexing the Property. No annexation proceedings have been commenced for annexation of any part of the Property by any other municipality, nor has any election for annexation of the Property to the Town been held within the twelve (12) months immediately preceding the filing of this Petition; i. The annexation of the Property will not result in the detachment of area from any school district or attachment of same to another school district; J. Annexing the Property will not have the effect of extending the boundary of the Town of Lochbuie more than three miles in any direction from any point of the boundary of the Town of Lochbuie in any one year; k. Undertake negotiations with respect to an annexation agreement between the Town and Petitioner in form and substance acceptable to the Town and Petitioner ("Annexation Agreement") prior to the effective date of this annexation, as provided for in Chapter 31-12-112(2), Colorado Revised Statutes, as amended. 9. That the Property proposed to be annexed is located within special district(s) identified on Exhibit 3 and no other(s) and the undersigned consents to the Property's inclusion into those special districts. 10. That the undersigned Petitioner signed this Petition not more than one hundred and eighty (180) days prior to the date of the filing of this Petition with the Town Clerk. 11. That Petitioner has filed this Petition subject to the following conditions: a. The Town approves I Industrial zoning for the Property sufficient to support all 3 aspects of development and operation of BNSF's Intermodal Facility, in accordance with C.R.S. § 31-12-115 and Article II of Chapter 19 of the Lochbuie Municipal Code; and b. Approves and authorizes the execution of an Annexation Agreement acceptable to the Town and Petitioner at the time of adoption of the annexation ordinance. 12. That, upon the annexation of the Property becoming effective, and subject to the conditions set forth in this Petition and to be set forth in the Annexation Agreement, the Property shall become subject to all ordinances, resolutions, rules and regulations of the Town, except as otherwise set forth in the Annexation Agreement, and except for general property taxes of the Town, which shall become effective on January 1 of the next succeeding year following adoption of the annexation ordinance. 13. That the Petition contains: (a) An allegation that it is desirable and necessary that such area be annexed to the Town of Lochbuie and the requirements of C.R.S. §§ 31-12-104 and 31-12-105 exist or are met. (b) An allegation that the signers of the Petition, comprise more than fifty percent (50%) of the landowners of the area proposed to be annexed and own more than fifty percent (50%) of the area proposed to be annexed, exclusive of public streets and alleys and any land owned by the Town of Lochbuie. (c) A request that the Town of Lochbuie approve the annexation of the Property, as more particularly described in Exhibit A. (d) The signature of the landowners that executed the petition. (e) The mailing address of the landowner signers. (f) The legal description of the Property and a legal description of the specific real property owned by the landowners that executed the petition. (g) The date that the landowners executed the petition. That four (4) copies of the annexation map corresponding to the Property have been submitted to the Town with the Petition, and that each annexation map contains the following information: (a) A written legal description of the boundaries of the property proposed to be annexed. (b) A map showing the boundary of the property proposed to be annexed. (c) Within the map, the boundaries and the plat numbers of plots or of lots and blocks. (d) Next to the property proposed to be annexed, a drawing of all contiguous municipal boundaries. 3. That no signature on the Petition is dated more than one hundred eighty (180) days prior to the date of filing of the Petition for Annexation with the Town Clerk of the Town of Lochbuie, State of Colorado. NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Lochbuie, Colorado that: Section 1. That the foregoing recitals and findings are incorporated herein as findings and conclusions of the Town Board. Section 2. The Petition for Annexation of the real property described and shown in Exhibit A, attached hereto and incorporated herein by this reference, to be known as the Burlington Northern Santa Fe Annexation No. 5, is determined to be in substantial compliance with C.R.S. § 31-12-107(1). Section 3. No election is required under C.R.S. § 31-12-107(2). Section 4. No additional terms and conditions are to be imposed except as provided in each Petition for Annexation and in any annexation agreement which may be entered into by and between the Town of Lochbuie and the petitioner(s), which are not to be considered additional terms and conditions within the meaning of C.R.S. §31-12-112. The Town Board shall hold a public hearing on the proposed annexation at a special meeting to be held on Tuesday, September 17, 2024, at 6:30 p.m., or as soon as thereafter possible, at the Lochbuie Town Hall, 703 WCR 37, Lochbuie Colorado 80603 and via teleconference with details on accessing such teleconference platform to be made publicly available on the Town web site at least 24 hours before the hearing, to determine if the proposed annexation as described in the Petition complies with Section 30 of Article II of the Colorado Constitution and C.R.S. §§ 31-12-104 and -105, or such parts thereof, as may be required to establish eligibility for annexation. Section 6. The Town Clerk shall publish a Notice of Public Hearing once a week for four successive weeks in a newspaper of general circulation in the area proposed to be annexed, Page 3 with the first publication of such notice to be at least thirty days prior to the date of the hearing. The Town Clerk shall further provide notice to the Clerk of the Board of County Commissioners of Weld County, the Weld County Attorney, and to any special district or school district having territory within the area proposed to be annexed, in the manner and within the time provided in C.R.S. § 31-12-108(2). Section 7. The Town staff and Town Attorney are hereby directed to take all such actions, including making any legal filings, as are necessary to comply with state law governing the process for annexing the Property. The Property is not presently part of any incorporated city, city and county, or town; h. No annexation proceedings have been commenced for annexation of any part of the Property by any other municipality, nor has any election for annexation of the Property to the Town been held within the twelve (12) months immediately preceding the filing of this Petition; i. The annexation of the Property will not result in the detachment of area from any school district or attachment of same to another school district; J. Annexing the Property will not have the effect of extending the boundary of the Town of Lochbuie more than three miles in any direction from any point of the boundary of the Town of Lochbuie in any one year; k. The entire width of all streets and alleys to be included within the Property are included; 1.
