HomeMy WebLinkAbout20240643.tiffRESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY ROAD 78 BETWEEN UNION PACIFIC RAILROAD RIGHT-OF-WAY AND COUNTY ROAD 37 - WELD COUNTY DEPARTMENT OF PUBLIC WORKS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Petition for Vacation of Right -of -Way from the Weld County Department of Public Works, 1111 H Street, P.O. Box 758, Greeley, Colorado 80632, a copy of said petition and a list of the adjoining property owners marked Exhibit "A", being attached hereto and included by reference, requesting vacation of a portion of right-of-way for County Road 78, being 1,267 feet in length, more or less, between Union Pacific Railroad right-of-way (adjacent to U.S. Highway 85) and County Road 37, being more fully described as follows: The public road right-of-way lying thirty (30) feet on either side of the section line, commencing at the SE1/4 of Section 24 and the NE1/4 of Section 25, Township 7 North, Range 66 West of the 6th P.M., Weld County, Colorado; being more particularly described as being the south 30 feet of the SE1/4 of Section 24 and the north 30 feet of the NE1/4 of Section 25, from the easterly property line of the Union Pacific Railroad to the westerly right-of-way line of County Road 37, as further described in Exhibit "B" WHEREAS, the Department of Public Works has recommended approval of said request since that portion of right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of right-of-way, with said vacation to become effective upon recording as required below. 4961007 Pages: 1 of 5 05/17/2024 11:50 AM R Fee:$0.00 Carly Koppes, Clerk and Recorder, Weld County , CO cc: puiccH/ON/op I0n1sa), Pic f.R/ cnn ), CAc55,/IS r) o5 M91 all 2024-0643 EG0082 VACATION OF A PORTION OF COUNTY ROAD 78 BETWEEN UNION PACIFIC RAILROAD RIGHT-OF-WAY AND COUNTY ROAD 37 - WELD COUNTY DEPARTMENT OF PUBLIC WORKS PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for Vacation of Right -of -Way from the Weld County Department of Public Works, be, and hereby is, accepted. BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is described above, be, and hereby is, vacated. BE IT FURTHER RESOLVED by the Board that any persons owning dedicated and recorded easements and rights -of -way for the use of the vacated right-of-way, if any, shall not be affected by the right-of-way vacation authorized herein. BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral interests it may possess in the area of the vacated right-of-way and that the vacation authorized herein shall in no away affect such mineral interests. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to record this Resolution and the attached Exhibits "A" and "B" in the records of the Weld County Clerk and Recorder. PURPOSE During the engineering phase of a cul-de-sac design for WCR 78 it was proposed by the majority landowner to vacate the rights -of -way of WCR 78 between the Union Pacific Railroad (UPRR), and WCR37. The process for Weld County to vacate ROW is done in accordance with the requirements of C.R.S. Section 43-2-303(2)(b) and Weld County Code Chapter 8, Article 16. Therefore, the purpose of this request is to vacate WCR 78 between the closed UPRR crossing and WCR37. BACKGROUND Weld County Public Works coordinated with the Colorado Department of Transportation (CDOT), and UPRR, related to the negotiated closure of twelve county road crossings of UPRR, of which this application specifically relates to the railroad crossing located east of U.S. 85 between the towns of Eaton and Ault at WCR 78. RIGHTS -OF -WAY REQUESTED TO BE VACATED County Road 78 Weld County Public Works petitions to vacate all of that county road ROW of Weld County Road 78 that is described and depicted in Exhibit B, attached hereto ("WCR 78 ROW"). The WCR 78 ROW is approximately 1,267 feet in length and 60 feet in width and is located between UPRR ROW and WCR37. UTILITIES; MUNICIPALITIES: ROAD ACCESS No portion of any of the County Road Rights -of -Ways described herein are located within the limits of any incorporated town or city, or on the boundary of any other county.
