Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Diana Aungst Department of Planning Services Code Compliance Officer, Cynthia Villanueva The following business was transacted: =! I hereby certify that pursuant to a notice dated October 11, 2024, a public hearing was conducted to consider the request of staff, to revoke Zoning Permit, ZPAG23-0003, for certain uses Agricultural Support and Service (trucking company principally engaged in the hauling of agricultural products) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a summary of the request and described the property location. She stated, pursuant to Section 23-4-1200.C of the Weld County Code, a revocation hearing was requested before the Board of County Commissioners for Zoning Permit, ZPAG23-0003, which was approved administratively on July 17, 2023, for a trucking company, which is located approximately one (1) mile north of Galeton. Ms. Aungst explained there are five (5) Conditions of Approval (COA), including a change of use for the maintenance shop, which are outstanding on the ZPAG. She explained the property was previously permitted under USR16-0003, which was revoked on August 9, 2017, via a Show Cause Hearing. She relayed the application depicts two (2) existing structures, including an existing single family residence and a commercial maintenance shop, with a proposed 70 -foot by 17 -foot lean-to structure. She stated a change of use Building Permit is required in order to utilize the shop for the maintenance of the trucks, and a building permit was not obtained for the lean-to structure. Ms. Aungst explained, although multiple requests have been made for completion of the Conditions of. Approval, per Section 23-4-1200.C, no action has been taken by the property owner, and as of October 14, 2024, no building permit has been submitted. She explained the courses of action available to the owner, stating COA #1.B and #1.C have been addressed. In response to Commissioner Saine, Ms. Aungst confirmed the building, having housed a trailer, is not GG: PL (DE/ew/£R/r /Mua/KR) 1 /22/2'1 2024-2719 PL2421 HEARING CERTIFICATION - ROGER AND SHERYL HILL (ZPAG23-0003) PAGE 2 classified as an agricultural building but a detached accessory building; however, in either case, no building permit was applied for. Roger Hill, property owner, relayed the site has been cleaned up and they are making every attempt to come into compliance. He explained he had an Engineer look at the structure to confirm approval of a building permit, and stated he is working on resolving the noncompliance issues. In response to Commissioner James, Ms. Aungst stated a building permit has not yet been applied for, and Mr. Hill said he would apply for one this week. In response to Chair Ross, Ms. Aungst reiterated COA #1.6 and #1.C have been satisfied. Chair Ross pointed out the COAs that have not yet been met, confirming with Mr. Hill his understanding of completion of the noncompliant issues. Mr. Hill stated the cost would be the deciding factor to complete the noncompliant issues, and suggested 60 days would suffice. In response to Commissioner Saine, Cynthia Villanueva, Code Compliance Officer, Department of Planning Services, relayed the cost of a building permit is a difficult estimate; however, a free permit would be available for an agricultural building permit, as long as no personal items are stored in it. El Commissioner Saine moved to continue the matter to December 18, 2024, at 10:00 a.m., to allow additional time for the property owner to complete the Conditions of Approval which are out of compliance. The motion was seconded by Commissioner Buck, a roll call vote was taken, and it carried three (3) to two (2), with Commissioners Ross and Freeman voting no. There being no further discussion, the hearing was completed at 10:18 a.m. This Certification was approved on the 6th day of November, 2024.
